BACKGROUND
During the week of September 6th the Building Official contacted both Security
Pacific Bank and Aetna Insurance Company, the only two parties who show an
interest in the property mentioned above. A certified letter to Mr. Asher, the
listed owner was returned unclaimed.
It has been verified that the property was in foreclosure the day of the fire,
so Mr. Asher did not own the property when the fire occurred. The insurance
company has indicated the necessity of having the property appraised in order to
allow the proper amount to be paid to Security Pacific Bank prior to demolition
of any structures. The insurance company.already has a bid to demolish the
building and hopes to be working with Security Pacific in the next couple of
weeks per a phone conversation as of September 7, 1989 to proceed with.
demolition upon resolution of the appraisal issue.
As a fall back, since no appeal to the Notice and Order has been received, the
the Building Official has requested demolition quotations from-three licensed
demolition contractors that we should receive the week of September. 13th.
However, staff feels that because of the complex legal issues, both~the lender
and the insurer have been working towards the demolition of the structure and it
would be perhaps premature to actually commence with demolition when
communication has been received indicating that there is' an intent to comply
with the Notice and Order. Since the property is adequately secured and fenced,
staff believes it appropriate to defer any action on City demolition for at
least 2 weeks. We would be prepared to provide a status report to the City
Council on October 2.
