RECOMMENDATION'·
It is recommended that the City Council adopt the following:
1. Resolution ordering the preparation of an Engineer's Report;
2. Resolution approving the Engineer's Report; and
3. Resolution of intention to levy annual assessments, annex
additional territory, .and to set the protest hearing for
July 5, 1989.
BACKGROUND:
The Engineer's Report prepared by.BSI Consultants, Inc., has been filed
with the City Clerk. A total Of 17 parcels are proposed for annexation
to the District, most of which are in Tustin Ranch, north of Irvine
Boulevard. The recommended 1989-90 fiscal year assessments are shown
below:

WHEREAS, it is the intention of the City Council of the City
of Tustin to levy annual assessments for the 1989-90 fiscal year
for the Tustin Landscape and Lighting District; and
WHEREAS, substantial changes in existing improvements have
occurred by reason of new parcels to be annexed, new landscaped
areas and new street lighting facilities to be maintained by said
District; and
WHEREAS, BSI Consultants, Inc. is under contract to provide
professional engineering services in connection with said
District under the direction of the Director of Public Works/City
Engineer.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Tustin that the Director of Public Works/City Engineer is

WHEREAS, by Resolution No. 89-90, the City Council initiated
proceedings for the 1989-90 fiscal year for the levy of annual
assessments and for the annexation of additional territory to
said existing district and ordered the Engineer to prepare a
report in accordance with Section 22565 of the State of
California Streets and Highways Code; and
WHEREAS, pursuant to said Resolution, the Engineer has filed
the report with the City Clerk; and
WHEREAS, the City Clerk has submitted the report to the City
Council and the City Council now has reviewed and examined the

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
ORANGE COUNTY, CALIFORNIA, DECLARING ITS INTENTION TO
ORDER-THE ANNEXATION OF ADDITIONAL TERRITORY TO AN
EXISTING DISTRICT AND TO PROVIDE FORAN ANNUAL LEVY
OF ASSESSMENT FOR THE IMPROVEMENT, MAINTENANCE AND
SERVICING OF PUBLIC LANDSCAPING AND LIGHTING FACILITIES
WITHIN THE BOUNDARIES OF THE TERRITORY INCLUDED IN THE
TUSTIN LANDSCAPE AND LIGHTING DISTRICT AND TO LEVY AND
COLLECT ASSESSMENTS PURSUANT TO THE LANDSCAPING AND
LIGHTING ACT OF 1972 AND GIVING NOTICE THEREOF
WHEREAS, the City Council by Resolution 89-90 initiated
proceedings for the annual levy of assessments and annexation of
additional territory to an existing district for the Tustin
Landscape and Lighting District pursuant to the provisions of the
Landscaping and Lighting Act of 1972 (Part 2, Division 15 of the
California Streets and Highways Code); and
WHEREAS, by said Resolution No. 89-90, the City Council
ordered the City Engineer to prepare a report pursuant to Section
22565 of said Code; and
WHEREAS, the City Engineer did prepare and file such a
report and the same was approved by the City Council on the 19th
day of June, 1989, Resolution No. 89-91;
NOW, THEREFORE, the Ci CounCil of the city of Tustin does
hereby resolve as follows:
SECTION 1. That the public interest and convenience
require and it is the intention of the City Council of the City
of Tustin to order the annexation of additional territory to an
existing district and to order the annual levy of assessments and
to levy and collect said assessments pursuant to the provision of
said Landscaping and Lighting Act of.1972 (Part 2 of Division 15
of said Streets and Highways Code).
SECTION 2. That the improvements to be undertaken consist
of the installation, maintenance, servicing and operations of
those certain public landscaping and lighting facilities located
within the Tustin Landscape and Lighting District. The
asseSsment district designated as Tustin Landscape and Lighting.
District generally encompasses that portion of the City known as
East Tustin, being north of I-5 Freeway and east of Browning
Avenue except the areas of all public streets, avenues, lanes,
~.alleys, rights-of-way, parks, and all publicly owned property
being, used for public purposes, provided, however notwithstanding
.property owned by railroad and public utility companies not used
for public purposes shall be included in the district and not. be
lexcluded pursuant to the aforesaid exceptions. Additional
parcels to be annexed are listed in the Engineer's Report.
SECTION 3. That reference is hereby made to the Engineer's
Report on file with the city Clerk and open to inspection, for a
fully detailed description of the improvement, the boundaries of
the Assessment District and any zones therein, and the proposed
assessments upon assessable lots and parcels of land within the
District.
SECTION 4. That said proposed maintenance, servicing and
operation of landscaping and lighting, in the_opinion of the City
Council of the City of Tustin will be to the benefit'of the
property lying within the described boundaries of the Assessment
District, as said Assessment District is described and defined in
said Engineer's Report.
SECTION 5. Notice is hereby given that Wednesday, July 5,
1989 at the hour of 7:00 p.m. in the City Council Chambers, 300
Centennial Way, Tustin, California, 92680, are hereby fixed as
the time and place where all interested persons may appear before
the City Council and be heard concerning the annexation of
additional territory to the existing district and the annual levy
of assessments of the District, the extent of the District, the
services to be performed, and the proposed assessment and all
other matters relating thereto.
Protests must in writing and must be filed with the City
Cierk prior to the conclusion of the hearing. Any such protest
shall' state all grounds of the objection ahd, if filed by the
property owner, shall contain a description sufficient to
identify the property.
SECTION 6. The CitF' Clerk shall cause notice of the
hearing to be given by causing the Resolution of Intention to be
posted and published in the manner required by Part 2 of Division
15 of the Streets and Highways code.

ENGINEER'S REPORT
FOR
TUSTIN LANDSCAPE AND LIGH`T'ING DISTRICT
FOR THE
1989-90 FISCAL YEAR
I. PURPOSE
The purpose of this report is to set forth findings and the
engineering analysis for the Tustin Landscape and Lighting
District for the 1989-90 fiscal year. This district,
utilizing direct benefit assessments, will finance the cost
of providing maintenance and operation of street and highway
landscaping and street lighting in selected areas within the
Tustin City limits.
II. FINDINGS
The City Council of Tustin adopted Resolution No. 85-75 on
July 15, 1985 which formed the Tustin Landscape and Lighting
District and confirmed assessments for the first fiscal year,
1985-86. This report covers the levy of annual assessments
for the 1989-90 fiscal year. It is proposed to annex
seventeen (17) parcels to the District. A list of parcels
proposed for annexation is included in the appendix as Exhibit
ttAn .
The street lighting system in the district consists of 709
lights. A summary by type and size follows:

Additional street lights will be installed in the future as
properties are developed in the district.
The 1989-90 street and highway landscaping includes parkway
landscaping in the Tustin Ranch area, specifically: the south
side of Bryan Avenue between Browning Avenue and Tustin Ranch
Road; the north side of Bryan Avenue between Browning Avenue
and Jamboree Road; the east side of Browning Avenue between
River Ford Road and E1 Camino Real; the west side of Tustin
Ranch Road from the Santa Ana Freeway to Irvine Boulevard; the
east side of Tustin Ranch Road between Bryan Avenue and
Heritage Way; the south side of Irvine Boulevard east of
Tustin Ranch Road; and the east side of Jamboree Road north
of Bryan Avenue. The total landscaped area is 10.8 acres.
Part 2 of Division 15 of the Streets and Highways Code, the
Landscaping and Lighting Act of 1972, permits the establish-
ment of Assessment Districts by cities for the purpose of
providing certain public improvements which include main-
tenance and operation of street lights and landscaping.
The 1972 Act requires that maintenance assessments be levied
according to benefit rather than according to assessed value.

Section 22573 provides that:
"The net amount to be assessed upon lands
within an assessment district may be
apportioned by any formula or method which
fairly distributes the net amount among all
assessable lots or parcels in proportion to the
estimated benefit to be received by each such
lot or parcel from the improvements."
The Act also permits the designation of zones of benefit
within any individual assessment district if "by reasons of
variations in the nature, location, and extent of the improve-
ments, the various areas will receive different degrees of
benefit from the improvement" (Sec. 22547). Thus, the 1972
Act requires the levy of a true "assessment" rather than a
"special tax."
III. FINANCIAL ANALYSIS
The 1972 Act provides that the total cost can be recovered in
the assessment spread including incidental expenses. The
latter can include engineering fees, legal fees, printing,
mailing, postage, publishing, and all other costs identified
with the district proceedings.
The estimated expenditures for street lighting in the proposed
district for the fiscal year are as follows:

The estimated revenues for the district are as follows:

The assessment spread will be based upon $94,200.
The estimated expenditures for landscaping maintenance in the
proposed district for the fiscal year are as follows:

IV. ENGINEERING ANALYSIS
A. Name
The district is entitled "Tustin Landscape and Lighting
District."
B. Boundary
The boundaries of the assessment district are as shown
on the Assessment Diagram. All parcels within said
boundaries and identified in the latest Orange County
Assessor's Parcel Maps are included in the district
excepting from the assessment for said costs and expenses
within the area described, the area of all public
streets, public avenues, public lanes, public roads,

public drives, public courts, public alleys, all
easements and rights of way, all public parks, greenbelts
and parkways, and all public property being used for
public purposes.
C. Facilities
The facilities or improvements are defined as street
lights, street and highway landscaping, their
appurtenances, energy and maintenance costs to operate
them.
D. Benefit Analysis
All parcels in the district will derive benefit from
street lighting and some from landscaping. The intent
of this report is to establish a methodology that fairly
distributes the cost of the district in relation to the
benefits received.
Lands and rights of way owned by railroads and public
utilities are included in this proposed assessment
district as permitted by Section 22595 of the Streets and
Highways Code.
There are 946 parcels of property in the district
(including annexed and exempt parcels), all zoned for
residential or commercial use. The District will be
broken down for assessment purposes, as follows:

Zone RI:
Residential - without lights, assessed
only for lighting incidental expenses.
There are 37 parcels in this zone.
Zone CI:
Commercial, industrial, churches, and
undeveloped parcels - without lights,
assessed only for lighting incidental
expenses. There are 23 parcels in this
zone with 681.19 acres.
Zone R1:
Single family detached residential - with
lights, assessed for lighting incidental
expenses and lighting costs. There are
575 parcels within this zone.
Zone R2:
Condominiums, townhouses, and apartments -
with lights, assessed for lighting
incidental expenses and lighting costs.
There are 257 parcels within this zone
with 2131 dwelling units.
Zone Cl:
Commercial, industrial, churches etc. -

with lights, assessed for lighting
incidental expenses and lighting costs.
There are 48 parcels in this zone with
226.57 acres.
Zone L: Any of the above mentioned areas with City
maintained landscaping, assessed for
incidentals and landscaping maintenance

costs. There are 785 parcels in this zone
with 525 R1 dwelling units, 1850 R2
dwelling units, and 64.90 commercial
acres.
Zone E: Exempt property. There are 8 parcels in
this zone. This includes publicly owned
property.
E. Assessments - Lighting Incidental Expenses
All parcels in the district will be assessed for the
lighting incidental expenses associated with the district
(except exempted properties). The method for spreading
the incidental cost is on an assessment unit (AU) basis
regardless of land use type. The assessment ratio will
be one (1) assessment unit (AU) for each single family
detached residential unit, 0.75 assessment units for
condominiums and apartments and six (6) assessment units
for each acre of commercial, industrial, etc. The

Therefore, all parcels in Zones RI, R1, R2, and C1 will
receive an assessment of: $2.46 per parcel in Zone RI
and R1, $1.84 per unit in Zone R2, and $14.76 per acre
in Zone CI and C1.
F. Assessments - Lighting Costs
Parcels in Zones R1, R2 and C1 will be assessed for
lighting incidental expenses at a rate of $2.46 per
assessment unit (AU) plus an assessment for the cost of
operating and maintaining the lights in the district, as
calculated below.
The assessment ratio will be one (1) assessment unit (AU)
for each single family detached residential unit, 0.75
assessment units for condominiums and apartments and six
(6) assessment units for each acre of commercial,
industrial, etc. The calculation is as follows:

Assessments for parcels with local benefit of street
lights in Zones R1, R2 and C1 will be: $21.34 per parcel
in Zone R1, $16.00 per unit in Zone R2, and $128.04 per
acre in Zone C1. However, the complete lighting assess-
ment for these zones will include these amounts plus the
lighting incidental costs previously mentioned.
G. Assessments - Landscape Maintenance Costs
Parcels in Zone L will. be assessed for incidental
expenses plus an assessment for the cost of maintaining
landscaping in the district.
The assessment ratio will be one (1) assessment unit (AU)
for each single family detached residential parcel (or
unit) and 0.75 assessment units for apartments and
condominiums and six (6) assessment units for each acre
of commercial, industrial, etc.
The calculation is as follows:
Landscaping Costs Plus Incidental Expenses = $73,100
Zone L: 525 parcels (or units) x 1 = 525.00 A.U.
1850 Units x 0.75 = 1,387.50 A.U.

Assessments in Zone L would be $31.76 per single family
detached residential parcel, $23.82 for each apartment

V. SUMMARY
µ The individual assessments for each parcel in the Tustin
Landscape and Lighting District for the 1989-90 fiscal
year are contained in a list of assessments entitled
Exhibit "B" which is attached in the appendix and shall
be on file in the office of the City Clerk of the City
of Tustin.
