Miller asked that motion in Minutes of December Zlst read that report concerning connection of District 7 lines ~e referred to City Attorney and City Engineer. Moved by Klingelhofer, seconded by Ring that Minutes of December 21st Meeting be appro~ed as corrected and mailed. ~ar~ied. ZC64-140 Mayor Mack reported that Hearing on ZC64-140 of Tustin TUSTIN Elementary School District had been re-noticed for ELE. SCHOOL January 18th Meeting. DISTRICT City Clerk ~eported that eight bids had been received BIDS FOR fo~ Improvement of Prospect Avenue between First Street IMPROV. and Fourth Street. OF PROSPECT The following bids were then opened: Hardy & Hatper $15,568.40 D.C. Muralt Co. 17,550.00 G. & M. Engineer directed to present bid recap at next meeting. BRYAN- NEWPORT Hearing opened at 7:44 P.M. on "Bryan-Newport Annexation." ANNEX. Clerk reported there had been no correspondence or written protests. Mr. Victor J. Green, property owner, spoke against annexation feeling he has good fire and police protection and would like to know what Tustin is doing to improve itself. There were no written protests presented. Hearing closed at 8:05 P.M. Mr. Coco thanked Mr. Green for his comments and invited him to attend more Council and Planning Meetings and see3some of the inovations and working committees. ORD. NO. Moved by Ring, seconded by Klingelhofer that Ordinance No. 270 270 "An Ordinance Approving the Annexation of Certain READ BY Uninhabited Territory, Designated 'Bryan-Newport Annexation' TITLE to the City of Tustin, California" be read by title only. ONLY Carried unanimously. Mr~ WhSelock directed to contact Mr. Green regarding Annexation and City Services. "PARKER ANNEX." Hearing opened at 8:15 P.M. on "Parker Annexation.n Letter of protest from James H. and Eleanor F. Parker LETTER OF owner of property, read. PROTEST There being no further comments, the Hearing was declared closed at 8:17 P.M. Moved by Coco, seconded by Klingelhofer that finding PARKER ANNEX. a majority protest had been received, proceedings be DISCONT discontinued on "Parker Annexation." Carried.' Continued Hearing opened at 8:19 P.M. to consider AMENDING amending Section 5.11 of the ZOning Ordinance'of the SECT. 5.11 City. ZONING ORD. There being no comments or objections, the Hearing was declared Closed at 8:20 P.M. Moved by Coco, seconded by Ring that Ordinance No. 271, ORD. 271 ~mending Section ~ll of the Zoning Ordinance of the READ BY City of ustin, Ordinance No. 157, as amended, be read TITLE ONLY by title only. Carried unanimously. Moved by KlingelhOfer, seconded by Ring ~hat Ordinance 0RD. 268 No. 268, amending the Tustin City Code to prohibit PROJECTILES discharge of projectiles be read by title only. Motion carried, unanimously. Moved by Coco, seconded by Miller that'Ordinance No. 0RD. 268 268 be passed and adopted. Carried by roll call - PASSED AND Ayes: Mack, Klingelhofer, Coco, Miller, Ring. Noes: ADOPTED None. Absent: None. Clerk directed to send copy of above resolmtion to parents of boy ~njured in Tiller Day Parade. Repor~ regarding connection of District 7 linez to CONNECT. City Sewer lines deferred to ~ext meeting. Mr. Carlsen, DIST. 7 Mr. Wheelock and Mr. Rourke to prepare report ~o be TO CITY given to Councilman Miller for further checking and SEWER report to Council January 18t~ Meeting. Moved by Klingelhofer, seconded by Miller that Ordinance 0RD. 272I No. 272~ amending the Subdivision Ordiance, providing AMENDING for underground utilities be read in its entirety. SUBDIVISION Carried. ORD. Moved by Miller, seconded by Coco that Ordinance No. 0RD. 272 272 be revised to strike out exceptions by the REVISED Planning Commission. Motion carried. Moved by Miller, seconded by Ring that Fire Department FIRE DEPT. Rules and Regulations be adopted. RULES AND REGULATIONS Moved by Klingelhofer, seconded by Coco that Fire Department Rules and Regulations be tabled, until the next regular meeting. Carried. Chief Hilton directed to submit any changes or corrections in above to the Council prior to next meeting. . Upon request of Mr. Wheelock, Mayor Mack ordered the PACKING HOUSE report regarding packing house at Newport and San Juan NEWPORT AND deferred .to next regular meeting. SAN JUAN 8:39 P.M. - Mayor called l0 minute recess - meeting reconvened at 8:49. POLICY ACCEPT. Proposed policy regarding acceptance of gifts by GIFTS employees'presented by Mr. Rourk~.' RE-DRAFT Attorney asked to re-draft policy and to include POLICY employees and appointed officials. Arterial Highway Financing Program Projects explained by Mr. Wheelock and report presented. RESOL, 757 Moved by Klingelhofer, seconded by Ring that DEV. OF Resolution No. 757, requesting the County of Orange MCFADDEN to include within the Arterial Highway Financing Program the development of McFadden Street, be read by title only. Moved by Klingelhofer, seconded by Ring that the Mayor MUTUAL FIRE and City Clerk be authorized to enter into Agreement PROTECTION with the City of Orange foe Mutual Fire Protection. Carried. 7 Mr; Ring requested that in conjunction with study of STUDY OF encumberances on the BUdget, there be a two week study AUTO ALLOW. of'auto allowance flat fee payment'vs actual mileage payment. 'Mayor directed Mr.'Wheelock to work with Mr; Ring on th~'~matter and report. Mayor directed the City Attorney-to work out a Parkway PARKWAY ~ Tree Ordinance in conjunction with Parks and Recreation TREE 0RD. Commission. Upon questioning, Mr. Rourke advised that the Parks and Recreation Commission could hold noticed hearings on subjects under their JuriSdiction for recommendation to the Planning Commission and/~r City Council. MoVed by Ring, seconded by Klingelhofer that previous PREVIOUS Agreement~ for Mutual Fire PrOtection with the County AGREEMENT of~Orange dated august 19, 1957, be cancelled. Carried. MUTUAL FIRE ~ PROTECTION ~ Repor~ from Chief Sisselregarding sending and receiving CANCELLED ~' teletypes reviewed. Chief Sissel explainedlbenefits and ~ co~ts and stated that the County will do all maintenance TELETYPES ~ and upkeep. AGREE. WITH MoVed by Ring, SeCOnded by Coco that Mayor and City Clerk ORANGE bedauthorized to execute Agreement with Orange County COUNTY FOR Communications for teletype recemving machine. Carried. TELETYPE MACHINE PrOposed correspondence to Board of Supervisors regarding Coanty Zone Case 831 (Katnik) read and suggested corrections COUNTY that letter include that the City Council urges that the ZONE CASE Board of Supervisors consider the recommendations of 831 ~-' their Planning Commission in making their decision and recommends denial of ZC No. 831. MoVed by Miller, seconded by Ring that letter b~ sent to the Boar~'~of supervis'o~s with corrections. Carried. Clerk to forward a copy of above letter to each member of the BOard. Mr~ Haworth announced that the General Plan Committee GEN. PLAN will meet Tuesday evening, January 12th, regarding COMM. Phase 2 of General Plan Study. Correspondence from Wm. E. Dannemeyer, Worlds Fair CORR. WORLDS Committee, presented and Mayor asked that Mr. J. Taylor FAIR COMM. of Planning Department, attend upon approval of Mr. Haworth, and repor~ to the Council. Correspondence from Orangewood Academy referred to CORR. City Attorney. ORANGEWOOD ACADEMY Moved by Klingelhofer, seconded by Ring that correspondence be received and filed and letter fro~ Mr. Comroe be referred ~o the Chamber of Commerce. Carried. REPORT ~" Repor~ from Mr~ Wheelock regarding Larts Agreement LARTS presented and action deferred pen~ing more i~formation. AGREEMENT Mr. Wheelock asked to mnvestigate problems an~ OFF-RAMP procedures for action to obtain an off-ramp at Newport NEWPORT Avenue for traffic going North. AVE.
