HUSTON, CITf ltRNAGER COII~NITY DEVELOPflENT DEPARTMENT ANNEXATION 147 - HOLT AVENUE NORTH OF WARREN RECOI)ENDATION It is recommended that the City Counctl adopt Resolution No. 89-80 ordering the territory known as "Annexation No. 147 - Holt Avenue north of Warren" annexed to the Ctty of Tustin. BACKGROUND On February 6, 1989, the City Council initiated Annexation 147 by the adoption of Resolution No. 89-6. Shortly thereafter the Community Development Department transmitted the annexation proposal to the Local Agency Formation Commission (LAFCO). This annexation was initiated at the request of 1005 of the property owners in the annexation area. ~. On April 19, 1989, LAFCO approved the a6nexation subject to the terms and conditions of LAFCO Resolution No. 89-17 which is attached to this report for- reference. ~ .,.. Since the annexation has been filed with 1005 property owner consent, a public hearing is not required to ratify the annexation. However, all property owners have been notified of the City's intent to consider this matter as part of the regular Council agenda. CONCLUSION With the consent of 100% of the property owners and the LAFCO approval of the annexation on April 19, 1989, staff recommends that the City Council adopt Ctty Counct1 RePort Annexation No. 147 June 19, 1989 Page two Resolution No. 89-80. If adopted, this 'resolution wtll be transmitted to LAFCO for submittal to the Secretary of State. Acceptance of the resolution by the Secretary of State wtll then formalize the annexation. Shtngleton gleton Ol'rector of Community Development Community Development Department EXHIBIT A 10 11 12 13 ?,15 18 19 2O 21 22 23 24 ' 25 RESOLUTION OF THE LOCAL AGENCY FO~4ATION COMMISSION OF ORANGE COUNTY, CALIFORNIA April 19, 1989 On motion of Commissioner Vasquez, duly seconded and carried, the following resolution was adopted- .WHEREAS, a resolution for the proposed annexation designated Annexation No. 147 to the City of Tustin in the County of Orange was heretofore filed by the City of Tustin and accepted for filing February 15, 1989 by the Executive Officer of this Local Agency Formation Commission pursuant to Part 3 of Title 5, Division 3, commencing with Section 56000 et seq of the Government Code; WHEREAS, the Executive Officer, pursuant to Government Code Section 56828 set March 15, 1989 as the hearing date of this proposal and gave the required notice of hearing; and WHEREAS, the hearing was continued to April 19, 1989; and WHEREAS, the Executive Officer, pursuant to Government Code Section 56833, has reviewed this proposal and prepared a report 'inclu.ding his recommendation thereon, and has furnished a copy of this report to .each person-entitled to a copy; and WHEREAS, said proposal was accompanied by proof satisfactory to this Commission that all of the owners of land ~fthin the territory proposed to be annexed have given their signed consent to such an~xation and determination; and WHEREAS, this Commission called this proposal for public hearing on April · 19, 1989, heard from the interested parties, considered the proposal and the report of the Executive Officer, and considered the factors determined by the Commission to be relevant to this proposal, including, but not limited to, factors specified in Government Code Section 56841; and WHEREAS, the proposed annexation has been determined to be categorically exempt from the requirements of the California Environmental Quality Act of 1970. NOW, THEREFORE, the Local Agency Formation Commission of the County of Orange DOES HEREBY RESOLVE, DETERMINE and ORDER as follows: Section 1. Subject to the terms and conditions hereinafter specified, said proposal is approved. Section 2. Said territory is found to be inhabited and is assigned the following short-form designation: ANNEXATION NO. 147 TO THE CITY OF TUSTIN. Section 3. The City of Tustin is designated a.s the conducting authoritY and the legislative body thereof is hereby directed to initiate annexation proceedings in compliance with this resolution. Said conducting authority is authorized to annex said territory without notice and hearing and without an election, pursuant to Section 56837 of the Government Code. Any election called upon the question of confirming an order for annexation shall be called, held and conducted upon such annexation only within the territory ordered to be annexed. The City of Tustin, as applicant, shall be liable for and pay all proper expenses incurred in conducting proceedings in compliance with this resolution. The Executive Officer is hereby authorized and directed to mail certified co,pies of this resolution in the manner as provided in Sect~qo 56853 .of the Government Code. COMMISSIONERS GADDI H. Does not exceed 75 acres in area, is inhabited and all property owners therein have consented to its annexation to the City of Tustin. b. The City Council of the City of _Tustin is authorized to annex said territory without notice and hearing and without an election pursuant to Government Code Section 56837. 3. The City of Tustin, as applicant, shall be liable for and pay all proper expenses .incurred in conducting proceedings in compliance with the resolution. NOW, THEREFORE, BE IT RESOLVED that the Ctty Council of the City of Tustln hereby orders the territory described tn Exhlbtt A annexed to the Ctty of Tustln, and directs the City Clerk of the Ctty of Tustln to transmit a certified copy of thts resolution wtth applicable fees requlred by Sectton 54902.5 of the Government Code to the Executive Offtcer of the Local Agency Formation Commlsslon of Orange County.
