HUSTON, CITY MANAGER ;ENT CALENDAR N0. 11 11-19-90 Inter - Com PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: AUTHORIZATION TO ADVERTISE FOR BIDS - TUSTIN RANCH ROAD LANDSCAPING ADJACENT TO THE LAURELWOOD DEVELOPMENT RECOMMENDATION: That the Tustin City Council adopt the attached resolution approving plans and specifications for the installation of Landscape and Irrigation improvements along Tustin Ranch Road adjacent to the Laurelwood Residential Development. BACKGROUND: As a part of the street improvements along Tustin Ranch Road between Walnut Avenue and the Santa Ana (I-5) Freeway the Laurelwood Development perimeter wall was reconstructed to provide an improved screening of the roadway from the Laurelwood residential area. This wall was reconstructed on a small earthen berm and relocated easterly to provide additional height and realignment to follow the profile grade of Tustin Ranch Road in lieu of the residential development. This wall now joins the sound walls being constructed with Tustin Ranch Road/I-5 interchange project. These wall improvements and street improvements were constructed by the Irvine Company as a part of the conditions of approval of the Irvine Industrial complex which was developed in the mid 19701s. DISCUSSION: The relocation and construction of the screenwall requires certain landscape and irrigation improvements be installed and modified on the Laurelwood side of the wall. These improvements fall both within of excess public right-of-way and on private property. The landscaping and irrigation on the Laurelwood property requires replacement due to damage that was sustained during the grading of the berm and the construction of the wall. It is anticipated that maintenance of the excess public right- of-way area will be done by the Laurelwood Homeowner's Association through a reimbursement agreement between the City and the Homeowner's Association. Funding for this Landscape/Irrigation installation and replacement has been budgeted in the Capital Improvement Program Budget for 1990-91. The engineer's estimate for this project is $122,400.00. Depending upon the actual bid amount received, it may be necessary to make a supplemental budget appropriation. This can be determined at the time bids have been received and a contract award is made. WHEREAS, it is the intention of the City Council of the City of Tustin, California to contract Installation of Landscape and Irrigation Improvements along Tustin Ranch Road adjacent to the Laurelwoods Residential Development; and WHEREAS, the City Engineer has presented plans and specifications for the construction of said work; NOW, THEREFORE, BE IT RESOLVED that the plans and specifications presented by the City Engineer be and are hereby approved as the plans and specifications for: Installation of Landscape and Irrigation Improvements along the Tustin Ranch Road adjacent to the Laurelwood Residential Development BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law for the receipt of sealed bids or proposals for the doing of the work specified in the aforesaid plans and specifications; BE IT FURTHER RESOLVED that this project is categorically exempt from the requirements of the California Environmental Quality Act; Class I: Existing Facilities. PASSED AND ADOPTED at a regular meeting on the City Council of the City of Tustin, held on the 19th day of November, 1990. ATTEST: City Clerk Mayor SECTION A CITY OF TUSTIN, CALIFORNIA NOTICE TO CONTRACTORS SEALED PROPOSALS will be received at the office of the City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California 92680 until 10:00 A.M. on the 11th day of December, 1990 at which time they will be publicly opened and read, for performing work as follows: LANDSCAPE IMPROVEMENTS, LAURELWOOD PATIO HOME AND TOWNHOUSE AREAS The work to be done consists of furnishing all materials, equipment, tools, labor and incidentals as required by the plans, specifications and contract documents for the above stated project. This proposed contract provides for the construction of Landscape and Irrigation Improvements at Laurelwood Patio Home and Townhouse areas. Plans, specifications and proposal forms to be used for bidding on this project can only be obtained by prospective bidders at the office of the City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California 92680, upon payment of $15.00 per set, or will be mailed out upon payment of $20.00 per set, which amounts are not refundable. In conformance with Section 37931 of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and accompanied by bidder's security in the form of cash, cashier's check, certified check or bid bond executed by an accredited surety. The security shall be for an amount not less than 10% of the amount of the bid. A bid shall not be considered unless one of the forms of bidder's security is enclosed therewith. A Faithful Performance Bond in the amount of 100% and a Labor and Materials Bond in the amount of 100% in the form attached to the contract documents shall be provided. Said bonds shall be issued by a surety company rated grade A or better and Class IV or better by the latest edition of Best's Key Rating Guide. The City of Tustin hereby affirmatively ensures that minority business enterprises will be afforded full opportunity to submit bids in response to this notice and will not be discriminated against on the basis of race, color, national origin, ancestry, sex, or religion in any consideration leading to the award of contract. A-1 The City of Tustin reserves the right to reject any or all bids, and/or to waive any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. Prior to bid opening, bidder may withdraw his bid. Bids received after the bid opening time and -date herein will be returned to bidder unopened. Pursuant to the California Public Contract Code, the contractor will be entitled to post approved securities with the City or an approved financial institution in order to have the City release funds retained by the City to insure performance of the contract. Prior to contract award, the successful bidder shall possess a valid State of California contractor's license in the classification of A, or C27. For all projects not subject to Section 10164 of the Public Contracts Code of the State of California (federally funded state projects), bidders must comply with Section 7028.15 of the Business and Professions Code of the State of California which provides that all bidders subject to that section must state on their bid the number of their contrator's license, the date of expiration of their contractor's license, and a statement that the representations made in their bid are made under penalty of perjury. The City Council of the City of Tustin has obtained from the Director of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for legal holiday and overtime work in the locality in which the work is to be performed for each craft or type of work needed and a copy of the same is on file in the office of the City Engineer. Not less than said prevailing rates shall be paid to workers employed on this public works contract as required by Labor Code Sections 1771 and 1774 of the State of California.
