APPEAL OF PLANNING COMMISSION APPROVAL OF AN AMENDMENT TO CONDITIONAL USE PERMIT NO. 88-15 (TUSTIN MARKET PLACE) The Planning Commission originally approved Conditional Use Permit No. 88-15 in July of 1988, establishing a Master Sign Program for the Tustin Market Place. Recommendation: Adopt the following Resolution No. 89-156, upholding the Planning Commission's action amending Conditional Use Permit No. 88-15 as recommended by the Community Development Department: RESOLUTION NO. 89-156 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, UPHOLDING THE PLANNING COMMISSION'S APPROVAL OF ANAMENDMENT TO CONDITIONAL USE PERMIT 88-15, AMENDING THE MASTER SIGN PROGRAM FOR THE TUSTIN MARKET PLACE 2. APPEAL OF PLANNING COMMISSION ACTION, VARIANCE 89-09 (DYNACHEM) A representative from Morton Thiokol, Inc., Dynachem Division, has requested that the appeal hearing be continued a second time to the November 6, 1989 City Council meeting. Recommendation: Continue the Public Hearing on the appeal of Variance 89-09 until the November 6, 1989 City Council meeting as recommended by the Community Development Department. CITY COUNCIL AGENDA PAGE 1 OCTOBER 16, 1989 APPEAL OF PLANNING COMMISSION DECISION, VARIANCE 89-10 (13911 CARROLL ~--'- MIMI'S PLAZA) On August zS, 1989, the Planning Commission adopted Resolution No. 2669 conditionally approving a center identification monument sign and denying all other aspects of the variance request for a proposed sign program for Mimi's Plaza. The applicant has appealed the Planning Commission's decision relating to the Seventeenth Street monument sign and the freeway signs. Recommendation: Uphold the Planning Commission action to deny the location and size of the proposed monument sign and tenant identification wall signs by adoption of the following Resolution No. 89<-157 as recommended by the Community Development Department: RESOLUTION NO. 89-157 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, UPHOLDING THE PLANNING COMMISSION'S ACTION TO DENY A PORTION OF VARIANCE 89-10, A REQUEST TO AUTHORIZE (A) TENANT IDENTIFICATION MONUMENT SIGN TWO FEET FROM FRONT PROPERTY LINE; (B) OFF-PREMISE WALL SIGNS; AND (C) REAR WALL SIGNS TO BE 75 SQUARE FEET IN SIZE, LOCATED AT 13911 CARROLL WAY VI. (Roll call vote) OLD BUSINESS STATUS REPORT - JOHN WAYNE AIRPORT NOISE MONITORING PROGRAM (JWA), COALITION FOR ]% RESPONSIBLE AIRPORT.SOLUTION (CRAS), AIRPORT SITE COALITION (ASC) AND HELICOPTER OVERFLIGHT PROGRAM TASK FORCE (HOPTF) Update on the John Wayne Airport Noise Monitoring Program (JWA), Coalition for a Responsible Airport Solution (CRAS), Airport Site Coalition (ASC) and Helicopter Overflight Program Task Force (HOPTF) . Recommendation: Receive and file subject report as recommended by the Community Development Department. CITY COUNCIL AGENDA PAGE 4 OCTOBER 16, 1989 APPEAL OF PLANNING COMMISSION ACTION, CONDITIONAL USE PERMIT 89-25 ANt ~ESIGN REVIEW 88-66 (CARW~-~ AT 240 EAST FIRST STREET) On October 9, 1989, the Planning commission reviewed the proposed site modifications and forwarded a list of potential conditions of approval (contained in Exhibit A) for City Council consideration as requested. Recommendation by Community Development Department: 1. certify the final Negative Declaration for the project as adequate by adoption of the following Resolution No. 89-159: REsoLUTION NO. 89-159 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR CONDITIONAL USE PERMIT 89-25 AND DESIGN REVIEW 88-66, INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT 2. Adopt the following Resolution No. 89-139 conditionally approving Conditional Use Permit 89-25: RESOLUTION NO. 89-139 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 89-25 AUTHORIZING ESTABLISHMENT OF A FULL SERVICE CARWASH LOCATED AT 240 E. FIRST STREET 3. JOINT POWERS AGREEMENT-BETWEEN THE CITY OF SANTA ANA AND TUSTIN CREATING'THE TUSTIN-SANTA ANA TRANSPORTATION SYSTEM IMPROVEMENT AUTHORITY , The City Council at a meeting on October 2, 1989, continued discussion on this matter pending concurrence by each City on the proposed Agreement. Recommendation by the Community Development Department: 1.. Approve a Joint Powers Agreement if the City Attorney and staff reaches agreement with Santa Ana; or 2. Continue the matter. At their meeting of September 5, 1989, the City Council discussed the potential abandonment/vacation of a public alley located southerly of Linda Lane, easterly of Yorba Street and westerly of Rosalind Drive. Recommendation: Subject alley remain as a public facility which. would require no action by the City Council as recommended by the Public Works Department/Engineering Division. XI. NEW BUSINESS 1. SPECIAL DISTRICT REPRESENTATIVE ON LAFCO (LOCAL AGENCY FORMATION COMMISSION OF ORANGE COUNTY) The Executive Director of LAFCO has recommended that two independent special district representatives be allowed a seat on I~AFCO. CITY COUNCIL AGENDA PAGE 5 OCTOBER 16, 1989 Recommendation: Officially oppose LAFCO appointment of Special District representatives as recommended by the Community Developm~ Department. 2. STATUS OF NOISE COMPLAINT AT 621 W. SIXTH STREET #A In response to a Councilmember inquiry, staff has prepared a summary of complaints and follow-up action taken to date on the subject property. Recommendation: Receive and file subject report as recommended by the Community Development Department. 3. PROPOSED PROBLEM RESOLUTION COMMITTEE Staff has been researching subject proposal submitted by Mr. Berklee Maughan. Recommendation: Continue until the staff and Mr. Maughan have had an opportunity to discuss the alternatives as recommended by the City Manager. 4. APPEAL OF PLANNING COMMISSION APPROVAL OF SLOPE WARRANTY PROGRAM On September 25, 1989, the Planning Commission reviewed and approved, a Slope Warranty Program. A letter from Foothill Community Builders appealing the Planning Commission's decision was received on September 27, 1989. Recommendation: Pleasure of the City Council. 5. PROJECTED WATER DEBT SERVICE ~UND CASH FLOW During Budget Workshops, the City Council directed staff to review the Water Debt Service Fund's cash flow needs and submit to the Council alternatives for repayment'of amounts due to the General Fund of approximately $413,000. Recommendation: Pleasure of the City Council. 6. REQUEST FOR WAIVER OF STREET DEDICATION - IRVINE BOULEVARD Chevron USA, Inc. has requested a waiver of the required street dedication along Irvine Boulevard and Newport Avenue at the northeasterly corner of the intersection with respect to the proposed alterations of. the Chevron site. Recommendation: Deny the request by Chevron USA, Inc. for waiver of street dedication along Irvine Boulevard and Newport Avenue adjacent to their development at the northeasterly corner of the intersection as recommended by the Public Works Department/Engineering Division. 7. TUSTIN RANCH ROAD EXTENSION BETWEEN WALNUT AVENUE AND EDINGER AVENUE In August of 1988, the City Council authorized the preparation of a project design report for the extension of Tustin Ranch Road between Walnut Avenue and Edinger Avenue, a distance of approximately one-half mile. CITY COUNCIL AGENDA PAGE 6 OCTOBER 16, 1989 Recommendation by the Public Works Department/Engineering Division: 1. Rece~ _ and file Tustin Ranch Ru ~ Project Design Report. 2. Authorize staff to solicit proposals for final design services, plan preparation, and preparation 0f environmental document based on Alternative I. 3. Authorize commencement of negotiations with the Marine Corps for approximately 12.3 acres of right-of-way acquisition. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - SEPTEMBER 11, 1989 Ail actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of September 11, 1989. 2. COMMUNITY CABLEVISION COMPANY RATE INCREASE As a matter of courtesy, the General Manager for Community Cablevision Co. has written a letter advising the city of the company's intent to increase cable rates effective October 6, 1989. The letter was not received by the City until October 3, 1989. Recommendation: Receive and file subject report as recommended by the Public Works Departmen%/Administrative Division. 3. SEVENTEENTH STREET MEDIAN ISLAND LANDSCAPING The City Council, at their meeting of October 2, 1989, requested an update and schedule on the placement of median island landscaping along Seventeenth Street between Yorba Street (north) and Prospect Avenue (south). Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 4. GAS POWERED LEAF BLOWERS Per City. Council direction, .staff is researching the regulation of gas powered leaf blower usage. Recommendation: Receive and file subject report as recommended by the Community Development Department. 5. NARCOTICS ACTIVITY - CARFAX DRIVE A resident expressed a concern regarding narcotic activity in the vicinity of Carfax Drive at the October 2, 1989 City Council meeting. VANDENBERG LANE WATER WELL STATUS REPORT The City lncil at their meeting o utober 1, 1989, requested an update un the status of the Vandenb=rg Lane water well project. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 7. STATUS OF LANDSCAPING - 235 W. MAIN STREET At their meeting of October 1, 1989, the City Council requested an update on the status of landscaping/beautification of the Prospect Avenue frontage of the water plant facility located at 235 W. Main Street. Recommendation: Receive and file subject report as recommended ~ ~e ~ Works Department/Engineering Division. 8. INVESTMENT SCHEDULE AS OF SEPTEMBER 30, 1989 Investment Schedule with maturities, 12 months or less. Recommendation: Receive and file subject report as recommended by the Finance Department. XIII.
