SUMMARY:
Staff is requesting the City Council set the date and time to conduct interviews to fill
vacancies on the Planning Commission and Cultural Resources Advisory Committee.
RECOMMENDATION:
Pleasure of the City Council.
BACKGROUND:
Due to recent resignations, one vacancy on the Planning Commission and one vacancy
on the Cultural Resources Advisory Committee have become available.
A public notice was published in the Tustin News, advertised on the City's website, and
posted on the Tustin City Hall posting board that the City Council was seeking
'candidates interested in serving on the Planning Commission and Cultural Resources
Advisory Committee. The information included the number of vacancies, required
qualifications, compensation, and duties.
The following individuals have expressed interest, and their applications are attached
for City Council review:
Planning Commission (one vacancy, term expires on July 16, 2001)
John Beringer, Betty Halderman, Andrew Hamilton, Ginny Hovland, Bernard
Miller, Aaron Morris, and Jon Spencer.
Cultural Resources Advisory Committee (one vacancy, term expires on July 16, 2001)
Johnny Clay, Nancy Fontaine, and Gary Smith.

The final step in the selection process would be completion of ballots by the City

John M. Beringer, Jr. LPCS
Professional History
Mr. Beringer is Chief Executive Officer and Principal Claims Professional for Beringer &
Associates, Inc.. He is also its sole employee for providing Claims and Litigation Management
services as well as Mediation and Consulting services. Prior to his engagement with Beringer &
Associates, Inc. he was employed by Specialty Risk Services to provide the services of case
management of a significant pending including class action lawsuits, developer construction defect
cases, trade dress and various employment torts; supervision of litigation for others; negotiation
and analysis of coverage for Hartford Insurance Company and their clients in both the self insured
and insurance contract venues including coverage's derived fi.om primary and excess policies;
Errors and Omissions, General Liability, Tax Practitioners and professional services contracts.
Mr. Beringer's area of expertise includes resolving disputes involving product liability,
toxic chemical torts, construction defect, employee/employer litigation, sexual harassment,
wrongful termination, business litigation, coverage-bad faith disputes and trade dress infringement
in state, federal and international venues.
While the specific list of clients assigned to his office is confidential, his clientele included
Fortune 500 companies, various municipalities in California, Nevada, Oregon, Washington and
.Arizona, and numerous individually owned companies with national reputation.
Prior to his engagement by Specialty Risk Services, Mr. Beringer was Principal of
Beringer & Associates: Risk Management, Insurance Coverage. Analysis and Mediation. Prior to
creating Beringer & Associates, Mr. Beringer was involved in the insurance industry as a Senior
Litigation Specialist and Litigation Manager. His involvement with insurance carriers spanned 28
years, during which time he was employed by the Automobile Club of Southern California,
Industrial Indemnity Insurance Company, The Hartford's Specialty Risk Services and Great
American Insurance Company. One of Mr. Beringer's assignments in the insurance industry was
with Western International Insurance Company as National Litigation Manager and Corporate
Secretary.
Well over 15,000 litigated cases were resolved by Mr. Beringer during his employment in
the insurance industry. At the conclusion of his last assignment with Western International
Insurance Company, Mr. Beringer received an appointment with the National Chinese
Government fi.om the Minister of Inland Marine Insurance as a Consultant for International
Insurance.
Mr. Beringer is also a graduate of The Mediation Center and qualified as a mediator under
Alternative Dispute Resolution Program Act of 1993 and Business & Profession Code 465. He
has been a mediation provider for the Victim-Offender P, econciliation Program (VORP),
sponsored by the Orange County District Attorney's office for resolution of misdemeanors and
infractions as an alternative formal prosecution; host mediator for the Day of Dialog in Los
Angeles sponsored by the Los Angeles City Attorney's Office and Councilman Mark Ridley
Thomas. Mr. Beringer has held an appointment as Special Arbitrator since December of 1959
with Arbitration Forums Inc.
Mr. Beringer has mediated disputes for the last six years on the behalf of numerous
organiZations and has delivered presentations on communication and non-confrontational dispute
resolution to contract professionals at Hughes Aircraft, Rockwell International, Boeing and to the
general community. He is the author of 'Tou Can Win Without Losing. "an article discussing
litigation alternatives and was requested to testify to the Senate Committee on Mediation
regarding certification, licensure and role of mediators in Risk Management.
He is also the founder and moderator of Cyrano's at 7:30, a discussion group on ethics
and current events; an exmember of the Tustin Rotary Club; a Water Commissioner for the City
of Tustin and committee member for the Committee for the Redevelopment of South Tustin. He
has been featured in Jan Norman's column It's Your Business in the Orange County Register and
has been a consultant for KCRW's "Which Way L.A." radio show on insurance issues.
Mr. Beringer graduated with honors from Business Owners Service Program at Rancho
Santiago College, and was retained as an instructor in their program on Risk Management and
Insurance. Most recently Mr. Beringer was a participant in a panel discussion on The Claims
Business for the 21st Century for the CPCU convention in Costa Mesa on Litigation Management
and the application of technology to the claims process.

Reason for applying: To help keep Tustin attractive, safe, and growing in an organized
manner which will optimize the tax income for Tustin.
