HUSTON, CITY MANAGER REPORTS NO. --3,, 12-3-90".- Inter - Com PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: MAILBOXES WITHIN PUBLIC RIGHTS-OF-WAY RECOMMENDATION: That the Tustin City Council provide staff direction as to their desires to have the private mailboxes either remain within or be removed from the public rights-of-way. BACKGROUND: As a convenience to the public, the U.S. Postal Service has placed both walk-up and drive-by type mailboxes within the public street rights-of-way for the depositing of mail. This service is provided by the Federal Government through a non- profit private operation. Over the past several months additional walk-up/drive-by type mail boxes have been placed in the public rights-of-way by private businesses, such as Federal Express and Airbourne Express. The placement of these private business mailboxes within the public rights-of-way initiated a concern and complaint from the Postmaster of the Tustin Post Office. DISCUSSION: Staff has reviewed the City Code with respect to the placement of private business mailboxes within public right-of-way and have been unable to find any area of the code that permits the placement. The Sign Code does not allow any private advertisement within the public right-of-way. Each of the previously mentioned mailboxes have company names and logos on the units. The Tustin Postmaster has requested that these units be removed from the public right-of-way. Staff is requesting direction from the City Council as to whether they desire to have these private mailboxes removed from the public right-of-way. In the event - they are to be removed, it is suggested that the City Attorney's office provide staff with a notification/removal process for the removals due to the sensitivity of the items being removed. In the event it is desired to have the private mailbox facilities remain within the public right-of-way, an amendment to the code should be made to allow the use and to establish a permit system for each placement so that the City can control the locations of said facilities with respect to pedestrian and traffic safety. *bl,, e gnde c k e r Director of Public Works/City Engineer BL:ccg
