This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk's office for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the books located at the Police Department, Tustin Library and, on the evening of the meeting, at the rear of the Council Chambers. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chambers; however, if you desire to smoke, an outside speaker has been provided. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE II. INVOCATION - The Invocation will be given by Alan Waterson, Pastor of Aldersgate Methodist Church. III. ROLL CALL IV. PROCLAMATION - WILLIAM GRAY, CONTINENTAL CABLEVISION V. PUBLIC HEARING 1. RECOVERY OF CITY INCURRED COSTS OF ABATEMENT OF A PUBLIC NUISANCE AT 200 EL CAMINO REAL A major fire damaged the Pacific Meat Company on July 30, 1989, which left the structure as a major loss. The Community Development Department let an emergency contract to clean the site on August 12, 1989. Recommendation: After conducting the required Public Hearing, assess the charges of four thousand thirty six dollars and ninety cents ($4,036.90) against the property as a special assessment and lien as recommended by the Community Development Department. 2. NEWPORT AVENUE/WARREN ANNEXATION NO. 149 The subject annexation is 7.826 acres in size and is located on the west side of Newport Avenue. The area is bounded by unincorporated residential properties on the west and north, the northern border of Tustin (Baptist Church) on the south, and Newport Avenue on the east. Recommendation: Conduct a Public Hearing to receive testimony from affected residents and adopt the following Resolution No. 89- 127 making application for Annexation No. 149 to the Local Agency Formation Commission (LAFCO) as recommended by the Community Development Department: CITY COUNCIL AGENDA PAGE 1 . APPROVAL OF MINUTES - AUGUST 21, 1989, REGULAR MEETING 2. APPROVAL OF DEMANDS IN THE AMOUNT OF $2,277,006.28 RATIFICATION OF PAYROLL IN THE AMOUNT OF $207,149.08 3. VESTING TENTATIVE TRACT MAP 13746 (AKINS DEVELOPMENT) RESOLUTION NO. 89-129 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR VESTING TENTATIVE TRACT MAP 13746 AND ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT Approve Environmental Determination for the project by adJption of Resolution No. 89-129; and RESOLUTION NO. 89-130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING TENTATIVE"TRACT MAP NO. 13746 Approve Vesting Tentative Tract Map 13746 as recommended by the Planning Commission by adopting Resolution No. 89-136 as recommended by the Community Development Department. 4. RESOLUTION NO. 89-128 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CONFIRMING THE APPLICATION OF THE MASTER PROPERTY TAX TRANSFER AGREEMENT TO THE PROPOSED NEWPORT/WARREN ANNEXATION NO. 149 Adopt Resolution No. 89-128 confirming the application of the Master Tax Transfer Agreement to the Proposed Newport Avenue/Warren Annexation No. 149 as recommended by the Community Development Department. 5. RESOLUTION NO. 89-132 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING PLACEMENT OF A CERTAIN STOP SIGN AT THIRD STREET AND PREBLE DRIVE Adopt Resolution No. 89-132 authorizing the placement of a stop sign at the subject intersection in the City of Tustin as recommended by the Public Works Department/Engineering Division. RESOLUTION NO. 89-134 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING PLACEMENT OF STOP SIGNS AT VARIOUS LOCATIONS IN THE CITY OF TUSTIN Adopt Resolution No. 89-134 authorizing the placement of stop signs at various locations as recommended by the Public Works Department/Engineering Division. 8. RESOLUTION NO. 89-135 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING ITS INTENTION TO VACATE AND ABANDON FAIRGATE DRIVE BETWEEN TUSTINRANCH ROADAND THE NORTHERLY BOUNDARY OF TRACT NO. 12870 AND A PORTION OF RAWLINGS WAY BETWEEN FAIRGATE DRIVE AND A POINT APPROXIMATELY 150 FEET EASTERLY OF FAIRGATE DRIVE AND TO FIX A TIME AND PLACE OF PUBLIC HEARING THEREON Adopt Resolution No. 89-135 declaring the City's intention to vacate and abandon Fairgate Drive between Tustin Ranch Road and the northerly boundary of Tract No. 12870 and a portion of Rawlings Way between Fairgate Drive and a point approximately 150 feet easterly of Fairgate Drive, and setting a time and place of a public hearing thereon as recommended by the Public Works Department/Engineering Division. 9. RESOLUTION NO. 89-136 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, SETTING A TIME AND PLACE OF A PUBLIC HEARING TO CONSIDER THE DESIGNATION AND ADOPTION OF ANUNDERGROUND UTILITY DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD ~IRES AND ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE CITY OF TUSTIN LOCATED ON RED HILL AVENUE BETWEEN SYCAMORE AVENUEAND 580 FEET NORTHERLY OF WALNUT AVENUE, WHICH AREA IS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" AND ON THAT CERTAIN MAP ON FILE IN THE OFFICE OF THE CITY CLERK AND CITY ENGINEER'OF THE CITY OF TUSTIN Adopt Resolution No. 89-136 which sets the time and place of a public hearing to consider the designation and adoption of the Red Hill Avenue Underground Utility District No. 11 as recommended by the Public Works Department/Engineering Division. 10. AUTHORIZATION TO SOLICIT EQUIPMENT BIDS Authorize solicitation of proposals for the purchase of new and replacement equipment authorized in the 1989-90 fiscal budget as recommended by the Public Works Department/Field Services Division. 11. REQUEST FOR TREE REMOVALS (1) Approve requests for tree removals at the following locations: 17652 Limetree Way, 14551 Cherrywood Lane, 14712 Buckingham Place, Centennial Park and 14662 Cheshire Place and (2) Deny request for tree removal at the following location: 13772 Palace Way as recommended by the Public Works Department/Field Services Division. D-'" 039 Approve ~perative Agreement No. D. .039 for the construction of traffic signal improvements along £rvine Boulevard, Newport Avenue and Edinger Avenue, and authorize the Mayor to execute said agreement as recommended by the Public Works Department/ Engineering Division. VIII. ORDINANCE FOR INTRODUCTION - None IX. ORDINANCE FOR ADOPTION 1. NO PARKING ZONES ON PORTIONS OF FIRST STREET, IRVINE BOULEVARD AND YORBA STREETS - ORDINANCE NO. 1028 The following Ordinance No. 1028 had first reading and introduction at the August 21, 1989 City Council meeting. ORDINANCE NO. 1028 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING AND PRESCRIBING NO PARKING ZONES ON PORTIONS OF FIRST STREET, IRVINE BOULEVARD AND YORBA STREETS Recommendation: X. M.O. - Ordinance No. 1028 have second reading by title only. M.O. - Ordinance No. 1028 be passed and adopted. (Roll call vote) OLD BUSINESS 1. STATUS REPORT - JOHN WAYNE AIRPORT NOISE MONITORING PROGRAM (JWA), COALITION FOR A RESPONSIBLE AIRPORT SOLUTION (CRAS), AIRPORT SITE COALITION (ASC) AND HELICOPTER OVERFLIGHT PROGRAM TASK FORCE (HOPTF) Update on the John Wayne Airport Noise Monitoring Program (JWA), Coalition for a Responsible Airport Solution (CRAS), Airport Site Coalition (ASC) and Helicopter Overflight Program Task Force (HOPTF) . Recommendation: Receive and file subject report as recommended by the Community Development Department. 2. CITIZEN COMPLAINT - ALLEY SOUTHERLY OF LINDA LANE AND EASTERLY OF YORBA STREET AND REMOVAL OF STREET SWEEPING SIGNS ON WESTERLY SIDE OF YORBA STREET At the August 21, 1989 City Council meeting, concerns were raised by Mr. Ralph Westrum, 13651 Rosalind Drive, regarding the status of the alley lying southerly of Linda Lane and westerly of Yorba Street and removal of "No Parking During Street Sweeping Hours" signs on the westerly side of Yorba Street. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. No action will allow "No Parking" restrictions to remain in effect. 3. CITIZEN CONCERN: I-5/SR-55 INTERCHANGE CONSTRUCTION Two members of the Tustin Village Way Homeowners, Association raised concerns that they have had no communication from Caltrans CITY COUNCIL AGENDA PAGE 4 . Recommendation: Receive and file report and direct staff to send subject letter to Caltrans with a copy to the homeowners' association as recommended by the Public Works Department/ Engineering Division. XI. NEW BUSINESS 1. GREEN VALLEY RESIDENTSt REQUESTS At the August 21, 1989 City Council meeting, Mr. Berklee Maughan, on behalf of a group of residents on Green Valley, presented four issues to the City Council for consideration. Recommendation: Pleasure of the City Council. Z. EQUIPMENT PURCHASE REQUEST Subject request concerns the bid process and purchase of a one- ton valve truck. Recommendation by Public Works Department/Field Services Division: (1) That the City Council rescind their authorization to purchase a one-ton valve truck from Guaranty Chevrolet as authorized at the June 5, 1989 City Council meeting; and (2) Authorize staff to readvertise and solicit additional bids for the purchase of a one-ton valve truck in fiscal year 1989-90. 3. CODE OF ETHICS RESOLUTION At its meeting of August 7, 1989, the City Council concurred to schedule discussion of a Code of Ethics Resolution. Recommendation: Pleasure of the City Council. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - AUGUST 28, 1989 Ail actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of August 28, 1989. 2. CMS ENHANCEMENTS At the August 21, 1989 City Council meeting, Mr. Dick Rupe, representing CMS Enhancements, identified a number of issues he had encountered related to installation of high stock storage. Recommendation: Receive and file subject report as recommended by the Community Development Department. CITY COUNCIL AGENDA PAGE 5 . SEPTEMBER 5, 1989 3. STATUS OF PECTION OF PROPERTY AT 1'-"1 WOODLAND On August 21, 1989, the City Council directed staff to coordinate various inspections on the subject property prior to proceeding with further action on declaring the property a public nuisance. Recommendation: Receive and file subject report as recommended by the Community Development Department. 4. SALE OF SURPLUS EQUIPMENT On July 17, 1989, the City Council declared Police Unit 3402, damaged beyond repair, as surplus. Recommendation: Receive and file notice of sale of surplus, Police Unit 3402, as provided for in Ordinance No. 871 as recommended by the Public Works Department/Field Services Division. 5. INFORMATIONAL UPDATE ON THE STATUS OF THE WIDENING OF I-5 AND SR-55 AND THE RECONSTRUCTION OF THE I-5/SR-55 INTERCHANGE Subject report concerns work to widen I-5 from 1-405 to SR-55 and the reconstruction of the I-5/SR-55 interchange. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 6. WARNER AVENUE BRIDGE CONSTRUCTION STATUS REPORT This report will provide an update on the Warner Avenue bridge through the week of September 18, 1989. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 7. RESPONSE TO COMMENTS FROM MR. BRUCE TRAYWICK Mr. Bruce Traywick, 14651 Pacific Street, has expressed several concerns relative to traffic conditions along Yorba Street between Irvine Boulevard and Seventeenth Street.
