SUBJECT: AUTHORIZE THE CITY MANAGER TO SIGN CONSULTANT AGREEMENT FOR
PREPARATION OF ELEMENT REGARDING AB 939
RECOMMENDATION:
Authorize the City Manager to select a consultant and develop a
scope of service that will allow the City of Tustin to complete and
adopt its Source Reduction and Recycling Element (SRRE) by February
29, 1991 as required by AB 939, and approve a supplemental
appropriation from the unappropriated reserves of the General Fund
not to exceed $70,000 to provide said consulting services.
DISCUSSION:
Faced with rapidly filling landfill sites statewide, and
environmental concerns regarding existing and proposed sites, the
State adopted the Integrated Waste management Act, AB 939,
effective September, 1989. The Act sets very stringent
requirements on cities and counties to re -direct its waste stream
away from landfills and has established targets of a 25 percent
diversion by the year 1995 and a 50 percent diversion by the year
2000. While the County has taken the lead on behalf of the Cities
on several elements of the legislation, each agency is required to
prepare its individual Source Reduction and Recycling Element.
This Element must be adopted by each City and submitted to the
County by February 29, 1991 for certification and submittal to the
State as part of a county -wide plan by July 1, 1991.
The City has formed a Committee made up of staff from Public Works,
Community Development and Finance to draft the City's SRRE. The
Committee has identified several areas in the Element that they do
not feel that staff has the expertise to complete and the
complexity of the Element has taken considerably more time to
prepare than anticipated. In order to meet the February submittal
date and to deal with the technicalities of the Element, the
Committee is requesting authorization to retain the services of a
consultant to aid the City in the preparation of their SRRE.
Because of the uniqueness of this legislation, we've found few
consultants that are qualified to prepare the Elements for cities,
and are seeing a high range of proposed fees to provide the
services. It is the intention of the Committee to continue to
progress with the drafting of the Element and, only utilize the

consultant in those areas of unique technical nature or in the
event of a time crunch that may cause the City to miss the
February, 1991 submittal date.
GREAT WESTERN RECLAMATION PROPOSED RECYCLING PROGRAM
An integral component of the Source Reduction and Recycling Element
is the establishment of a city-wide recycling program. Staff has
been reviewing a proposed program submitted by our present hauler,
Great Western Reclamation, and investigating proposed and existing
programs throughout the County. We are reviewing all options with
Great Western with the stated goal of providing the most efficient
program, ie. one that will allow the City to meet the diversion
targets established by AB939, at the best possible price.
As a result of our discussions with Great Western, we have targeted
July 1, 1991 as the start date of the City's Recycle Program. This
will provide sufficient time to complete our review of all options,
give Great Western adequate lead time to staff and capitalize the
program and it will allow us time to submit the new rates to the
County for placement on the tax roll.
