Haworth Attorney, Ken Bryant IV APPROVAL OF Moved by Miller, seconded by Klingelhofer that MINUTES minutes of September 7th meeting be approved as mailed. Carried. V. PUBLIC 1. Zone Change 65-145 John ~. Huntley HEARINGS To permit a change of zone from R-1 to PD (Planned Deve~lopment) On approximately 9.7 acres of property located on Yorba Street, approximately 700' northeriy of 17th Street. Hearing opened at 7:32 P.M. Mr. Haworth presented Planning Staff Report and recommendation of the Planning Commission for approval. Mr. Frank Morris, architect, speaking for tke applicant, exolained the oroposed 80 unit development. There being no protests and no further comments the hearing was declared closed at 7:44 P.M. Moved by Rin , seconded by Klingelhofer that Zone Change 65-145 of John B. Huntley be so- proved for PD 4500 zoning. Carried by roll call - Ayes: Mack, Kingelhofer, Coco, Miller, Ring. Noes: None. Absent: None. 0rdinance No. 292 Moved by Klingelhofer, seconded by Ring that 0rdinance No. 292 - An Ordinance of the City of Tustin,California, changing Zone on Applcation No. ZC 65-145 of Huntley, be read by title only. Carried unanimously. 2. Hearing to Consider Certain Amendments to the Zoning Ordinance - Ordinance No. 157 as Amended. Mr. Haworth requested a continuation of this hearing for further study. Moved by Ring, seconded by Klingelhofer that hearing to consider Amendments to the Zoning Ordinance be continued to the next regular meeting of October 4th Carried. 45O VI OLD BUSINESS 1. Tuition reimbursment Council Policy Moved by Miller, seconded by Coco that Tuition Reimbursement Policy for employees be adopted as presented. Carried by roll call. Ayes: Miller, Coco, Mack.. Noes Ring, K!ingethofer. a s o ~ oyees is beyond the ability of the City and that the City should faz~ individual situations, as they come up. Employees should further themselves and then the City could weigh the benefits and consider any reimbursement. Council d!rected that provisions should be considered regarding department heads and relmbursement should be apportioned by desirability and suitability. 2. Policy of the City Council Regarding Industrial Development Moved by Klingethofer, seconded by Ring that policy of the Clty Council of the City of TustIn on Industrial Development be adopted/ Carried. VII. NEW 1. Ordinance No. 291 BUSINESS "An Ordinance of the City of Tustin, Califfornia Amending Uniform Building Code." Moved by Ring, seconded by K!ingelhofer that Ordinance No. 291 have first reading by title only. Carried unanimously. 2. Extension of Agreement with Valley Consultants, Inc. for Engineering Services. Moved by Miller, seconded by Klln~elhofer that agreement with Valley Consultants be extended for a period of one year, commencing October l, 1965. Carrled. (Mr. Ring excused from meetlng at 8:05 P.M.) 3. Appointment of Parks & Recreation Commissioner. Moved by Coco, seconded by Miller that Mr. Ed. Bering be reappointed to the Tustin Parks and Recreation Commission for a term of two years, effective November 2, 1965. Carried. 4. Dance Permit Requests (I) The Holiday, 505 W. First Street (2) Tustin Inn,440 E. Finst Street Moved by Klinge!hofer, seconded by Coco that requests from The Holiday and the Tustin Inn ..... for Dance Permits, be approved and permits granted. Carried. 5. Designation of Insurance Carrier for City Liability, Fire, and Auto Coverage Moved by Miller, seconded by Klinglhofer that the City Administrator is authorized and directed to place the City's insurance pursuant to the bld of LeGrand & LeGrand & Ball, provide that personal injury definition ls modlfied in accord- ance with specifications for bid. Carried. 4'51 6. Travel Request - Building Department Moved hy Miller, seconded by Coco that Mr. Fred Brook beI authorized to attend the International Convention of Building Officials. Carried. 7. Resolution No. 794 Moved by Miller, seconded by Coco that Resolution "NO. 794 be read by title only. Carried unaminously. Moved by Klingelhofer, seconded by Coco that Resolution No. 794 "A Resolution Declaring That Proceedings Have Been Initiated By the City Council of the City of Tustin to Annex to Said City Certain Uninhabited Territory Described Herein, and Designated as Red Rill Center Annexation to the City of Tustin and Giving Notice of the Proposed Annexation", be passed and adopted. Carried by roll call. Ayes: Mack, Klingelhofer, Coco, Miller, Ring. Noes: None. Absent: None. 8. Approval of Demands Moved by Klingelhofer, seconded by Miller that demands in the amount of $18,654.73 be approved and paid. Carried. VIII. CORRES- 1. Resignation - Vincent L. Humeaton PONDENCE Moved by Kllngelhofer, seconded by Miller that resignation of Mr. Humeaton as representative on the 0range County Mosquito Abatement Commission and as alternate councilman in Tustin's Continuity of Government be accepted with regret and a letter of appreciation for faith- ful years of continued servlce be sent to Mr. Humeaton. Carried. Moved and seconded that Mayor be authorized to appoint a commissioner to Mosquito Abatement Commission. Appointment to be ratified by the Council. Motion declared out of order. Mayor appointed Councilman Miller to sit on the Commission temporarily until an appointment can be made. (Mr. Ring returned at 8:32P.M.) 2. Tustin Chamber of Commerce Request for permission to use vacant lot on Northeast corner of Third & "D" Streets for Tustin Tiller Day Carnival. Moved by Coco, seconded by Miller that request of Chamber be approved subJecto to the following conditions: 1. Carnival Company obtain a business license and conform to all City regulations. 452' 2. Carnival be Inspected and Approved by Fire, Police and Building Departments. 3. Written consent Of property owner for use of land be filed with the City Clerk. Motion carried. Moved by Coco, seconded by Kllngelhofer that correspondence be received and filed. Carried. IX. OTHER Mayor asked Mr. Miller to lnvestigate Harbor BUSINESS District Expenditures. ADJOURN- Meeting adjourned to a personnel session. MENT Moved by Ring, seconded by Coco that meeting be adjourned. Carried.
