Home My WebLink AboutPH 1 VACATION FAIRGATE 10-02-89PUBLIC HEARING N0. 1 10-2-89 o Inter - Com jATE: SEPTEMBER 25, 1989 V TO: WILLIAM HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: VACATION AND ABANDONMENT OF FAIRGATE DRIVE AND A PORTION OF RAWLINGS WAY RECOMMENDATION: It is recommended that upon completion of the public hearing, and if the City Council desires to vacate and abandon Fairgate Drive between Tustin Ranch Road and the northerly boundary of Tract No. 12870 and a portion of Rawlings Way between Fairgate Drive and a point approxi- mately 150 feet easterly of Fairgate Drive, that the attached resolution be passed and adopted by the City Council at their meeting of October 2, 1989. BACKGROUND: At their meeting of September 5, 1989, the City Council adopted Resolution No. 89-135 declaring its intention to vacate and abandon Fairgate Drive and Rawlings Way and fixing a time and place for the public hearing thereof. The public hearing has been set for the October 2, 1989 council meeting at 7:00 p.m. After this public hearing has been completed, and if the council so desires to vacate and abandon Fairgate Drive and Rawlings Way, the attached resolution will require adoption. This resolution provides for permanent easements per Section 8330 of the Streets and Highway Code for all existing public utilities within those portions of Fairgate Drive and Rawlings Way to be vacated and abandoned. Once the adopted resolution is recorded at the County Recorder's office, the.proceedings on this abandonment action are complete. The City Council finds and determines: a. The City Council duly adopted its resolution No. 89-135, declaring its intention to vacate and abandon Fairgate Drive and Rawlings Way, described in Exhibit "A" and shown on Exhibit "B" attached hereto and incorporated herein by this reference, and fixing a time and place of public hearing thereon. b. Said resolution has been duly published according to law; and c. Said notices of said hearing have been posted as required by law; and d. A public hearing has been duly called, noticed and held according to law, and all persons interested in or objecting to the proposed vacation and abandonment appearing at said hearing were heard. e. Said portion of streets are not necessary for present or prospective public street purposes, except for public utilities. f. That the Planning Commission by adoption of Resolution No. 2662 dated August 28, 1989, has determined that the subject property should be declared excess to the City's needs and disposed of for private -street purposes. g. Categorical exemption from EIR requirements. 2. The City Clerk is directed to cause a certified copy of this resolution, duly attested by the City Clerk under seal of the City, to be recorded in the office of the County Recorder of the County of Orange.
