HUSTON, CITY MANAGER REDEVELOPMENT AGENCY STAFF EDA AWARD NO. 07-49-03826 SUMMARY City Council authorization is requested to secure reimbursement of City of Tustin staff expenses related to administration of a federal construction grant. RECOMMENDATION It is recommended that the City Council adopt Resolution no. 03-88 (attached). FISCAL IMPACT Termination of the EDA grant will ensure reimbursement of EDA grant administrative costs incurred by the City of Tustin. BACKGROUND/DISCUSSION/CONCLUSION On January 15, 1999, the United'States Department of Commerce and City of Tustin executed an Economic Development Agency (EDA) construction grant for the planned improvement of a portion of street, water and other infrastructure improvements associated with the Valencia/Armstrong project for Tustin Legacy. Grant terms under which the City originally applied are no longer conditions that the City can meet. In addition, EDA policies and rules governing the use of such grants have also changed since 1998, when the City originally applied for and received the grant. Through City Council approval of Resolution 03-88, the City will request that EDA reimburse approximately $45,122 in City administrative costs associated with the grant's past administration. Final eligibility for such reimbursement will be determined by the EDA. Christine A. Shingletor~/,/ Assistant City Manager' Program Manager Attachment RESOLUTION NO. 03-88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING REIMBURSEMENT OF ENGINEERING COSTS AND REQUEST TO TERMINATE U.S. DEPARTMENT OF COMMERCE, ECONOMIC DEVELOPMENT ADMINISTRATION FEDERAL ASSISTANCE AWARD AGREEMENT (EDA AWARD NO. 07-49-03826) The City Council of the City of Tustin finds as follows: A, On January 15, 1999, the City of Tustin accepted the Financial Assistance Award Agreement for the construction of street, water and sewer extensions at the former Tustin Marine Corps Air Station. NOW, THEREFORE, the City Council of the City of Tustin resolves as follows: , The City of Tustin requests reimbursement of costs in the amount of $45,122 from the U.S. Department of Commerce, Economic Development Administration; and that this is the final reimbursement request. , The City of Tustin furthermore request that the U.S. Department of Commerce, Economic Development Administration terminate this agreement after the reimbursement request has been processed and all the necessary documentation is completed.
