BACKGROUND: At the July 17, 1989 city council meeting, Cathy and Keith Rankin expressed their concerns/complaints regarding the following items. concerning the E1 Modena-Irvine flood control channel adjacent to and in back of their residence: * Police response to the area * Graffiti on the walls of the flood control channel * Police access to the flood control levies * The throwing of rocks, debris and bottles into the back yards and swimming pools adjacent to the channel * Jurisdiction over the flood control channel * Damage to the Rankin residence due to the de-watering activities during construction of the channel * Difference of elevation between the back yard of the Rankin residence and the surface of the flood control maintenance road The E1 Modena-Irvine flood control channel right-of-way is under the jurisdiction of the County of Orange Environmental Management Agency (Flood Control District) with respect to ownership of property and the recent construction of the reinforced concrete channels and maintenance roads. The channel improvements were designed and constructed by the County of Orange to convey storm run-off from the 100-year frequency storm. Prior to this construction, the earthen channels were unable to convey the 100-year frequency storm run-offs which subjected the area to periodic flooding. The city both requested and supported the county in the construction of these channel improvements. Staff reviewed the area adjacent to the Rankin residence and measured the height of the backfill against the block wall to be approximately 0.7 ft., which reduced the overall effective wall height by ~pproximately 9". Other areas in the immediate vicinity and on the westerly side of the channel have reduced wall heights up to 2 feet. We have received an additional complaint from Adrian Morrison of 1751 Stonehenge Drive about the wall in her back yard which has approximately 2 feet of fill placed against the wall. CITIZEN COMPLAINT - 13321 HIXON CIRCLE AUGUST 9, 1989 PAGE 2 The recent channel construction and any residual effects of that project appear to be the responsibility of the County of Orange. It is suggested that the city write a letter to the county requesting that they contact each of the two residents that have surfaced concerns regarding the effects of the recent channel construction to hopefully determine what can be done to mitigate these concerns. A draft of a suggested letter is attached for the city council's information.. It is also suggested that each of the 20 property owners adjacent to the channel facilities be sent a copy of the letter. It is my understanding that the Police Department will be responding with a separate memo relating to the concerns directed to their department. During the course of construction, the city received citizen complaints which we forwarded to the resident inspector. More recently, the city has received two additional complaints from Tustin residents regarding the project construction as follows: * Cathy and Keith Rankin, 13321 Nixon Circle, Tustin, CA Telephone 731-3521 * Adrian Morrison, 1751 Stonehenge Dr., Tustin, CA ' Telephone 838-0291 The Rankins' concerns/complaints included graffiti on the flood control channel walls, vandalism to their property from individuals gathering within the flood channel right-of-way, which agency (city or county) has jurisdictional control over the flood control facility, reduction of the effective height of their rear wall, and damage to their residence and property due to the de-watering activities during the channel construction. There were additional concerns regarding police response time and police access to the channel maintenance roads for enforcement, and these are to be addressed by the city's police department. Adrian Morrison's concern was the fill material placed against her rear wall and the reduction of the effective height of the wall. The city is reqUesting that your office contact each of the above- mentioned individuals regarding their concerns/complaints and to hopefully mitigate these items. We would be happy to have city staff attend any meetings that you may have with the homeowners. HUSTON, POLICE DEPARTMENT CITIZEN COMPLAINT CITY MANAGER - 13321 NIXON CIRCLE Recommendat ion Receive and file. Background At the July 17, 1989 City Council meeting, Cathy and Keith Rankin expressed their concerns/complaints surrounding the E1 Modena- Irvine flood control channel. This flood control channel runs to the rear of their residence. The flood control channel itself is not within the City boundaries. We de have access to the flood control channel. We do patrol this area because the activities of the individuals who frequent this area cause discomfort to City residents who live adjacent to it. There have been few calls for service over the last several months. The response times to these calls were within acceptable limits . We have contacted Nixon Circle residents regarding a Neighborhood Watch meeting. The overriding concerns at this time are the construction/flood control issues. The Police Department is not qualified to deal with these issues. The Neighborhood Watch meeting has been put on hold until some of these construction issues have been resolved. Sgt. with other take this Peery is the Tustin Police Department's operational liaison the homeowners. He has been in contact with Mr. Rankin and homeowners in the area.
