NAULT, DIRECTOR OF FINANCE SPECIAL ASSESSMENT AGAINST PROPERTY AT 170 EL CAMINO WAY RECONNENDATION: Adopt Resolution No. 89-111 designating the City Engineer and City Finance Director to act on behalf of the City Council, and adopt Resolution No. 89-112 assessing the property located at 170 E1 Camino for the cost incurred by the City for the abatement of dangerous buildings. DISCUSSION: The City 'Council took action on June 19, 1989 to approve the assessment of $4,358.53 against the referenced property to recover the City's cost of abating this dangerous building. These resolutions are housekeeping items to comply with requirements of the County of Orange for placing assessments on the tax roll. Director of Finance RAN:ls Attachments 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 89-111 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING THE CITY ENGINEER AND THE CITY FINANCE DIRECTOR TO ACT ON BEHALF OF THE CITY COUNCIL FOR THE CORRECTION AND/OR CANCET3.~TION OF SPECIAL ASSESSMENTS WHEREAS, the City Council of the City of Tustin by Resolution has authorized the addition of certain special assessments, and directed the Auditor-Controller of the County of Orange (herinafter referred to as the Auditor), to add same to the tax roll; and WHEREAS, it is periodically necessary to request the Auditor to make certain corrections and/or cancellations of same; .and WHEREAS, the Auditor has determined that, henceforth no correction or cancellation of special assessments may be made to the tax roll without the authorization of this City Council or the designee, or designees of this City Council. WYNN CITY CLERK 1 5 6 7 8 9 10 11 13 14 15 17 18 19 21 23 2~ 25 26 :~7 28 RESOLUTION NO. 89-112 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ASSESSING THE PROPERTY LOCATED AT 170 EL CAMINO REAL FOR THE COST INCURRED BY THE CITY FOR THE ABATEMENT OF DANGEROUS BUILDINGS. WHEREAS, the City Council of the City of Tustin by Resolution has directed the abatement of a public nuisance located at 170 E1 Camino Real; and, WHEREAS, the City has made every effort to secure the cooperation of the property owner in abating the nuisance on said property; and, WHEREAS, upon the failure of the property owner to cause the abatement, and City'staff has abated the nuisance at a cost to the City of $4,358.53. NOW, THEREFORE, BE IT RESOLVED that the Finance Director for the City of Tustin is directed to place a special assessment on Assessor's Parcel No. 401-571-05 in the amount of $4,358.53 to recover the cost incurred by the City of Tustin in the abatement of dangerous buildings for the property located at 170 E1 Camino Real. Please assess these charges to the property, the assessor's parcel nu,~ber is 401-571-05. The current owner is listed as ~!rs. June Perfit at 365 S. Hudson Avenue, Los Angel es, California 90020. L[)' pef Attachment OFFICIAL NOTICE OF PUBMC HEARING TU,.q'rlN CITY COUNCIL OFFICIAL NOTICE OF PUBLIC HEARING CITY OF TUSTIN Notice is hereby given that the City Council' of the City of Tustin, California, will conduc't a public hearing on June lg, 1989 at 7:00 p.m. in the Council Chambers, 300 Centennial Way, Tustin, California to consider the-following' 170 E1 Camlno Real Pursuant to Resolution No. 89-25 and other commmuntcations, the property owner of 170 E1 Camino Real in the City of Tustin, Assessor's Parcel # 401-571-05 failed to con~ly with' the City of Tusttn's Notice and Order to abate a public nuisance. The City, thereupon, performed work.to the exterior of the subject property at an approximate cost of $4,358.53. The purpose of the hearing will be to review an itemized account of those expenses incurred by the City and to determine whether the total costs of all repair work should be a special assessment against the subject property, or a personal obligation of the property owner, whichever the City Council shall determine appropriate. · Any person interested in or affected by the proposed change may file written protests or objections with the Clerk of the City of Tustin at any time prior to the time set for the hearing on said report. Each such protest or objection must.contain a description of the property in which the signer thereof is interested and the grounds of such protest or objection.
