HUSTON, CITY MANAGER ` OLD BUSINESS NO. 8 10-2-89 Inter - Com FROM: - COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: CODE ENFORCEMENT REVIEW OF EL -CAMINO REAL AREA RECOMMENDED ACTION Pleasure of the Council. BACKGROUND AND DISCUSSION At the August 21, 1989 City Council meeting, complaints about the condition of properties in the downtown area were received. In response, the City Council directed staff to conduct a comprehensive field inspection report of the area north of Main Street. A field inspection was conducted on Tuesday, August 29th by members of the Building, and Planning Divisions of the Community Development Department a Public Works Department inspector and County Fire and Health Departments. Each site within the study area was inspected and a list of code violations was compiled. A map of the study area and a list of violations found at the time of -inspection are attached to this report for review. The field inspection team conducted a visual check of each site from the public street and only entered properties and. buildings where numerous violations were evident and where access was attainable. The findings show that some properties contain numerous violations ranging from health and safety violations to storage of abandoned vehicles. While some of these violations may have been in place for quite some time, Code Enforcement staff generally operate on a reactionary basis in response to complaints only, rather than proactive. review areas for potential violations (exception is the City's Neighborhood Improvement Task Force). The response to complaint method has been used due to current code enforcement case load and the need that there would be for permanent enforcement staff if it -was the City's desire to implement a proactive enforcement program. In reviewing results of the requested field inspections, there are two alternatives available to the Council. One alternative is to direct staff to initiate code enforcement action by contacffng all property owners.. and tenants of the properties and requesting their cooperation in attaining compliance with Ci ty Code requirements. If no action is taken by the property owner or tenant to correct the violations,, formal action would be taken in the form of public nuisance abatement or other appropriate action. The stgEand alternative is to contact the original complaintant(s) to respond to their sfic concerns and follow up on those specific properties. The same code enforcement procedures would be used as in alternative number 1 above. While uniform maintenance of properties is close to impossible, removal of the code violations found during the recent study could enhance the visual appearance of the area and encourage economic development. This information is listed in a uniform manner as follows: 1. Site Number: Each site which contains code violations is listed in numerical order. This number refers to the corresponding parcel shown on the study area map.. Those sites without a number were not found to be in violation at the time of inspection. 2. Address: Address of parcel as shown on official city records. 3. Assessor's Parcel Number (AP#): refers to the official parcel number assigned y the Orange County Assessor. 4. Owner of Record: The name and address of the owner as listed i n the 1989-90 Assessors Parcel Rolls. 5. Present Use on Property - Current user or tenant. 6. Condition of Property - Overall general condition of property. 7. List of Violations: A listing of all violations found on the property is provided by inspecting division, i.e. Community Development, Fire or Health. TCC 9297 General Regulations - Unpaved parking lot area. TCC 5501 Public Nuisance - Parking lot area has various nuisance violations including debris, storage of equipment, possible abandoned vehicles and two camper units stored in rear. Camper units may be inhabited and puddle of urine and other residential debris was scattered in the vicinity. TCC 4115 Health - Health code violations in men's restroom area, debris, standing water and ventilation problems. Fire Department - UFC 85.106 - Discontinue utilizing electrical extension cords in place of fixed wiring. UFC 85.104 - Correct electrical hazard, remove open electrical lighting sockets from low ceiling area.
