V. PUBLIC 1. Zone Change 65-143 Associates Funding HEARINGS Hearing opened at 7:32 P.M. to consider the Zone Change Application of Associates Funding to permit s change of zone from R-3 to C-1 on property located at Newport Avenue and Sycamore (Freeway Off-Ramp), Tustin. Mr. George Argyros, representing aOplicant, requested that the Council refer this application back to the Planning Commission due to changes that have taken place since application was filed. Moved by Ring, seconded by Klingelhofer tha~ Zone Change 6~-143, Associates Funding, Inc. be referred back ~o the Tustin Planning Commission for further consideration with a recommendation tO be made following the completion of the City-County Joint Study of this area. Carried. OLD 1. Presentation of Resolution of Commendation BUSINESS to Gene Uematsu Mayor i~troduced Mr. Uematsu and Resolution of Commendation was read and presented. 2. Ordinance No. 279 "AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED RICHARD B. SMITH ANNEXATION TO THE CITY OF TUSTIN, CALIFORNIA." Moved by Klingelhofer, seconded by Miller that Ordinance No. 279 be read by title only Carried unanimously. 390 Moved by Miller, seconded by Klingelhofer that Ordinance No. 279 approving the Richard B. Smith Annexation be passed and adopted. Carried by roll call. Ayes: Mack, Klingethofer, Miller, Ring. Noes: None. Absent: Coco. 3. Resolution No. 775 A Resolution expressing support of proposed consititutional amendments to allow levy of taxes upon telephone companies. Mr. Don ~alkner, representing the Telephone Comosny spoke in oooosition to the proposed constitutional amendment and explained the company feelings that they now pay their fair share of' Taxes and stated that Tustin now receives $2,29.3.00 property tax oluss percentage of County tax. Mr. Gill explained that it is estimated that Tustin would receive approximately $6.00 oer capita if Telephone Franchise Tax went through~ Moved by Ring, seconded by Klingelhofer that no action be taken on Resolution 775. Carried Mr. Miller voting no. Award of Contract Improvement of HOlt Avenue and NeWpor~ Avenue Moved by Klingelhofer, seconded by Ring that contract for improvemenu of Holt and Newport Avenues be awarded ~o industrial Contracting Co., being low bi~der~at a total cost of $9,924.00 and clerk be directed to return bidder bonds to unsuccessful bidders. Carried. VII. NEW 1. Franchise - Southern Counties Gas Company BUSINESS of California. a) Moved by Klingelhofer, seconded by Ring that application of Southern Counties Gas Company of California for Gas Franchise be received and filed. Carried B) Resolution 774 "A RESOLUTION OF THE CITY COUNCIL DECLARING ITS INTENTION TO GRANT THE GAS FRANCHISE APPLIED FOR BY SOUTHERN COUNTIES GAS COMPANY." Moved by Klingelhofer, seconded by Ring that Resolution No. 7?4 be read by title only. Csrried~unanimously. Moved by Kli~gelhofer, seconded by Ring that Resolution No. 774 a resolution declaring the City's intent togrant the Gas Franchise applied for by the Southern Counties Gas Co. of California be passed and adopted. Carried by roll call: Ayes: Mack, Klingelhofer, Miller, Ring. Noes: N~ne. Absent: Coco. 2. Prospect Ave. Improvements a) Agreement Moved by Miller, seconded by Klingelhofer that the Mayor and Clerk be authorized to execute agreement with the County of Orange covering construction of Fourth St. and Prospect. Carried. b) Resolution No. 776 A RESOLUTION OF THE CITY OF TUSTIN APPROVING THE PLANS AND SPECIFICATIONS FOR THE IMPROVEMENT OF PROSPECT AVE. BETWEEN FIRST ST. AND FOURTH ST. AND AUTHORIZING AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS." ~oved by Klin elhofer, Resolution ?~ be read seconded by Ring that by title onlM. Carried. unanimously. Moved by Ring, seconded by Miller that Resolution 776 approving plans and specifications for Prospect Ave. between First and Fourth Streets be passed and adopted. Carried by roll call. Resolution No. 777 "A RESOLUTION REQUESTING THAT PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY OF TUSTIN BE EXCEPTED FROM TAX LEVY BY THE COUNTY OF ORANGE FOR STRUCTURAL FIRE PROTECTION OF COUNTY AREAS." Moved by Ring, seconded by Klingelhofer that Resolution No. 777 be read by title only. Carried unanimously. Moved by Ring, seconded by Klingelhofer that Resolution 777 be passed and adopted. Carried by roll call. Ayes: Mack, Klingelhofer, Miller, Ring. Noes: None. Absent: Coco. 4. Sewer Reimbursement Agreement Moved by Miller, seconded by Klingelhofer the Mayor and Clerk be authorized to execute the Sewer Reimbursement Agreement between the City of Tustin and Charles Greenwood and Arthur Peterson Carried. 5. Ordinance No. 280 "AN ORDINANCE OF THE CITY OF TUSTIN, AMENDING THE TUSTIN CITY CODE RELATING TO THE SALE OF UNCLAIMED PROPERTY." Moved by Miller, seconded by Klingelhofer that Ordinance No. 280 have first reading bv title only. Carried unanimously. Moved by Miller, seconded by Klingelhofer that Ordinance No. 280 have secondereading by title only. Carried unanimously. Noe~:1 None. Absent: Coco. 6. Dance Permit - Hells Dee I~ Moved by Ring, seconded by Klingelhoferthat request from Mella Dee Inn for a dance permit be approved and permit issued. Carried. 7. Approval of Demands Moved by Miller, seconded by Klingelhofer 8 t~st demands intheamount of $27,6 0.59 be approved and paid. Carried. VIII. CORRESPONDENCE Charles Walker - Traffic Control Report from Mr. Wheelock and Mr. Gill directed to acknowledge correspondence from Mr. Walker. County Librar~ Mr. Gill directed to Contact Orange County Librarian, to determine how Tustin Library compares with the other branch libraries in similar population. Ariahelm Resolution Opposing ABe46 and 4~1 Mr. Gill asked to find out reasons why Anaheim is opposing ABe46 and 431. Resignation of Mr. A. Enderle Moved by Klingelhofer., seconded by Ring that Mr. Enderie be sent a letter from the Council thanking him for his time, efforts and valuable,assistance during his tenure as a Planning Commission member. Carried. Moved by Miller, seconded by Ring that correspondence be received and filed. "~ Carried. IX. OTHER Land Use and Zoning Analysis BUSINESS Moved by Ring, seconded by Klingelhofer that Land Use and Zoning Analysis be referred and transmitted to the Planning Commission. Carried. 2. Railroad Crossing Report Presented. Moved by Ring, seconded by Klingelhofer that City Administrator be authorized to negotiate an agreement with the Southern Pacific for installation of traffic signal pre-emption device at First St. crossing at a cost not to exceed $400.00. Carried. 3- Council Policy-Extended Travel A!ction on CounciI Policy relative to travel by City personnel on extended official business deferred to next regular meeting. __ 4. SB716.State Planning Act. Moved by Miller, seconded by Ring that the Mayor and City transmit a letter in support of Bill 716 to responsible parties in the Stat~ LegiSlature. Carried, 5. Speed Limit Study Request Councilman Klingelhofer reported that residents in area of Loma Vista School request that Prospect Avenue (County)be reduced to 25 or 30 M.P.H. Councilman Ring requested a check of speed limits on Newport Ave., south of McFadden. Moved by Klingelhofer, seconded by Ring that Mr. Gill take necessary steps to have speed limits lowered.
