HUSTON, CITY lqANAGER COI~qUNITY DEVELOPMENT DEPARTMENT SIGN CODE EXCEPTION RECOINItENDATION It is recommended that the City Council approve a Sign Code exception authorizing Trimedyne to display a flag bearing its corporate logo at 1311 Valencia Avenue by adopting Resolution No. 89-100 subject to the conditions contained therein, as submitted or revised. BACKGROUND Trimedyne, a leading R&D company in the field of bio-mechanical medicine, recently became the sole tenant in the 70,000 square foot industrial building located at 1311 Valencia Avenue, and have requested approval of a Sign Code exception to display a 5 foot by 8 foot flag bearing the Trimedyne logo in addition to the American and State flags. Such a display is not listed as an allowable sign in the industrial district. Pursuant to Section 9470 of the Sign Code, the City Council may authorize a Sign Code exception provided that any of the following circumstances exist: 1. Subject property is developed with setback more than two times the minimum front setback requirement of the district. e e Subject property frontage is at least 75% of the minimum frontage requirements for the signing. Proposed signing does not exceed more than one in number nor more than 15% of the area of the aggregate size of signs authorized by the criteria of the district. 4. The proposed signing would be in substantial conformance with the purposes and intent of this Chapter and would not constitute a health or safety violation as described in Part 4 of the Sign Code. City Council Report July 17, 1989 Sign Code Exception Page two DISCUSSION The proposed Trimedyne flag would Consist of a white background with black letters spelling "Trimedyne" and a red logo, and having a total area of 40 square feet. The flag would be displayed along side of the American and State flags at the front of the facility (see attached site plan). Existing signage for the facility consists of one 60 square foot wall sign mounted on the front elevation of the building. The following is a comparison of Trimedyne's proposal with the four criteria listed above' 1. Required setback - 0 feet: Actual setback - + 100 feet. 2. Minimum frontage (Valencia) - 100 feet' Actual frontage- 361 feet. e Aggregate sign area permitted - 64 square feet- Aggregate sign area requested- 100 square feet (+36%). 4. Intent of Sign. Code is for business identity' the corporate name and logo would be displayed. Pursuant to Section 9470, only one o~ the four criteria must be met; Trimedyne's proposal meets three of the four (exceeds 15% of the allowed aggregate sign area). CONCLUSION Staff believes the requested display is in keeping with the intent of the Sign Code as demonstrated in the above comparison and would be a positive addition to the Trimedyne facility. The City Council of the City of Tustin does hereby resolve as follows: The City Council does hereby fi nd and determine as follows: lo That a proper application for a sign code exception has been filed on behalf of Trimedyne for the purposes of displaying a 40 square foot corporate logo flag at 1311 Valencia. That pursuant to Section 9470, of the Sign Code all criteria required prior to Council granting a sign code exception is present with the subject request. ¸3. That the display requested is consistent with the intent of the sign code ordinance in that the purpose of the sign code is for business identity and said display will be for business identification. II. The City Council hereby approves the sign code exception for Trimedyne to display a 40 square foot corporate logo flag at 1311 Valencia subject to the following conditions: 1. That the flag be displayed on a flag pole not to exceed 30' in height. 2. That the flag authorized shall only display the corporate name/logo of Trimedyne. 3. That the display shall be kept in a good state of repair and shall replaced should it become torn, frayed or otherwise vi sably damaged. 4.
