REGULAR MEETING OF THE TUSTIN CITY COUNCIL
DECEMBER 31 1990
The City Council meets the first and third Monday of every month at 7:00
p.m. in the City Council Chamber at 300 Centennial Way.
This agenda contains a brief general description of each item to be
considered. Any person having a question concerning an item may call the
City Clerk's office for clarification. Except as otherwise provided by law,
no action shall be taken on any item not appearing in the following agenda.
Copies of staff reports pertaining to this agenda are available for public
use in the City Council agenda books located in the Police Department and
the Tustin Library. These same books are also provided for public use in
the Council Chamber during the Council meeting. Listening devices for the
hearing impaired are available upon request from the City Clerk. Smoking is
prohibited in the Council Chamber; however, if you desire to smoke, an
outside speaker has been provided.

1. 1991-92 PROPOSED USE OF COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS
(17TH YEAR APPLICATION)
The County of Orange has solicited funding applications for
participation in the Urban County's Community Block Grant
Program for fiscal year 1991-92.
Recommendation: Adopt the following Resolution No. 90-147
approving the 1991-92 application for the proposed use of
Community Development Block Grant (CDBG) funds as recommended by
the Community Development Department:
RESOLUTION NO. 90-147 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING THE CITY'S 1991-92
APPLICATION FOR HOUSING AND COMMUNITY DEVELOPMENT FUNDS AND
AUTHORIZING SUBMISSION OF SUCH APPLICATION TO THE COUNTY OF
ORANGE
2. RECONSIDERATION OF ZONE CHANGE 90-01 AND APPEAL OF CONDITION NO.
8.9 OF EXHIBIT A OF PLANNING COMMISSION RESOLUTION NO. 2816
TUTT/TUSTIN AUTO SPA CAR WASH
At a regular meeting on September 17, 1990, the City C-)uncil
denied without prejudice Zone Change 90-01 by adopting
Resolution No. 90-121. The request was to rezone a site located
at 1501 Nisson Road to allow construction of a car wash. The
property is currently zoned C-1 (Retail Commercial) District and
the proposed change in zoning is to C -G (Commercial General)

approval of a Conditional Use Permit.
Recommendation: Pleasure of the City. Council.
V. PUBLIC INPUT - At this time members of the public may address the City
Council regarding any items not on the agenda within the subject
matter jurisdiction of the City Council provided that NO action may be
taken on off -agenda items unless authorized by law.
VI. CONSENT CALENDAR - All matters listed under Consent Calendar are
considered routine and will be enacted by one motion. There will be
no separate discussion of these items prior to the time of the voting
on the motion unless members of the Council, staff or public request
specific items be discussed and/or removed from the Consent Calendar
for separate action.
1. APPROVAL OF MINUTES - NOVEMBER 19, 1990 REGULAR MEETING
Recommendation: Approve the City Council Minutes of November
19, 1990.
2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $1,578,277.15
and ratify Payroll in the amount of $258,730.87.
3. RESOLUTION NO. 90-142 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 13786
Recommendation: Approve Final Tract Map no. 13786 by the
adoption of Resolution No. 90-142, as submitted or revised, as
recommended by the Community Development Department.
4. RESOLUTION NO. 90-148 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 13735
Recommendation: Approve Final Tract Map No. 13735 by the
adoption of Resolution No. 90-148, as submitted or revised, as
recommended by the Community Development Department.
5. PUBLIC WORKS MANAGEMENT STUDY - ARROYO ASSOCIATES
Recommendation: Authorize the City Manager to execute an
agreement with Arroyo Associates for consultant services as
recommended by the City Manager.
6. RESOLUTION NO. 90-153 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR
THE CONSTRUCTION OF EMBOSSED CONCRETE PAVING IMPROVEMENTS AT
VARIOUS LOCATIONS
Recommendation: Adopt Resolution No. 90-153 approving the plans
and specifications for the subject project and directing the
City Clerk to advertise for bids as recommended by the Public
Works Department/Engineering Division.

VIII. ORDINANCES FOR ADOPTION
1. ORDINANCE NO. 1052 - ZONE CHANGE 90-03
On November 5, 1990, the City Council introduced Ordinance No.
1052, a proposed rezoning which would adopt a Planned Community
(PC) district and the Newport/Warren Planned Community regulations

for 7.826 a,..es located in the vicinitj of Newport and Warren
Avenues. A revised Negative Declaration needs to be certified
prior to final adoption of this Ordinance.
Recommendation by the Community Development Department:
a. Approve the revised Environmental Determination for the
project by adopting the following Resolution No. 90-146:
RESOLUTION NO. 90-146 - A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TUSTIN, CALIFORNIA, RECOMMENDING CERTIFICATION
TO THE CITY COUNCIL OF THE FINAL NEGATIVE DECLARATION AS
ADEQUATE FOR ZONE CHANGE 90-03, INCLUDING REQUIRED FINDINGS
PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
b. That the following Ordinance No. 1052 have second reading by
title only and adoption (roll call vote):
ORDINANCE NO. 1052 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 90-03 TO
ZONE PROPERTY LOCATED ON 7.826 ACRES IN THE VICINITY OF
NEWPORT AND WARREN AVENUES TO PC (PLANNED COMMUNITY). THE
APPLICANT FOR THIS ZONE CHANGE IS THE CITY OF TUSTIN
2. ORDINANCE NO. 1054 - FLOOD PLAIN MANAGEMENT
The following Ordinance No. 1054 had first reading and
introduction at the November 19, 1990 City Council meeting:
ORDINANCE NO. 1054 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AMENDING SUBSECTION 9802.1(A) OF CHAPTER 8,
ARTICLE 9 OF THE TUSTIN MUNICIPAL CODE RELATED TO FLOOD PLAIN
MAPPING IN THE CITY'S FLOOD PLAIN MANAGEMENT REGULATIONS
Recommendation: Ordinance No. 1054 have second reading by title
only and be passed and adopted as recommended by the Community
Development Department (roll call vote).
IX. OLD BUSINESS
1. UTILITY POLE REMOVAL AT SOUTHEASTERLY CORNER OF MAIN STREET AND
NEWPORT AVENUE
At a previous City Council meeting, staff was directed to request
from Southern California Edison Company a cost for removal of one
utility pole and the undergrounding of one span of overhead
utility wires at the southeasterly corner of Main Street and
Newport Avenue.
Recommendation:

1. REQUEST FOR STOP SIGN INSTALLATION ON YORBA STREET AT BONNER DRIVE
At a previous City Council meeting Helen Edgar requested that the
City consider installation of stop signs on Yorba Street at Bonner
Drive.
Recommendation: Receive and file subject report as recommended by

2. ASSESSMENT DISTRICT NO. 86-2 - JAMBOREE ROAD IMPROVEMENTS
At a previous meeting, the City Council requested staff review a
segment of Jamboree Road between Station 310 + 40 and 327 + 50 for
the installation of masonry concrete block wall. Prior to
Council's request, Ms. Carol Wheeler, representing the Cowan
Heights area, requested the City construct a wall on top of the
recently constructed earth berm.
Recommendation: Pleasure of the City Council.
XI. REPORTS
1. PLANNING COMMISSION ACTION AGENDA - NOVEMBER 26, 1990
All actions of the Planning Commission become final unless
appealed by the City Council or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of
November 26, 1990.
2. MAILBOXES WITHIN PUBLIC RIGHTS-OF-WAY
The U.S. Postal Service has placed both walk-up and drive-by type
mailboxes within the public street rights-of-way for the
depositing of mail. Over the past several months, private
business mailboxes such as Federal Express and Airbourne Express,
have been placed in the public rights-of-way which initiated
concern from the Postmaster of the Tustin Post Office.
Recommendation: Provide staff direction as to the Council's
desires to have the private mailboxes either remain within or be
removed from the public rights-of-way.
3. REQUEST TO RESTORE ON -STREET PARKING AT 13682 NEWPORT AVENUE
As directed by the City Council at their November 19,, 1990
meeting, staff conferred with the City Attorney's Office regarding
the restoration of on -street parking in front of and adjacent to
the San Remo Italian Market at 13682 Newport Avenue.
Recommendation: That no on -street parking be restored to the
easterly side of the street adjacent to 13682 Newport Avenue as
recommended by the Public Works Department/Engineering Division.
