HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: FINAL TRACT MAP NO. 13746 RECOMMENDATION CONSENT CALENDAR NO. 9 9-17-90 Inter - Com It is recommended that the City Council approve Final Tract Map 13746 by the adoption of Resolution No. 90-118, as submitted or revised. BACKGROUND AND SUMMARY The Planning Commission at its meeting of September 10, 1990 recommended to the City Council approval of Final Map 13746. The proposed subdivision will. create 3 lots -to accommodate construction of 316 multiple family units at an overall density of 18 dwelling units per acre. The City Council previously approved the Tentative Tract map for the project at a meeting on September 5, 1990. The subject site is bounded by Keller Drive on the north, Jamboree Road to the east, Irvine Boulevard to the south and Robinson Drive to the west. Planned and anticipated development in the vicinity includes a 252 unit apartment development and proposed retail site to the south across Irvine Boulevard, a future Medium Density Residential project to the west across Robinson Drive and a proposed community park and elementary school to the north. CONCLUSION The Vesting Tentative Map approved for this project included various conditions of approval which required adjustments to the map. All of the required revisions are reflected upon the Final Map and the required conditions of approval have been met. It has been determined that the Final Map is in conformance with the Vesting Tentative Map approval, requirements of the East Tustin City Council Report Final Tract Map No. 13746 September 17, 1990 Page 2 Specific Plan, Development Agreement, the City's Subdivision Code, the East Tustin EIR and the State Subdivision Map Act. Based upon the conformance, it is recommended that the City Council adopt Resolution No. 90-118, approving Final Map 13746. A e E. Bonner Christine A. The City Council finds and determines as follows: A. That Final Tract Map No. 13746 has been submitted by Akins Development Company to subdivide 17.464 acres into (three) 3 numbered and four (4) lettered lots to accommodate multiple family development. B. That a public hearing was held by the Planning Commission on August 14, 1989. At that hearing, the Planning Commission recommended approval of Vesting Tentative Tract Map 13746 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 13746 on September 5, 1989. C. That the Planning Commission at its meeting of September 10, 1990 recommended to the City Council approval. of Final Tract Map 13746. D. The Final Map is considered ministerially exempt pursuant to Section 15268(B) of the California Environmental Quality Act. E. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to the development of single family dwellings. F. The 2.06 acres of parkland required for this development was previously dedicated with recordation of Tract 12870. G. That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract Map 13746 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. H. That the site is physically suitable for the type of development proposed. I. That the site is physically suitable for the proposed density of development. J. K. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public -at -large, for access through or use of the property within the proposed subdivision. L. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. M. That the Final Map is in substantial conformance with the Vesting Tentative Map. II. The City Council hereby approves Final Tract Map No. 13746, subject to final approval of City Engineer.
