NAULT, DIRECTOR OF FINANCE RESOLUTION NO. 89-110 PLACING ASSESSMENT FOR SOLID WASTE COLLECTION ON THE 1989-90 TAX ROLL. , J RECOMMENDATION: Adopt Resolution No. 89-110 directing the Finance Director to place the charges for Solid Waste Collection as detailed in the following discussion on the tax roll for fiscal 1990. DISCUSSION: The proposed Solid Waste Collection Rates to be placed on the tax roll for fiscal 1990 are $93.84 per year per single family residential unit up to three units per parcel, and $98.64 per year for residential units of four units or more utilizing can service, and commercial units utilizing can service. This is a 29 percent increase over the previous year. Based on the weighted average formula we use to compute, the new collection charge, the actual cost to the City for trash collection, has only increased 5.35 percent, $0.22 per month, $2.64 per year. The County Land Fill Fee has increased $1.09 per month, $13.08 per year. The County Land Fill Fee has risen by $7.63 per ton since July of 1988. This is an increase of 125 percent in twelve months. The per unit charge has gone from $1.54 July of 1988, $2.44 in January of 1989 and $3.53 in July of 1989. We have no control over the Landfill Fees and we are obligated to make whole our contractor for the fees he is charged. Ail cities pay these fees at the same rate. Attached for your review is a report to the City manager detailing the factors used to calculate the increase and a survey prepared by the County of Orange General Services Agency detailing the trash fees Countywide. Statistically Tustin, prior to the current proposed rates, was 17 percent below the Countywide average for single family collections, and 11 percent below the County average for bin service. This survey is dated May of 1989, so I'm sure that these numbers are changing as are ours · Page 2 August 2, 1989 Resolution 89-110 In accordance with the Health and Safety Code, we have published a Notice of this hearing and the availability of the computer report once each week for two consecutive weeks. We have also sent a public notice to each owner of a parcel that was not previously assessed for trash collection. These are primarily newly developed residential parcels in Tustin Ranch and annexations. OF THE HEALTH AND SAFETY CODE OF THE STATE OF CALIFORNIA, FINALLY APPROVING AND ADOPTING A REPORT RELATIVE TO PARCELS OF REAL PROPERTY RECEIVING SOLID WASTE COLLECTION SERVICES, DETERMINING THE CHARGES FOR SOLID WASTE COLLECTION TO BE ASSESSED AGAINST THE RESPECTIVE LOTS OR PARCELS OF LAND AS THEY APPEAR ON THE CURRENT ASSESSMENT ROLL. The City Council of the City of Tustin does hereby resolve as follows: 1. The City Council of the City of Tustin does hereby resolve as follows: A. That proceedings were duly instituted, conducted and completed pursuant to provisions of Section 5473 et seq. of the Health and Safety Code of the State of California. B. A written report dated July, 1989 containing a description of each parcel of real property receiving solid waste collection services and facilities and the amount of the charge proposed to be levied upon each parcel for the collection of solid waste for the fiscal year 1989-90 was prepared and filed with the City Clerk of the City of Tustin on July, 1989. C. That a public hearing to. hear and consider all objections or protests, if any, to the aforesaid report and proposed charges was duly set for August 7, 1989 at 7:00 o'clock p.m. in the Council Chambers of the City of Tustin at 300 Centennial Way, Tustin, California. D. Said hearing was duly noticed as required by law, by publication once each week for two successive weeks on July 24, 1989 and July 31, 1989 in the Tustin News, a newspaper of general circulation printed and published in the City of Tustin. E. At the aforesaid time and place the duly noticed hearing was held and all persons who were present were heard and all comments, objections and protests to the aforesaid report and proposed charges were duly heard and considered by the City Council. F. The charges proposed in the aforesaid report are fair and reasonable, are commensurate with the services provided, and the charge therefore should properly be collected on the tax roll in the same manner, by the same 1 $ 5 6 7 9 10 11 12 13 14 15 16 17 18 19 21 22 25 27 2~ persons and at the same time as, together with and not separately from, general taxes. 2. The City Council hereby elects to have the charges set forth in the aforesaid report collected on the tax roll in the same manner, by the same persons, at the same time as, and together with and not separately from its general taxes and hereby authorizes that such charges be collected on the tax roll, as all prescribed to the provisions of Health and Safety Code Section 5473 et seq. 3. The resolution shall be effective following its adoption by a two-thirds vote of the members of the City Council and shall remain in force and effect and said charges shall be collected in the manner as aforesaid for the year 1989-90 and for each subseqent year as authorized by the hereinabove referenced sections of the Health and Safety Code. 4. The City Clerk is authorized and directed to forthwith file a certified copy of this resolution with the Auditor of the County of Orange, together with a copy of the hereinabove-described report, and a statement endorsed thereon over her signature that the said report has been finally adopted by the City Council of the City of Tustin. HUSTON, .... ~ANAGEK RONAL~DIRECTOR~' OF FINANCE JULY 1,~989 ADJUSTED TRASH COLLECTION RATES Attached for your review are the revised Trash Collection Rate Schedule and the Schedule of Adjustment Factors. The data used to calculate the adjustments is published by the U.S. Department of Labor; Bureau of Labor Statistics. We have confirmed the increase for each category with the BLS. The composite increase in the collection rate is 5.35 percent or 22 cents per month for residential pickup. The County landfill rate increased 45 percent on July 1. This is the third increase including July 1, 1988, for a total of 129 percent in twelve months · The landfill fee is a direct pass through that does not require the approval of the City. The monthly rate for landfill fees for residential units has increased from $1.54 per unit in June of 1988 to $3.53 July 1, 1989. The new monthly rate for residential trash collection is $7.82 per unit, $93.84 annually. Commercial can service monthly rate will be $8.22, $98.64 annually. Great Western Reclamation has been authorized to begin charging their customers the new rates as of July 1, 1989. These rates are contemplated to be the rates placed on the tax roll for 1989-90. The only change would be if! the County were proposing an additional landfill increase for January, 1990.
