SUBJECT: RECOVERY OF CITY INCURRED COSTS FOR REMOVAL OF AN ABANDONED
SIGN AT 17601 SEVENTEENTH STREET
RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 90-131
approving a special assessment of one hundred nine dollars and
twenty cents ($109.20).
BACKGROUND/DISCUSSION
The subject property is developed with an office building and is
located at 17601 Seventeenth Street. On May 2, 1990, staff
received a complaint from the Planning Commission of a hazardous
condition due to an abandoned sign located on the southeastern
portion of the subject property. Pursuant to Tustin City Code
Section 9442, the City must give notice to the property owner
related to the abandoned sign and require its removal or
correction.
Accordingly, staff sent a certified Notice and Order on May 18,
1990 requesting that the property owner remove the abandoned sign.
However, staff had to re -notice the property owner again on July
10, 1990, as the property owner's address reflected a post office
box and was undeliverable by certified mail. On August 23, 1990,
staff reinspected the subject property and found that no work had
been completed by the property owner.
Since staff had not received any form of contact by the property
owner regarding the required removal, City staff performed as
authorized by City Code Section 9442 the required work. The work
order was carried out on August 31, 1990 and the following expenses
were incurred by the City:

CONCLUSION
Based upon the above information, staff believes that the City
Council should place a special assessment against the property
located at 17601 Seventeenth Street for one hundred nine dollars
and twenty cents ($109.20).

RESOLUTION NO. 90-131
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, ASSESSING THE PROPERTY
LOCATED AT 17601 SEVENTEENTH STREET
(ASSESSOR'S PARCEL NO. 395-301-05) FOR THE
COST INCURRED BY THE CITY FOR THE REMOVAL OF
AN ABANDONED SIGN.
WHEREAS, the City has made every effort to secure
the cooperation of the property owner in abating the
nuisance at 17601 Seventeenth Street.
WHEREAS, upon the failure of the property owner to
cause the abatement, and City staff has abated the
nuisance at a cost.to the City of $109.20.
NOW, THEREFORE, BE IT RESOLVED that the Finance
Director for the City of Tustin is directed to place a
special assessment on Assessor's Parcel No. 395-301-05 in
the amount of $109.20 to recover the cost incurred by the
City of Tustin due to the removal of an abandoned sign
for the property located at 17601 Seventeenth Street.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California held on the
15th day of October, 1990.
