SUBJECT: FINAL ACCEPTANCE OF TRAFFIC SIGNAL IMPROVEMENTS AT MAIN AND STONEGLASS,
MAIN AND EL CAMINO REAL AND WALNUT AND FRANKLIN
RECOMMENDATION:
It is recommended that City Council, at their meeting of October 15, 1990,
adopt the attached resolution accepting said work authorizing the recordation
of the Notice of Completion.
Assuming no claims or stop payment notices are filed, it is further recommended
that 35 days after the date of recordation of the Notice of Completion, that
the Council authorize staff to order the escrow agent, California Republic
Bank in Bakersfield, to release payment of the final 10% retention payment of
$15,741.03. This amount together with previous payments of $141,669.30
represents 100% of the final contract amount.
BACKGROUND:
On February 20, 1990, the City Council awarded the contract to Intersection
Maintenance Service (IMS) in the amount of $145,000.00. This project
encompassed the construction of traffic signal improvements as follows:
1. New traffic signal and safety lighting installation at Main Street
and Stoneglass.
2. Modification to the existing traffic signal at Main Street and
El Camino Real to provide protected left -turn movements in all
directions.
3. Modification to the existing traffic signal at Walnut Avenue and
Franklin Avenue to provide protected left -turn movements from
Walnut Avenue to Franklin Avenue.
The contractor (IMS) previously requested an escrow account be set up with
California Republic Bank in Bakersfield, as a substitute for the retention
earnings required to be withheld by the City pursuant to the construction
contract entered into between the City and the Contractor. These retention
monies amount to 10% of the total monies earned by the Contractor for the
duration of the contract. On July 2, 1990, the City Council approved the
"Escrow Agreement for Escrow Deposits in Lieu of Retention" and authorized
the Mayor to execute said agreement.
All work has been completed to the satisfaction of the Engineering Division.
The final contract amount is $157,410.33, which includes two change orders in
the amount of $12,410.33, in addition to the original contract of $145,000.00.

RESOULTION NO. 90-135
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING
RECORDATION OF NOTICE OF COMPLETION FOR CONSTRUCTION OF
TRAFFIC SIGNAL IMPROVEMENTS AT MAIN STREET AND STONEGLASS,
MAIN STREET AND EL CAMINO REAL, AND WALNUT AVENUE AND
FRANKLIN AVENUE.
WHEREAS, Intersection Maintenance Service, having a contract with
the City of Tustin to construct the hereinafter described public works and
improvements; and
WHEREAS, the City Council finds that said contractor has completed
said public improvement hereinafter more particularly described in
accordance with the provisions of the contract documents and the notice of
completion, and acceptance of said public work and improvement should be
filed and payment of the balance due said contract authorized in
accordance with the contract documents.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said public work and improvement be, and the same is hereby
accepted. Said public work and improvement is more particularly described
as follows:
1. New traffic signal and safety lighting installation of Main Street and
Stoneglass.
2. Modification to the existing traffic signal at Main Street and E1
Camino Real to provide protected left -turn movements in all
directions.
3. Modifications to the existing traffic signal at Walnut Avenue and
Franklin Avenue to provide protected left -turn movements from Walnut
Avenue to Franklin Avenue.
AND BE IT FURTHER RESOLVED that the City Engineer of the City of
Tustin be and is hereby authorized to execute and file a notice of
completion and acceptance of said public work and improvement described
herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Tustin on the 15th day of October, 1990.
