HomeMy WebLinkAboutOB 3 CITIZEN CONCERN 09-05-89TO: WILLIAM HUSTON, CITY MANAGER F~OM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION 'SUB~ECT: CITIZEN CONCERN: I-5/RTE. 55 INTERCHANGE CONSTRUCTION RECOM~ENDATION: Receive and file report, and direct staff to send attached letter to Caltrans with a copy to the Homeowners Association. BACKGROUND: Two members of the Tustin Village Way Homeowners Association raised concerns that they have had no communication from Caltrans during the past several months regarding the freeway construction as it relates to their residential development. The city's consultant, Bob Jones, made contact with Caltrans and obtained the following information: · There have been no negotiations with the Association for some time due to a change in the amount of right-of-way that would be required from the Homeowners Association. This change negated the appraisal Caltrans had completed and consequently, Caltrans withdrew the original offer. Caltrans has not proceeded with a new appraisal and offer to the Homeowners Association until they are confident that there will be no more changes in the ~,design. The revised appraisal report is scheduled for completion approximately three weeks from August 30, 1989, with an additional week required for the offer to the affected property owners. · Caltrans did indicate that wherever feasible the sound walls will be' constructed as a first order of business with each stage of construction. Councilman Edgar was correct with respect to his information that, due to alignment conflicts, a portion of the sound wall adjacent to the new connector road from southbound I-5 to southbound Rte. 55 cannot be constructed .until such time as the new connector road is constructed. · The K-rail and plywood barriers are being utilized to channelize vehicles from the southbound I-5 connector road to southbound Rte. 55 and the recently relocated McFadden Avenue off-ramp. These barriers will help provide a safe work area for the removal of the abandoned McFadden off/on ramps and the McFadden Avenue bridge reconstructions. CITIZEN CONCERN: I-5/RTE. 55 INTERCHANGE CONSTRUCTION AUGUST 30, 1989 PAGE 2 Aside from the freeway related construction, Donna Wilson raised a concern about the local agencies' construction on surface streets as they relate to the freeway construction. In the future, staff will be reviewing any major Tustin projects with adjacent agencies so as to minimize conflicts and inconvenience to the public. Attached is a draft letter for the Mayor's signature which has been prepared at the city council's request. If this letter meets with the council's concurrence, it will be finalized and sent to Caltrans. Bob Ledendecker Director of Public Works/City Engineer BL:mv Attach/ DRAFT September 5, 1989 Mr. Keith McKean, Director Caltrans, District 12 2501 Pullman Street Santa Ana, CA 92705 Re: Santa Ana (I-5)/Costa Mesa Rte. 55 Freeway Interchange Dear Mr. McKean: The Tustin City Council continues to receive concerns from the Tustin Village Way Homeowners Association regarding the current and proposed freeway construction as it relates to their residential development located at 15500 Tustin Village Way, Tustin, CA. In previous meetings, the following initial concerns had been raised by the Homeowners Association: 1. The loss of covered and open parking spaces and the replacement of same. This is also a major concern of the city due to the absence of any on-street parking spaces as it relates to this development. 2. The need for the Caltrans acquisition of any dwelling units, if any. 3. Loss of common or open space such as swimming pools, laundry facilities and landscaped areas. 4. Resultant noise' levels from both the freeway and HOV elevated transitways affecting the residential development and what degree of mitigation measures will be required, if any. 5. Visual intrusion of the proposed elevated transitways to the residential units bordering the freeway rights-of-way. It is requested that Caltrans' staff meet .with the Homeowners Association to respond to these concerns which have not been previously resolved and provide them with any updates on the project status. Mr. Keith McKean September 5, 1989 Page 2 More recently, the Homeowners Association has expressed additional concerns that they have not had any communication from Caltrans regarding the right-of-way acquisitions and the above-mentioned concerns. Additionally, the homeowners were concerned about the scheduling of the sound wall construction prior to the commencement of any construction. It is our understanding from recent conversations with Caltrans' staff that a change in right-of-way needs has halted all right-of-way negotiations and new appraisals will have to be made. If this information is correct, we would request that Caltrans contact the Homeowners Association and inform them of any revised project scheduling as it relates to their development. We would request that the city's representative, Mr. Bob Jones, be included in any meetings with the Tustin Village Way Homeowners Association that would relate changes in project scope and scheduling as well as the above-mentioned concerns.
