HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: AMENDMENT TO THREE YEAR PARTICIPATION AGREEMENT WITH COUNTY OF ORANGE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM RECOMMENDATION It is recommended that the City Council approve the amendment to the three year participation agreement with the County of Orange Community Development Block Grant Program by minute order. BACKGROUND On August 16, 1990 the City Council adopted Resolution No. 90-94 approving the City's continued participation in the Housing and Community Development Block Grant Program for fiscal years 1991, 1992 and 1993 with the County of Orange. On September 20, 1990, EMA Housing and Community Development received a telecommunication from Los Angeles area office of the U.S. Department of Housing and Urban Development indicating that two clauses would have to be added to the County's Standard Urban Community Development Block Grant Cooperation Agreement. The County is now asking all participant cities to amend their previously approved agreements to reflect the federal government's request. This cooperation agreement is a vital part of HUD's determination on funding levels for the County of Orange and all participating cities. W I T N E S S E T H WHEREAS, as on September 5, 1990, an Agreement to Cooperate in the Urban County's unity Development Block Grant Program was approved by the County of Orange, and WHEREAS, the Agreement was concurrently approved by each participating, and submitted to the U.S. Department of Housing and Urban Development (HUD) for final oval, and WHEREAS, HUD subsequently directed the COUNTY to amend its cooperation to include additional clauses described below, NOW THEREFORE, this Amendment to Cooperation Agreement is hereby agreed to and ded as following: Contract Additions: 16. The CITY and COUNTY agree that Community Development Block Grant funding .or any activities in or in support of any cooperating CITY, that does not affirmatively .urther fair housing within its own jurisdiction, or that impedes the COUNTY's action to ;omply with its fair housing certification is prohibited. 17.
