HomeMy WebLinkAboutAGENDA 10-15-90AGENDA REGUL � MEETING OF THE TUSTIN C1__, -COUNCIL OCTOBER 15, 1990 The City Council meets the 1st and 3rd Monday of every month at 7:00 p.m. in the City Council Chamber at 300 Centennial Way. This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk's office for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the books located at the Police Department, Tustin Library and, on the evening of the meeting, at the rear of the Council Chambers. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chambers; however, if you desire to smoke, an outside speaker has.been..provided. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE II. GENERAL PLAN AMENDMENT 90-02 AND ZONE CHANGE 90-03 The Planning Commission, at their regular meeting of October 8, 1990, recommended City Council approval of General Plan Amendment 90-02 and Zone Change 90-03 for 7.826 acres located in the vicinity of Newport and Warren Avenues and recently annexed to the City (Annexation No. 149). Recommendation by the Community Development Department: (a) Approve the Environmental Determination for the project by adopting the following Resolution No. 90-132: RESOLUTION NO. 90-132 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING FINAL NEGATIVE DECLARATION AS ADEQUATE FOR GENERAL PLAN AMENDMENT 90-02 AND ZONE CHANGE 90-03, INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (b) Adopt the following Resolution No. 90-133 approving General Plan Amendment 90-02: RESOLUTION NO. 90-133 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT 90-02 TO DESIGNATE ON THE GENERAL PLAN LAND USE MAP CITY COUNCIL AGENDA PAGE 1 OCTOBER 15, 1990 CERTA ?ROPERTY AS PC (PLANNED C JNITY) FOR THE PROPERTY IN THS, vICINITY OF NEWPORT AVENUE ,iND WARREN AVENUE (c) Have first reading by title only and introduction of the following Ordinance No. 1052: ORDINANCE NO. 1052 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 90-03 TO ZONE PROPERTY LOCATED ON 7.826 ACRES IN THE VICINITY' OF NEWPORT AND WARREN AVENUES TO PC (PLANNED COMMUNITY). THE APPLICANT FOR THIS ZONE CHANGE IS THE CITY OF TUSTIN 2. RECOVERY OF CITY INCURRED COSTS FOR REMOVAL OF AN ABANDONED SIGN AT 17601 SEVENTEENTH STREET A City work order was carried out on August 31, 1990, to remove an abandoned sign located on property at 17601 Seventeenth Street. Recommendation: Adopt the following Resolution No. 90-131 approving a special assessment of one hundred nine dollars and twenty cents ($109.20) ,as recommended by the Community Development Department: RESOLUTION NO. 90-131 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ASSESSING THE PROPERTY LOCATED AT 17601 SEVENTEENTH STREET (ASSESSOR'S PARCEL NO. 395-301-05) FOR THE COST INCURRED BY THE CITY FOR THE REMOVAL OF AN ABANDONED SIGN VI. PUBLIC INPUT - At this time members of the public may address the City Council regarding items not on the agenda within the subject matter jurisdiction of the City Council provided that NO action may be taken on off -agenda items unless authorized by law. VII. CONSENT CALENDAR - All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1. APPROVAL OF MINUTES - OCTOBER 1, 1990 REGULAR MEETING Recommendation: Approve the City Council Minutes of October 1, 1990. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $2,422,482.70 and ratify Payroll in the amount of $255,762.66. 3. RESOLUTION NO. 90-129 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR CITY ENTRY MONUMENT SIGNS Recommendation: Adopt Resolution No. 90-129 accepting works of improvement and authorizing the recordation of the Notice of Completion for three City entry monument signs as recommended by the Community Development Department. ACCEPTANCE PUBLIC IMPROVEMENTS WITI TRACT NO. 13822 Recommend,.ion: Accept all public imp.Ljvements related to Tract No. 13822 and authorize the release of the following improvement bonds: Faithful Performance Bond No. 3SM71925700, $561,000; Labor and Materials Bond No. 3SM71925700, $28,000; and Monumentation Bond No. 3SM71925900, $2,000 as recommended by the Public Works Department/Engineering Division. 5. RESOLUTION NO. 90-135 - A RESOLUTION OF THE CITY COUNCIL OF -THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR CONSTRUCTION OF TRAFFIC SIGNAL IMPROVEMENTS AT MAIN STREET AND STONEGLASS, MAIN STREET AND EL CAMINO REAL, AND WALNUT AVENUE AND FRANKLIN AVENUE Recommendation: Adopt Resolution No. 90-135 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/Engineering Division. 6. CALTRANS AGREEMENT NO. 12-028 A-2 Recommendation: Approve the amendment to the Cooperative Agreement No. 12-028.A-2 between Caltrans and the City subject to final review and approval of the City Attorney as recommended by the Public Works Department/Engineering Division. 7. NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) STORM WATER PERMIT IMPLEMENTATION AGREEMENT Recommendation: (1) Authorize the Mayor to execute the joint agreement for implementation of the National Pollutant Discharge Elimination Systems (NPDES) Permit as approved by the City Attorney; and (2) Allocate $16,159.39 for the City's first year percentage share of the total program costs for the permit and the implementation of the permit requirements as recommended by the Public Works Department/Engineering Division. 8. RESOLUTION NO. 90-130 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, STATING COMMITMENT TO PLACE SAVINGS FROM SEASONAL WATER STORAGE SERVICE AND INTERRUPTIBLE SERVICE INTO A SPECIAL ACCOUNT Recommendation: Adopt Resolution No. 90-130 stating commitment to place savings from Seasonal Water Storage Service and Interruptible Service into a special account as recommended by the Finance Department. 9. AWARD OF CONTRACT FOR ANNUAL LANDSCAPE MAINTENANCE - EL CAMINO REAL Recommendation: Award the contract for the Annual Landscape Maintenance E1 Camino Real Program to Landscape West, Inc. for the annual amount of $14,220.00 as recommended by the Public Works Department/Engineering Division. 10. CALTRANS TRAFFIC CONTRACT Recommendation: Authorize the contract with the Department of Transportation for reimbursement of monies spent for traffic control during the Interstate 5 and State Route 55 construction as recommended by the Police Department. 11. RESOLUTION NO. 90-134 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, SUPPORTING THE REPEAL OF SB 2557, STATE BUDGET ACTIONS Recommendation: Adopt Resolution No. 90-134 supporting repeal of SB 2557, legislation that permits counties to charge cities CITY COUNCIL AGENDA PAGE 3 OCTOBER 15, 1990 for boo]' . prisoners and collect' recommenu-.A by the City Manager. JOHN WAYNE AIRPORT ACCESS PLAN Iof property taxes as At the September 17, 1990 City Council meeting, the City Attorney was directed to conduct an in-depth review of the EIR for the Airport Expansion in an attempt to identify areas of non- compliance with the County -approved Airport Access Plan. Recommendation by the City Attorney: (a) The City continue to monitor airport noise and airport operations for any new circumstances or facts that could trigger the legal requirement for a supplemental or subsequent EIR; (b) The City actively monitor, review and participate in the adoption of the final cargo carrier policy; and (c) City staff follow-up with the County on the status of the mitigation measure to request an FAA study of descent patterns. 2. GRAFFITI REMOVAL PROGRAM UPDATE AND PROPOSED STUDY APPROACH Status report on one component of the Southwest Neighborhood Stabilization Program, establishment of a graffiti removal program to facilitate removal of graffiti on private property. Recommendation: Receive and file subject report as recommended by the Community Development Department. XI. NEW BUSINESS 1. PARK DAME POLICY/GUIDELINES At the October 1, 1990 City Council meeting, Councilmember Potts requested a report from staff regarding naming a park in honor of Ursula E. Kennedy. Mrs. Kennedy was the first elected Councilwoman and first female Mayor of Tustin. Recommendation: Pleasure of the City Council. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - OCTOBER 3, 1990 PLANNING COMMISSION ACTION AGENDA - OCTOBER 8, 1990 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. DESIGN UPD - NEIGHBORHOOD PARR IN 7 T 12763 Status report on the 3.0 acre park site located on the southwest corner of Heritage Way and Myford Road. Recommendation: Receive and file subject report as recommended by the Community Services Department. 3. AD HOC CHILD CARE COMMITTEE UPDATE Status on the progress toward the goal of developing a comprehensive report on child care in the City. Recommendation: Receive and file subject report as recommended by the Community Services Department. 4. INVESTMENT SCHEDULE Investment Schedule as of September 30, 1990.
