RECOI~IENDATION
It is recommended that the City Council adopt Resolution No. 89-128 confirming the
application of the Master Tax Transfer Agreement to the Proposed Newport
Avenue/Warren Annexation No. 149
PROJECT ANALYSIS

On September 5, 1989 the City Counctl considered a petition filed by County property
owners to adopt a resolution of application for the Newport Avenue/Warren Annexation
No. 149.
Section 99(d) of the Revenue and Taxation Code requires the City and County to
provide the exchange of property tax revenue prior to consideration of the proposed
annexation application by the Local Agency Formation Commission (LAFCO). To meet
this requirement, staff has prepared a resolution to declare the existing master tax
transfer agreement of November, 1980 as appropriate for this annexation.
CONCLUSION
Prior to filing the Application for Annexation with LAFC0, a resolution which
proposes agreement on the property tax transfer must be approved by the City and
County. These resolutions then become part of the formal application file with
LAFC0.

A RESOLUTION OF' THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, CONFIRMING THE APPLICATION OF
THE MASTER PROPERTY TAX TRANSFER AGREEMENT TO THE
PROPOSED NEWPORT/WARREN ANNEXATION NO. 149
WHEREAS, a MASTER PROPERTY TAX TRANSFER AGREEMENT BETWEEN THE COUNTY
OF ORANGE AND THE CITY OF TUSTIN TO PROVIDE FOR PROPERTY TAX EXCHANGE IN
AREAS ANNEXED BY THE CITY dated October 28, 1980, has been executed by the
Board of Supervisors of Orange County and the City Council of the city of
Tustin providing for division of property taxes pursuant to'Section 99(d)
of the Revenue and Taxation Code of the State of California; and
WHEREAS, the City Council of Tustin has proposed the annexation of
the uninhabited and developed area known as Newport/Warren Annexation No.
149.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the city of
Tustin that the MASTER PROPERTY TAX TRANSFER AGREEMENT BETWEEN THE COUNTY
OF ORANGE AND THE CITY OF TUSTIN TO PROVIDE FOR PROPERTY TAX EXCHANGE IN
AREAS ANNEXED BY THE CITY providing for the allocation of property tax
revenues, as approved by the Board of Supervisors and the City Council and
entered into on November 18, 1980, shall be applicable to the territory
within the proposed Newport/Warren Annexation No. 149 to the city of Tustin
for the annexation of 2,826 acres as substantially developed property.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council
