After conducting the required public hearing it is recommended that the City Council
assess the charges of four thousand thirty six dollars and ninety cents ($4,036.90)
against the property as a special assessment and lien (see attached Exhibit A).
BACKGROUND AND DI~CU$$IOII

A major fire damaged the Pacific Meat Company on Sunday, July 30 which left the
structure as a major loss (more than 50% value). On Monday after the fire, the
Building Official served notice to the tenant, a* Mr. Steve Mendel a notice to
immediately secure the property and to barracade the public walkways because of the
extensive fire damage which occurred. Over the next several days the tenants cleared
out most salvageable belongings, meat and cleared off fire debris from the sidewalks
and fenced the entire property from trespassers.
During the second week citizens and city officials became aware of a very offensive
odor coming from the site. After investigating tt was apparent that portions of meat
products and residue were still evident at the site.
With the efforts of County Health Officials and the Building Official, we were able
to track down and locate officers of the meat company, and notified them that major
clean-up was needed immediately because of the stench, flies larvae and maggots
breeding in the abandoned meat residue.
The officers of the meat co. any, the property owner and major lenders and insurance
agent involved with the property were served notice to clean-up the site of all meat
products creating and health hazard within 24 hours.
Work was not started until late in the day Friday, 8/10/89 by manual labors and was
not to the degree of effort needed to handle the situation which was an immediate
threat.
The Community Development Department let an emergency contract to clean the site on
Saturday, August 12, which is the cost we have in Exhibit A.

In the notices served, a time frame of 30 days was also given to all parties to come
in with plans to rebuild the structure or secure demolition permits and remove the
damaged structure. To date, Security Pacific has been the only party to respond that
has a vested interest in the property. If the owners fail to demolish the structure
by September 11th or appeal the City's notice and order on the structure. The City
could let a contract to remove the damaged structure and assess this additional cost
to the property. Prior to proceeding with such a direction, staff will provide a
status report to the City Council at their meeting on September 18, 1989.

clean-up and assessment of the structural damage to the structures on
the site.
Within 30 days of the mailing of this notice, plans shall be submitted
to this office which detail reconstruction of any new buildings.
Otherwise, proper permits shall be. secured from the Co~unity
Development Department and work underway 'to remove the buildings.
Please note, however, that you must comply with all provisions of
Section 92?3 of the -Tustin Code.for non-conforming structures. The
previously existing land use (meat company) is considered a non-
conforming land use. Since over 50% of the currently assessed value
(prior' to the ....fire)-'of--the--structure has.been -damaged, any new
structures and uses on the property must fully comply with the existing
zoning and Uniform Building Code requirements for the district in which
the property is located.
If clean-up of the site is not started within 24 hours of this notice
or if plans or demolition permits are not secured within 30 days from
the mailing of this notice, the City may proceed to cause work to be
