APPROVAL OF Correction in Item IX - 2, Minute Order regarding MINUTES Tic Toc Market sign to read: That removal bond fc~.; sign at Mc Fadden Street market be extended for 1~' days to allow Tic Too Markets to remove existing sign and install sign conforming to the origina~ co~itions ss established by the Council. YORBA STREET ANNEXATION # 3 HEARINGS Proposed annexation to the City of Tustin of approximately 10.58 acres located west of Yorbs Street, south of Seventeenth Street to approximstei.. 1200' north of Fourth Street. Hearing opened at 7=35 P.M. There being no written or oral protests or comments the hearing was declared closed at 7:36 P.M. Moved by Coco, second by Klingelhofer that No. 3~, ap'~roving the annexation of Certain ~abited territory, designated Yorba Street ~.ion No. ~ have first reading by title only. Carried unanimously. 2. ZONE CHANGE 65.148 - CITY OF TUSTIN To permit a change of zone from C-2to C-1 on the property located on the S.qu~esst corner of LaCuna Road and Newport Ave., Tustin. Hearing opened at 7:38 P.M. Staff rePort and recommendation of the Planning Commission & Staff presented by Mr. Taylor. Mr. Warren Finley spoke on behalf of the origin~ apolicznts for zone change to C-2 on this proper~ end pPesented ~ map showing the ares and uses. Moved by Ring, seconded by Coco that hearing re- garding the Sign Ordinance be continued to the next regular meeting of February 21st. Carried. 4. PRE-ZONIG~ AMENDING ORDINANCE NO. 157 AS AMENDED To consider amending Sections 3.4 and 10.2 of the Zoning Ordinance to allow Dre-zonin~ of property located in unincorporsted County areas adjacent to City boundaries. Hearing opened st 8:10 P.M. Staff report and recommendation of Planning Commission presented by Mr. Taylor. There being no comments or objections the hearing was closed at 8:ll P.M. Moved by Ring, seconded by Coco that Ordinance No. 30J., amending the Zoning Ordinance No. 157, as amended, have fir_st reading by title only. Carried unanimously. VI OLD BUSINESS NONE VII. NEW BUSINESS 1. RESOLUTION NO. 812 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING PLANS AND SPECIFICATIONS FOR THE IMPROVEMENT OF FIRST STREET BETWEEN PROSPECT AVENUE AND NEWPORT AVENUE, AND AUTHORIZING AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS Council Minutes 2/7/66 Pg- 3 Moved by Ktingelhofer~ seconded by Ring that Resolution No. 812 be read by title only. battled unanimously. RESOLUTION NO. 813 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING PLANS AND SPECIFICATIONS FOR THE IMPROVEMENT OF IRVINE BOULEVARD BETWEEN 330' S.E. OF NEWPDRT AVENUE AND ELIZABETH WAY AND AUTHORIZING AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS. Moved by Coco~ seconded by Ring that Resol~_o_~ No. 81t be read bJ. title on_~Z. Moved by Rir~, seconded by Miller that Resolution No. 813, approving plans and specifications for the improvement of irvine Blvd. between 5~0~ S.E. of Newport Ave. end'L"~,~izabethT_i~;~X and authorizing and directing the City Clerk to advertise for bids, be passed and adopted. Carried by roll call. Ayes: Mask, Klingelhofer, Coco, Miller, Ring. Noes: Nonc~ Absent: None. Mr. Gill was directed to notify individual owners in the area that ~his Dro~ect is being accomplished. 3. ORDINANCE NO. 302 ........ ~ ........~..~ - Uniform City Food Ordinance AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING CHAPTER ll OF THE TUSTIN CITY CODE, RELATIVE TO FOOD AND FOOD ESTABLISHMENTS Moved by Coco, seconded by Ring that Ordinance .No. 30!~ amending Chapter ll of the ~g~n ~f~'y Code, relative to food and food es~Dl!EDments., have first readinJ,_by title only. Carried unanimously. 4. AGREEMENT WITH SOUTHERN PACIFIC RAILROAD For installation of drainage structure under railroad tracks near Main Street. Moved by Klingelhofer, seconded by Ring that the ~ayor and City Cler~_)_e s~uthorized to execute agreement with the Southern PacificCo_~ for construction of a drainage culvert under tracks near Main Street~ Tustin. Carried. 5. AGREEMENT WITH COUNTY 0F ORANGE For the improvement of Fourth Street - Newport Freeway to Newport Avenue. Council Minutes 2/7/66 Pg. 4 Moved by Ring, seconded by Klingelhofer, that the Mayor and City Clerk be authorized to execute agreement with the County of OrsnEe for improving Fourth StreeT· Carried. The Council requested that The City Administrator investigate the feasibility of having water piped to the center isle of Fourth St. 6. ORANGE COUNTY FLOOD CONTROL PERMIT-FIRST ST. Moved by Coco~ seconded by Miller that the City Engineer be authorized to sign the 0rsnee County Flood Control District ~ermit for modification of the East Tustin Storm Drain on First Street from Prospect to Newport. Carried. 7- TRACT 5726 - HARBOR HALL OF FAME Request for appeal of the Council's decision regarding the construction of s masonry wall along the west boundary of Tract 5726. Mr. Charles Cox spoke on behalf of Harbor Hall of Fame, builders of Tract 5726 and presented a plan of the area showing loc~tion of proposed w~ll including elevations etc. Moved by Miller, seconded by Coco that permission be ~rsnted Harbor Hall of Fame to erect s bloc~ wall as re~ueste~ subject to requirements of the Building Department for construction details -- and that adesua~e irrigation be provided for planting subject to recuirements of the Parks & Recreation Commission, also planting be s~roved by this Commission. Carried. Councilmen Ring voting No. 8. TRACT 4997 - Acceptance of improvements and exoneration of bonds. Moved by Ring, seconded by Klingelhofer that the improvements in Tract 499? be scce~ted and that the bonds be exonerated. 9. APPROVAL OF DEMANDS Moved by Klingelhofer, seconded by Coco that demands in the amount of S29~177-24 be approved and paid. Motion carried. VIII. REPORTS & 1. BOARD OF APPEALS - FIRE ZONES OTHER BUSINESS Mr. W. HockenberrX, member of the Board of Appeals spoke regarding Fire Zones. in the Industrial Areas in the City and presented the following recommendations on behalf of the Board: 1. The Council initiate the necessary action to change the Fire Zone in the subject area from Fire Zone 2 to Fire Zone 3- Council Minutes 2/7/66 Pg. 5 Bd. of Appeals cont. 2. That a jouint study by the Staffs of the Planning Department and Fire Deoartment be undertaken to determine maximum land cover- age, proximity of buildings, and other methods of keeping the flame soread potential to a reasonable minimum for the area. Mr. B. Williamson, re,resenting U. S. Plywood s~oke in favor of Fire Zone 3 for industrial areas. Mayor Mack instructed the Cit~ Administrator to check with those concerned and the major ~ro~erty owners in the industrial ares including Irvine Co. and the Ssnt~ Fe Land improvement Co. re- garding Fire Zones and report at nex~ regular meeting. 2. CLAIM OF ARCHIE DALE DONALDSON Moved by Klingelhofer, seconded by Ring that ~laim of Archie Dale Donaldson be referred to the City. Attorney for investigation, report, & recommendation. Carried. 3. TIC TOC MARKET SIGN - McFadden St. Market Report from the City Administrator and City Attorney presented to the Council. Mr. Ring stated that he had made a survey of the ares and had found no objections to the existing sign° Moved by Klimgelhofer, seconded by Ring that Tic Too Market Sign be permitted to stand as it ~xists and bond be returned. Moved by Coco, seconded by Miller that the City accept the agreement of Tid Toc Market to install a non-standard sign of 24 feet 6 inches high & 7~ X ~ square and that they be granted permission to install a 2~ X 7~ cartel indicating hours of operation on the same pole, below the clock. Motion carried. Councilmen Ring and Klingelhofer voting No. 4. TRAVEL REQUEST - COUNCILMEN RING Moved by Miller, seconded by Coco that Councilman Ring be ~rsnted permission to attend the first meeting of the League of California Cities Da~s ProcessinK Committee to be held March lOth & llth in San Francisco. COMMISSION __ Moved by Ring~ seconded by Klingelhofer that aporovsl be granted to members of the Parks & ReCreation Commission to attend certain selected sessions of the California & Pacific Southwes~ Recreation Conference, March 5-9 so be held in Los Angeles. Cost not to exceed ~150.00. Carried° IX. CORRESPON- DENCE 1.
