SUBJECT: REQUEST FOR TEMPORARY USE OF EMERGENCY ACCESS EASEMENT FOR
CONSTRUCTION RELATED TRAFFIC ONTO LA COLINA DRIVE (TRACT 13908
BRAMALEA)
RECOMMENDATION:
That the City Council at their meeting of December 17, 1990
approve the request by Bramalea California, Inc. for temporary
use of the Tract 13908 Emergency Access Easement for
construction related traffic onto La Colina Drive, subject to
the conditions listed below.
BACKGROUND:
At their meeting of August 6, 1990, the City Council considered
and denied requests to permit the temporary use of Emergency
Access Easements for construction related traffic from Tracts
13990, 13701 and 13786. Those requests were denied based upon
a number of reasons, including, traffic safety concerns,
construction traffic impacts to the neighboring county
residential area to the west of Tustin Ranch, as well as
negative impacts to perimeter landscape activity adjacent to the
effected roadways.
DISCUSSION:
Since the City Council meeting of August 6, 1990, staff has
received a request (letter of October 17, 1990, attached) from
Bramalea California, Inc., for consideration by the City for
their temporary use of an Emergency Access Easement for
construction related traffic onto La Colina Drive from their
Tract 13908. In conjunction with this referenced letter, the
Akins Development Company sought City reconsideration of their
previously denied request for temporary use of the Emergency
Access Easement for construction related traffic onto La Colina
Drive from their Tract 13701. Akins Development has since
rescinded this request for Tract 13701 after having secured
alternate construction access from Adams Drive via Irvine
Company property.
The Bramalea request for Tract 13908 is based upon an effort by
the Developer to minimize the mixing of construction traffic
with their model homes and future residents. The developer
feels that the Tract 13908 street configuration, coupled with
the location of their models and location of their singular
entrance off of Township Drive presents a situation which they
claim can not be reasonably mitigated without temporary use of
the Emergency Access Easement onto La Colina Drive.
Staff has met with and identified issues of concern to Bramalea,
and they have been responsive in seeking to address those
concerns, (see Bramalea letter of November 26, 1990, attached).
Staff would be agreeable to permitting Bramalea California, Inc.
to temporarily utilize the Tract 13908, Lot "J" Emergency Access
Easement for construction related traffic only under the
following conditions:
1. Fulfillment of the six items addressed in the Bramalea
letter of November 26, 1990, except as follows:
a. Item No. 3.
Escrow of funds will not be permitted. The
Developer will be required to post a cash
deposit to guarantee replacement of all
impacted improvements. Credit will be granted
to the Developer for any deleted work items
from the present AD86-2 Landscape Contract.
b. Item No. 5.
The Developer shall be responsible for the
removal and/or trimming of any other planting
material that inhibits the line of sight along
La Colina Drive. It shall be the Developer's
responsibility to replace at his expense, any
plantings which are impacted by fulfillment
of this condition.
2. The Developer shall be required to design, construct
and restore all impacted improvements in accordance
with the guidelines set forth by the City Engineer.
3. The City reserves the right to close the temporary
access onto La Colina Drive at any time due to non -
policing actions by the Developer of his contractors,
and/or non -conformity with any of these conditions or
regulations of the City.
4. Temporary use of the Lot "J", Tract 13908 Emergency
Access Easement is granted for the purpose of
construction related traffic access only.
5. Permission for the stated use is granted through
June 30, 1993, unless extended in writing by the
City Engineer.
6. The responsibility for enforcement of all conditions
shall be borne by the Developer, Bramalea California, Inc.
7. Bramalea California, Inc. shall indemnify the City of
Tustin in the amounts and format to be approved by the
City Attorney.
In staff's opinion, the above conditions should be sufficient
to address City related concerns and issues.

Emergency Access Easements for Construction Traffic at La Colina Road
Dear Bob:
Thank you once again for your reconsideration of the subject emergency access easements being used for
temporary construction traffic. As we have discussed, and as outlined by Mary Harwood, these access
points have been "secured" by locating temporary driving lanes within the La Colina median area. We have
enclosed the engineered plan and photographs for your reference. The plan incorporates the following
safety elements to mitigate the potential traffic conflicts as presented at The City Council Hearing meeting
on August 6th:
a. The temporary traffic lanes located within the La Colina median directs traffic from entering the
County/existing neighborhood area.
b. The strategic location of traffic directional, command and awareness signs regulates the traffic flow
in an efficient and safe manner.
In addition to the temporary safety measures, each of our existing and future contractors will be given a
"compliance addendum to their contracts" outlining the vehicular safety/traffic procedures for the use of
these construction access points. We would also make sure the streets will remain clean; and there will be
a periodic assessment made to you in writing as to the safe use and function of these access points.
We are requesting the use of these access points through the summer of 1992 for Akins tract (13701) and
through the spring of 1993 for Bramalea's tract (13908). Following our use of this temporary condition, the
occupied median and landscape lot areas will receive landscape improvements per the approved
assessment district (86-2) plans.
We would appreciate your assistance once again to agendize this proposal as a Council new business item
to be heard at the earliest available meeting. We are confident that this proposal addresses the City's traffic
concerns, as well as establishing a safe and efficient traffic routing pattern within our tracts.
Please give me a call to confirm your direction and schedule for a Council date.

Tracts 13908 (Bramalea) & 13701 (Akins Development)
Dear Bob:
This letter is to address the items of concern that were brought up at the reference meeting:
1. We feel that the most efficient and economic way to handle any potential conflict
with pedestrian traffic along the sidewalks adjacent to both of our projects would be
through signage. We would be willing to put up whatever warning signs you might
feel appropriate to warn pedestrians of construction ingress and egress traffic. As I
mentioned, both tracts would gate their entries which would only be open during the
hours of construction operations.
2. We feel we both could take sufficient policing actions through our contractual
arrangements with our subcontractors to enforce the turning movements and
circulation from the construction access gates. We are willing to draft language for
your approval that we could insert into our contracts that would include penalties for
non-compliance.
3. We are willing to post a cash deposit for the removal and replacement of the
necessary median cuts and other and all of the improvements that are necessary to
restore the medians to the original plan. I did mention to you that I feel the
landscaping for those removal sections should be escrowed and we would use those
funds to install the restoration of the landscaping once the medians are restored.
Any additional cost due to inflation would be born by both developers.
4. We are willing to install a standard pavement section with the median that would
meet with city specifications.

5. We have taken a look at the landscape plans on La Colina and with respect to the
Bramalea entry. We would need to have 4 eucalyptus trees between the access entry
and Tustin Ranch Road installed at a later date to provide a 280 foot sight distance
upon exiting our tract. This meets with county standards and I feel this would be
sufficient. We would reinstall the eucalyptus trees upon the restoration of the
median.
6. We would insure that the gates are opened for construction access prior to normal
hours of operation to insure that we would not have stacking on La Colina. These
hours of gate operation could also be stipulated in our contractural arrangements
with the subcontractors and enforced in a similar manor with a penalty.
Bob, as I mentioned to you, Bramalea is planning to open their project the first part of
January, so it is imperitive that we resolve these issues and have them confirmed by the City
Council the early part of December, so that we may process our DRE documents for sales.
We are looking forward to an expedient response and are willing to work with you in any
way possible to resolve these issues.
