HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ORANGE COUNTY CONGESTION MANAGEMENT PLAN (CMP) CONSENT CALENDAR NO. 10 11-5-90 Inter - Com RECOMMENDATION: That the Tustin City Council adopt the attached Resolution for the designation of a Congestion Management Program Agency for Orange County. BACKGROUND: As a result of the passage of proposition 111 in June, 1990, both the County of Orange and all Orange County cities are required to designate a Congestion Management Plan (CMP) Agency. On December 1, 1991, the Orange County Transportation Authority (OCTA) will formally go into effect with a board composed of six (6) City Council Members, four (4) County Supervisors and one (1) Public Member. As an interim measure, the existing CMP process inclusive of the Technical Advisory Committee and the Policy Task Force, would be utilized to produce the initial CMP for Orange County. The Policy Task Force would approve the CMP and the Orange County Transportation Commission (OCTC) will adopt the CMP as an interim process. These actions will allow local transportation projects that relate to the CMP to be considered for State and Federal Funds. DISCUSSION: The attached Resolution provides for the following: 1. Designation of the Orange County Transportation Authority (OCTA) as the Congestion Management Program Agency for Orange County. 2. City of Tustin recognizes that the initial Baseline CMP for Orange County will be adopted through the established Technical Advisory Committee the Policy Task Force and the Orange County Transportation Commission as an interim process until the OCTA is established. 3. Designation of the Congestion Management Program Agency for Orange County will be reconsidered, if the provisions of SB 838 are not implemented by December 1, 1991. Staff request the passage and adoption of the attached resolution designating a Congestion Management Program Agency for Orange County. WHEREAS, the passage of Proposition 111 requires the preparation and implementation of a comprehensive Congestion Management Plan in each of California's urban counties; and WHEREAS, compliance with Congestion Management Plan requirements is necessary for Orange County jurisdictions to be eligible for new state gas revenues; and WHEREAS, Orange County's cities, the County of Orange, and county transportation agencies are engaged in a cooperative process to develop a blueprint for Orange County's first Congestion Management Plan; and WHEREAS, the cooperative process includes a Technical Advisory Committee of staff representatives from each impacted interest group and Policy Task Force of city and county elected officials; and WHEREAS, the Congestion Management Plan blueprint process has provided for strong input and participation from all affected interest groups and agencies; and WHEREAS, legislation to implement Proposition 111 requires cities and the County of Orange to designate a local agency to approve, implement and monitor Orange County's Congestion Management Plan; NOW, THEREFORE, BE IT RESOLVED, that the City of Tustin designates the Orange County Transportation Authority as defined by SB 838 (Bergeson) as the Congestion Management Program Agency for Orange County, and BE IT FURTHER RESOLVED that the City of Tustin recognizes that the initial baseline Congestion Management Plan for Orange County will be adopted through the established Technical Advisory Committee, the Policy tasks Force and the Orange County Transportation Commission as an interim process outlined on Exhibit "A" until the OCTA is established: and BE IT FURTHER RESOLVED that the designation of the Congestion Management Program Agency for Orange County shall be reconsidered if the provisions of SB 838 are not implemented by December 1, 1991. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15� i 16! 17 18 19 20 21 22 23 24 25 26 27 28 Resolution 90-139, Page 2 PASSED AND ADOPTED by the City Council of the City of Tustin, California, this 5th day of November, 1990. ATTEST: City Clerk Mayor EXHIBIT A DEVELOPMENT AND ADOPTION PROCESS FOR INITIAL ORANGE COUNTY CONGESTION MANAGEMENT PLAN (CMP) 1 I'u ► • u:� A. The draft CMP document will continue to be prepared under the auspices of the multi - agency management steering committee consisting of OCTC, OCTD, Transportation Corridor Agencies, Leagues of Cities and the County of Orange. B. The County will continue to administer the consultant contract and serve as project manager for the completion of the initial CM P. A. Orange County Transportation Authority, (OCTA) established pursuant to SB 838 would be designated as CMP Lead Agency. B CMP Adoption Process would remain as currently established. Specifically: 1. CMP Policy Task Force would approve the CMP prior to submittal to OCTA. Action by the 10 City representatives would eliminate the need for separate action by all 29 Orange County Cities. 2. The current Technical Advisory Committee and public workshop structure would remain in effect. All items to be considered by the Task Force would be subject to prior review at Technical Advisory Committee meetings and public workshops. 3. The Orange County Transportation Authority (or Commission) would adopt the initial CMP at public hearing. 111. CMP IMPLEMENTATION, MONITORING AND APPEAL PROCESSES The proposed Orange County CMP would specify the precise implementation, monitoring, and appeal requirements; however, the following two items have been determined at this time. 1. The conformity determination and appeal process for reviewing individual jurisdiction compliance with the CMP will be modeled after and, to the extent feasible, utilize the existing AHFP Conformity Process: A) AHFP TAC Determination of Conformity B) AHFP` PAC Recommendations C) OCTA to Make Final Determination 2. The CMP consistency/conformity review process will only include those items required by statute.
