RECOHMENDATION
It is recommended that the City Council adopt Resolution No. 89-145, approving an
amendment to Flnal Tract Hap 12870, as submitted or revised.
BACKGROUND
Flnal Tract Map 12870 was recorded in Hay of 1988, establishing streets and lots for
Phase II! of the Tustln Ranch. All streets established with the r. ecordatton of
Ftnal Tract Hap 12870 were public str~ts.
The applicant has submitted a request to the Publlc Norks ,Department to vacate all of
Fatrgate Drtve and a portion of Rawlings Nay, (public streets) to create prtvate
streets tn locations shown on Attachment !,- !n conjunction with the requested street
vacations, the applicant proposes to construct private street entries and landscape
Improvements at the Intersections of Fa~rgate Drtve/Tusttn Ranch Road and Falrgate
Drive/Rawlings Nay, !n order to accommodate the proposed private entry improvements,
which involve widening the street sections, the Company is requesting approval to
amend the final map for Tract 12870 to adjust the boundaries of the lots adjoining
the subject streets.
On August 28, 1989, the Planning Commission adopted Resolution No. 2665 (attached),
recommending approval of an amendment to Final Tract Map 12870 to the City Council.
At that time, the Planning Commission also approved the design review for the
proposed private entry improvements and adopted findings that the proposed street
vacation is consistent with the City's General Plan.

The proposed amendments to Final Tract Map 12870 would adjust the boundaries of the
Fairgate Drive and Rawlings Way right-of-ways and the adjacent builder and landscape
lots to create a guard gated community ultimate.ly containing as many as 1,100
dwelling units and 3,500 residents. ..
The proposed amendment involves the following:
Fatrgate Drive becomes a private street and is renamed "Township Drive" to be
consistent with Tract 13627 for Phase IV.

Fatrgate (Township) Drtve ts wtdened at 1ts Intersection with Tusttn Ranch Road
to accommodate a guard house, gates, vehlcle turn around and enhanced street
Improvements/landscaping.
Rawlings. Way is cul-de-saced at its intersection with Fairgate (Township) Drive
to accommodte gates, vehicle turnaround and public access to an adjacent future
school site (lot 6, Tr. 12870).
Lots "ODD" "EEE" "FFF" "GGG" "HHH" "III" "JJO" and "KKK" are created for
private street and landscape purposes.
Minor reductions in size occur to Lots 3, 8 and 28 of Tract 12870, resulting in
a total reduction of 5 potential dwelling units.
The future school site is reduced from 10.006 to 9.901 acres (the School
District has agreed to this reduction).
The widening of Falrgate (Township) Drive, cul-de-sactng of Rawlings Way and creation
of new landscape lots would not result in a substantial deviation from the purpose
and intent of the approved final map.
Maintenance responsibilities for all improvements within lots "DDD" (Township Drive)
"EEE", "FFF", "GGG", "HHH", "III", "JJJ" and "KKK" will be the responsibility of a
Master Homeowner's Association, that will include future developments on lots 3, 4,
5, 8 and 28 of Tract 12B70 and lots 13, 24 and 26 of Tract 13627, as those eight ,10ts
will constitute the communities behind the gates. .

Given the analysis conducted by staff and consideration of comments from outside
agencies, it is concluded that the proposed amendment to Final Tract Map 12870 meets
the requirements of the State Subdivision Map'Act, State Planning Law, the East
Tustin Specific Plan and the Tusttn City Code. It is, therefore, recommended that
the City Council approve an amendment to Final Tract Map 12870, subject to the
conditions contained in Exhibit A of Resolution No. 2665.

AND LOT "DDD" FOR THE PURPOSE OF TURNING FAIRGATE
DRIVE AND A PORTION OF RAWLINGS WAY INTO A PRIVATE
STREET.
The City Council of the City of Tusttn does hereby resolve as follows'
I. The City Council finds and determines as follows-
A. That an Amendment to Final Tract Map 12870 was submitted to the
City by the Irvine Company for consideration.
B. That the proposed amendment will increase the number of lettered
lots by eight.
C. That the amended map is consistent with the intent and spirit of
the approved Final Tract Map 12870.
D. That the proposed amendments do not Violate the provisions of'
the City's Subdivision Ordinance or the State Subdivision Map
Act.
E. That a program EIR was previously prepared and certified for
this project.
F. That the proposed amendment to Final Tract Map 12870 is in
conformance with the Tustln General Plan, adopted East Tustin
Specific Plan, Development Agreement and Subdivision Map Act as
it pertains to the development of Sectors 5 and 8.

That the 'City has reviewed the School Facilities Agreement
between theI Irvine Company and the Tustin Unified School
District, the East Tustin Specific Plan, EIR 85-2 and the
impacts of the amendment to Final Tract Map 12870 for School
District Facilities and finds and determines that the impacts on
School District facilities by approval of this amended map are
adequately addressed through the imposition 'of school facility
fees as a condition of approval as contained in Exhibit A,
of Resolution No. 2665, incorporated herein by reference.
H. That the design of the amended map will not conflict wi th
easements acquired or required by the public at large, for
access through or use of the property within the subdivision.

Request for Street Vacation - Fairgate Drive and Rawlings Way
The city has received a request from the Irvine Company to abandon/
vacate the following streets within Tract No. 12870:
* Fairgate Drive between Tustin Ranch Road and the northerly
tract boundary
* A portion of Rawlings Way between Fairgate Drive and a point
approximately 150 feet easterly of Fairgate Drive.
As a part of this street abandonment/vacation process, Tract Map No.
12870 must be amended to designate these streets as a lot that will
provide permanent access to the affected subdivided lots 3, 4, 5, 6, 8
and 28 within Trac~ No. 12870. This access lot will also provide
permanent easements for all existing and future-required public
utilities serving the general area pursuant to Section 8430 of the
Street and Highway Code.
Concurrently with the recordation of the amended Tract .Map No. 12870,
the streets must be formally vacated via the following process: -
* Planning Commission makes a finding that the subject street
vacations will be in conformance with the ~Tustin General Plan
and advises the City Council of said finding.
* City Council passes and adopts a resolution declaring their
intention to vacate said streets and sets the time and place for
a public hearing on said matter.
* 'City Council h6'lds '~bove-mentio~ed public hearing and-receives
public'testimony on said proposed street vacations, if any.
* City Council, based upon said public testimony, makes a determination
as to whether the streets~.~should be vacated and takes an action on
said vacation.
As a point of information, amended...Tract Map No..1.2870 .changes the 'name
of Fairgate Drive. to Township Drive. The tract map has been plan
checked and is ready for° submission to both the Planning Commission and
City Council for their final actions/approvals.

TUSTIN, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY
COUNCIL OF' AN AMENDMENT TO FINAL TRACT MAP 12870,
CREATING LOTS "EEE", "FFF", "GGG", "HHH", "III",

The Planning Commission of the City of Tustin does hereby resolve as

installed onto lot 6 (school site) at a point in time when the driveway '
parking lot is constructed on 'school site. Said access shall have a minimum
width of 24 feet.

CCR'$
(1) 7.1 Prior to recordation of the first builder level subdivision map to all lots
within Sector 8 of the East Tustin Specific Plan, all organizational documents
for the project including any deed restrictions, .covenants, conditions, and
restrictions shall be submitted to and approved by the Community Development
Department'and City Attorney's Office. Costs for such review shall be.*.borne
by the subdivider. A copy of the final documents shall be submitted to the
Community Development Department after their recordation. CCR's shall include
but not be limited to the following provisions:

Since the City is interested in protecting .the public health and safety
and ensuring the quality and maintenance of common areas under control of
a Master Homeowner's Association, the City shall be included as a par~y
to the CCR's for enforcement purposes of those CC&R provisions in which
the City has interest, as reflected by the following B through K.
However, 'the City shall not be obligated to enforce the CCR's.

Maintenance standards shall be provided for applicable items listed in
Section C above in CCR's. Examples of maintenance standards are shown
be 1 ow:
(1) All common area landscaping and private lawn areas visible from any
public way shall be properly maintained such that they are evenly
cut, evenly edged, free of bare or brown spots, free of debris and
free of weeds above the level of the lawn. All planted areas other
than lawns shall be free of weeds, dead vegetation and debris. All
trees and shrubs shall be trimmed so they do not impede pedestrian
traffic along the walkways. Trees shall be pruned so they do not
intrude into neighboring property and shall be maintained so they do
not have droppings or create other nuisances to neighboring
property. All trees shall also be root pruned to eliminate exposed
surface roots and damage to sidewalks, driveways and structures.
(2) All private streets, sidewalks and paseo shall be maintained so
that they. are safe for users. Significant pavement cracks, pavement
distress, excessive slab settlement, abrupt vertical variations and
debris on travel ways should be removed or repaired promptly.
(3) Common areas shall be maintained in such a manner as to avoid the
reasonable determination of a duly authorized official of the City
that a public nuisance has been created by the absence of adequate
maintenance such as to be detrimental to public health, safety,*or
general welfare, or that such a condition of deterioration or
disrepair cause harm or is materially detrimental to property values
or improvements within the boundaries of th· subdivision' and Master
Homeowner's Association, to surrounding property, or to .property or
improvements within three hundred (300) feet of the property may
also be added as alternative language.
Master Homeowner's Assoct=tlon approval of exterior improvements in areas
of their maintenance responsibilities requiring a building permit shall
be obtained prior to requesting a building permit from the City of Tustin
Community Development Department. All plans for exterior improvements
shall conform to requirements set forth by the City and the CCR's.
All utility services serving the site shall be installed and maintained
underground.

The Association shall be required to file the nameS, addresses, and
telephone numbers of at least one member of the Association Board and
where .applicable, a Manager of the project before January 1st of each
year with the City of Tustin Community Development Department for the
purpose of contacting the association in the case of emergency or in
those cases where the City has an interest in CC & R violations.
Perimeter project block walls under Master Homeowners' Association
Maintenance responsibility to be constructed on private property shall be
maintained and replaced, if necessary by the Master Homeowner's
Association. This shall not preclude the Master Homeowner's Association
from .assessing charges to individual property owners for structural
damage to the wall or fence.
No amendment to alter, .modify, terminate or change the Homeowner's
Association's obligation to maintain the common areas and the project
perimeter wall (include if the wall is located on private property) or
other CC&R provisions in which the City has an interest, as noted above,
or to alter, modify, terminate or change the City's right to enforce
maintenance of the common areas and maintenance of the project perimeter
wall, shall be effective without the prior written approval of the City
of Tustin Community Development Department.
