ORDINANCE NO. 1030 - AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 89-01, TO
CHANGE THE LAND USE DESIGNATION OF THE FIRST STREET SPECIFIC
PLAN FROM "OFFICE AS PRIMARY USE" TO "COMMERCIAL AS PRIMARY USE"
ON THE PROPERTY LOCATED AT 640 WEST FIRST STREET

ORDINANCE NO. 1030
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 89-02, TO
CHANGE THE LAND USE DESIGNATION OF THE FIRST STREET
SPECIFIC PLAN FROM "OFFICE AS PRIMARY USE" TO
"COMMERCIAL AS PRIMARY USE" ON THE PROPERTY LOCATED AT
640 WEST FIRST STREET.
The City Council of the City of Tustin does hereby ordain as follows:
I. The City Council finds and determines as follows:
A. That a proper application, (Zone Change No. 89-02) has been
filed on behalf of the David Mel i l l i Company to change the land
use designation of the First Street Specific Plan from "Office
as Primary Use" to "Commercial as Primary Use" on the property
located at 640 West First Street legally described as Lot 5,
Tract 334.
B. That a public hearing was duly called, noticed and held on said
application on August 28, 1989 and September 18, 1989.
C. That a zone change should be granted for the following reasons:.,
1. That the proposed Zone Change is consistent with the
General Plan, particularly the Land Use Element which
identifies this property with a commercial land use
designation on the land use map.
2. That the proposed Zone Change is consistent with provisions
of the First Street Specific Plan related to encouragement
for retail uses, consolidation of smaller parcels, and
providing reciprocal access between parcels.
3. That the proposed Zone Change is in the best interest of
the public health, safety, and welfare of the surrounding
neighborhood and property by providing orderly development
and compatible land uses with the adjacent retail office,,
z and multi -family land uses.
D. A Negative Declaration has been prepared for the project in
accordance with the California Environmental Quality Act.

II. The City Council hereby approves Zone Change No. 89-02 to change the
land use designation of the First Street Specific Plan from "Office
as Primary Use" to "Commercial as Primary Use" on the property
located at 640 West First Street and legally described as Lot 5 of
Tract 334, as shown on the attached Exhibit A.
PASSED AND ADOPTED at a regular meeting of the City Council, held on the
day of , 1989.
