CREATING THE TUSTIN-SANTA ANA TRANSPORTATION SYSTEM IMPROVEMENT

RECOMMENDATION
It is recommended that the City Council either:
1. Approve a Joint Powers Agreement if the City Attorney and staff reaches
agreement with Santa Ana; or
2. Continute the matter until October 16, 1989.
BACKGROUND
Per results of recent meetings between the cities of Tustin and Santa Ana related to
Tustin concerns about the impacts of the Birtcher Xerox Centre project, both cities
have conceptually agreed to enter into a Joint Powers Agreement to develop and
maintain a program for transportation sys•�em improvements within certain portions of
each City. The agreement would also design a mechanism for establishing, determining
and controlling the expenditure of development fee revenues to be used for improving
vehicular traffic and adverse traffic impacts caused by development within portions
of each city.
Each city has exchanged their own drafts for the subject Agreement, and the City
Attorney's office is currently reviewing a revised draft of the document in an
attempt to reach agreement on certain major issues with Santa Ana. While it is our
desire to do everything possible to reach agreement by October 2nd, Santa Ana staff
have indicated that if major issues have been resolved and each City is close to
agreement on the document by October 2nd, they will continue their City Council's
scheduled action on the Birtcher-Xerox project until October 16, 1989. A
representative from the City Attorney's will be present at the Santa Ana City Council
meeting to ensure that Tustin concerns, if needed, are placed on the record-.
In the meantime, if concurrence on the Draft Agreement can be reached by September
29th, the Tustin City Council will be transmitted a copy of the Agreement for their
consideration on October 2 1989 under separate cover.
