HomeMy WebLinkAboutOB 2 CITIZEN COMPLAINT 08-21-89 OLD BUSINESS ATE: ~U S 9 I TO: FROM: SUBJECT: WILLIAM HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION CITIZEN COMPLAINT - 13651 ROSALIND DRIVE RECOMMENDATION: That the Tustin City Council at their meeting of August 21, 1989 authorize the removal of all "No Parking Anytime" signs on the westerly side of the alley between Linda Lane and a point 417 feet south of Linda Lane, and authorize the retention of the no parking signs on the easterly side of the alley and within the turn-around area. BACKGROUND: At the July 17, 1989 city council meeting, Ralph and Susan Westrum of 13651 Rosalind Drive expressed their complaints on the following two parking restrictions: 1. No parking during street sweeping operations from 6:00 a.m. to noon on Wednesdays on Linda Lane, Rosalind Drive and Laurie Lane between Yorba Street and Loretta Dr. 2. No parking anytime in the alley located southerly of Linda Lane and between Yorba Street and Rosalind Drive. Council directed staff to return with a report on these complaints for the city council meeting of August 21, 1989. In August 1985, the city council approved a policy regarding the request for the posting of parking restriction signs during street sweeping hours. This policy provided for the following: a. Ail restrictions should be placed on a block by block basis only for most residential developments, except where a development is located on a large parcel of land with one ownership such as an apartment complex or a homeowners association. b. The resident(s) initiating said request should be required to submit a petition signed by a minimum of 2/3 of the total number of residents on any given block that are in favor of the requested on- street parking restrictions. c. Only one signature per dwelling unit should be utilized for attaining the 2/3 count. d. Staff would review the request and/or petition and implement the action if the 2/3 signature requirement was met. Otherwise, if the signature requirement was not met, staff would deny the request. CITIZEN COMPLAINT - 13651 ROSALIND DRIVE AUGUST 9, 1989 PAGE 2 e. Appeals by the requesting party could be made to the City Council. f. Request for sign removals would require a petition signed by a minimum of 2/3 the total number of residents. In June 1988, a petition was received from thirteen (13) residents along Linda Lane, Rosalind Drive, and Laurie Lane requesting the installation of restricted parking signs. There are a total of eighteen residents either fronting, or having a sideyard on, these streets. The petition represented 72% of the residents in favor of the parking restrictions which was in excess of the 2/3 requirement outlined in the council- approved policy. Signs were installed along the three streets in June 1988. The established council policy does not indicate that the petition requires certification or verification of each of the signatures. Staff researched the background on the initial installation of the "No Parking Anytime" signs within the alley southerly of Linda Lane.. We were unable to find either the exact date of installation or the' reason/cause as to why they were installed. At the July 17, 1989 city council meeting under the public input section, Helen Edgar indicated that the signs were probably installed about 25-26 years ago. With regard to the bagging of the signs in the alley, there are no records that indicate who bagged the signs and at what date, except for the current bagging of the signs. This was done by the city until such time this matter can be resolved. The alley is twenty (20) feet in width and contains a turn-round area at the southerly end. The alley serves as access to the garages for six residences fronting on Yorba Street and for three residences fronting on Rosalind Drive. DISCUSSION: There appear to be two options to help alleviate the concerns of Mr. and Mrs. Westrum. First would be to remove the parking restriction signs on Linda Lane, Rosalind Drive and Laurie Lane, and second would be to remove the no parking signs on one side of the alley; The first option would require the requesting party to circulate a petition to obtain the signatures of 2/3 of the residents requesting the removal of the signs, per current council policy. The second option would require a city action to remove the no parking signs on one side of the alley, but retain them in the turn-around area at the southerly end. CITIZEN COMPLAINT - 13651 ROSALIND DRIVE AUGUST 9, 1989 PAGE 3 Due to the narrow width of the alley (20 ft.), prohibiting parking on one side of the alley provides residents access to their garages as well as emergency vehicle access to the backyards/garages of all the residences adjacent to the alley. The turn-around at the southerly end of the alley should also have parking prohibited on all sides. Staff recommends that parking be allowed on the westerly side of the alley which will provide approximately ten (10) additional parking spaces. Director of Public Works/City Engineer BL:mv
