ENVIRONMENTAL QUALITY ACT.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No'. 89-156, upholding the
Planning Commission's action amending Conditional Use Permit 88-15.
BACKGROUND
The Planning Commission originally approved Conditional Use Permit 88-15 in July of
1988, establishing a Master Sign Program for the Tustin Market Place. That approval
permitted the use of the purple accent color as a background color for project
identification signage in the following areas: a horizontal freeway sign, four
monolith signs {at either end of E1 Camino Real), tenant identification signs along
the freeway, auto directory signs on E1 Camino Real and also the low screen wall
along Jamboree Road. Shortly thereafter, the horizontal freeway sign was installed
with the purple background color and eight foot tall white letters. Subsequent
response to the color from the community prompted the Irvine Company to remove the
letters and paint over the purple with the terra cotta color used on buildings.
On July 26, 1989, the applicant submitted an application requesting a number of
amendments to the Master Sign Program, including the color for project identification
signage.

At their regular meeting of September 11, 1989, the Planning Commission adopted
Resolution No. 2657, (copy attached) approving an amendment to Conditional Use Permit
88-15, which permitted the use of a subdued purple on projecl~ identification signage.
On September 18th, the Planning Commission's action was appealed. A public hearing
notice for the appeal of an amendment to Conditional Use Permit 88-15 was published
in the Tustin News. All property owners within 300 feet of the subject property were
notified 'bY' mail pursuant to state law. The applicant, architect and property owner
were provided a copy of the agenda and staff report for this meeting.
DISCUSSION
The application to amend .Conditional Use Permit 88-15 originally sought approval of a
second color combination for project identification signage, utilizing a medium tan
color as a background and purple letters. This second combination was proposed to be
an option to the approved color combination of purple background with white letters.
At their ~egular meeting on August 14th, the .Planning Commission expressed concerns
about the tan/purple color combination, citing poor color contrast and introduction
of too many colors around the perimeter of the project. The CommiSsion directed the
applicant to explore additional alternatives.
After reviewing numerous alternative color combinations, including a number of
colors not contained in the original approved color palette for the project, the
applicant proposed to replace the approved purple background color with a more
subdued purple with letters to be scaled down but to remain in white. The subdued
purple is proposed to be used only on the freeway signs and the monoliths {at
Jamboree Road and Myford Road); the low screen wall along Jamboree would remain terra
cotta. The applicant has further clarified that the subdued purple would be used on
signage only, the original approved purple on the project color palette would
continue to be used as an accent color on the buildings.
As noted earlier, the Planning Commission reviewed'this proposal at thei~r regular
meeting on September 11th. At that time, the Commission concurred with the applicant-
that using a color combination not from the approved palette would add too many
colors to the project. Consequently, the Commission approved the Use of the subdued
purple, subject to the following condition: "At the conclusion of the one year time
period..., the Planning Commission will review the color of project signage and may
request modifications to the approved color".
This condition would allow the City and applicant the opportunity to evaluate the
color through a full year of seasons, as well as allowing completion of the freeway
on-ramp and perimeter landscaping.

A sample of the proposed purple has been painted on a board along with the approved
purple and placed on the site for the Council's review in natural light conditions.
The board is located where the low wall along Jamboree meets the eight foot wall that
curves along the I-5 freeway, facing the east side of the Stor building {visible from
the parking lot).
CONCLUSION
The Planning Commission has concluded that the use of the subdued purple as a
background color for project identification signage (including white letters) is
consistent with the intent of the East Tustin Specific Plan and the City's Sign
Code. It is therefore recommended that the City Council uphold the Planning
Commission's approval of an amendment to Conditional Use Permit 88-15, subject to the
findings and conditions of Resolution No. 89-156.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TU.STI.N, CALIFORNIA, - APPROVING AN.-. AMENDMENT TO
CONDITIONAL USE PERMIT 88-15, AMENDING THE MASTER SIGN
PROGRAM FOR THE TUSTIN MARKET PLACE.
The Planning Commission of the City of Tustin does hereby resolve as
follows'
I. The Planning Commission finds and determines as follows'
A. A proper application (Amendme,ot to CUP 88-15) was filed by
.... Donahue Schriber, repr-esenting the Irvine'-' Company, requeSt'i'ng
approval of an amendment to the Master Sign Program for the
Tustin Market Place.
B. A public hearing was duly called, noticed and held on said
application on August 14, August 28, 1989 and September 11,
1989.
C. Pursuant to Section 9291 of the Tustin Municipal Code, the
Commission finds that the proposed amendments to the Master Sign
Pro§ram will not be detrimental-, to the heal,th, safety, morals,
comfort, general welfare of the persons working or residing in
the neighborhood nor will it be injurious or detrimental to
property and improvements in the area. The Commission further
finds that the amended Master Sign Program will provide for
signs that are compatible with, and complimentary to the
architectural design and treatments of the Tustin Market Place.
D. The Planning-Commission finds that the location of fast food
restaurants in a 77± acre shopping center is a unique condition
that is not found elsewhere in the City and that freeway signage
for..the four such restaurants -in the Tustin Market Place is
therefore justified.
II. The Planning Commission conditionally approves an amendment to
Conditional Use Permit 88-15, amending the Master Sign Program for
the Tustin Market Place subject to the following conditions'
A. The Master Sign Program shall be amended as proposed in the
"Tustin Market Place Tenant Signing Criteria' Phase II", dated
August 25, 1989, except as modified herein or as modified by the
Director of Community Development pursuant to this resolution.

Under Section 1.6 (Tenant areas) Type II, item #3 shall be
deleted. ("One sign band identification per bay").
D. A maximum of 10 freeway signs' shall be permitted, advertising
the names of major tenants and fast food restaurants as
submitted per model with a maximum of 4 fast food restaurants.
The Planning Commission finds that the location of fast food
restaurants in a 77± acre shopping center is a unique condition
that is not found elsewhere in the City and that freeway si gnage
for the four such restaurants in the Tusttn Market Place is
therefore justified.
Section 1.5.G, Multi-Tenant Monument Signs; shall be modified to
limit the number of multi-tenant monument signs to two (2)
signs·
F. Lettering on existing and future Freeway Signs shall be revised
in accordance with Exhibit 'B' of. the amended Sign Program dated
August 25, 1989 and included with the Planning Commission staff
report dated September 11, 1989 as Attachment III.

Section 1.5.A. shall be revised to restrict tower Signs on the
Phase II retail building to the full height sides of the towers
only, no signs shal be permited above a roof.

Section 1.5.C., Building Fascia Signs (Exhibit C); shall be
amended to limit such signs to a maximum of two (2) tenants.
The design of the fascia shall reflect that shown at the
September 11, 1989 Planning Commission meeting and shall be
flexible enough to accommodate the two foot high aluminum sign
band should the need arise in the future. Revised structural
plans shall be submitted for review and approval by. the
Community Development Department prior to field alterations. It
shall be noted that no advertising, shall be permitted, only
business identification.
Section" 1';5-.'C.1';- Bultdlng Fascia Signs;' North Entertainment
Village, Building A (Exhibit C), shall be revised to restrict
the fascia signs on Building 'A' in the theatre/retail facility
of the North Village to tenants having access or frontage on the
Village Center Court only·

shall be used for all tenants in all buildings in the .North

K. Section 1.5.H., Theatre Marquee (Exhibit H) shall be revised to
limit the allowed square footage of the theatre marquee sign to
200 .sq.uare feet, including the na~e of the theatre operator.

The theatre marquee shall be integrated into Building 'B' so as
to be flush mounted (or as clos~ to flush mounted as possible).
The design of said marquee shall incorporate color bands to
match the color of the building, separating each marquee.
M. All unamended provisions of the Master Sign Program of July 11,
1988, not herein amended per this Resolution, shall remain in
full force and effect.
N. All applicable conditions contained in Resolution No. 2516,
incorporated herein by reference and not otherwise amended by
this Resolution, shall remain in full force and effect.

Th~ 'applicant shall submit ~ revised Sign Program which includes
all corrections made by this Resolution for review and approval
by the Community Development Department prior to issuance of' any
sign permits affected by this Resolution. The revised Sign
Program shall incorporate all sign criteria for tenant and
project identification, for a-Ti-Phases of the Market Place, into
one comprehensive document.
P. The'revised color combination for proj'ect signage, consisting of
the subdued purple background with white letters, shall be used
on project signage only, no walls (i.e. all perimeter and/or
screen walls). At the conclusion of the one year time period
from the adoption date of this Resolution,, the Planning
Commission will review the color of poject signage and may
request modifications to the approved col or.
PASSED AND ADOPTED by the Planning Commission of the City of Tustin at a
regular meeting held on the 11th day of Septemb , 1989. ,

A RESOLUTION OF THE CITY' COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, UPHOLDING THE PLANNING
COMMISSION'S APPROVAL OF AN AMENDMENT TO CONDITIONAL
USE PERMIT 88-15, AMENDING THE MASTER SIGN PROGRAM FOR
THE TUSTIN MARKET PLACE.
The City Council of the City of Tusttn does hereby resolve as follows'
I. The City Council finds and determines as follows-
A. A proper application (Amendment to CUP 88-15) was filed by
Donahue Schriber, representing the Irvine Company, requesting
approval of an amendment to the Master Sign Program for the
Tustln Market Place.
B. A public hearing was duly called, noticed and held on said
application on August 14, August 28, and September 11, 1989.
C. At their regular meeting on September 11, 1989, the Planning
Commission adopted Resolution No. 2657 conditionally approving
an amendment to Conditional Use Permit 88-15. The City
Council, at their regular meeting on September 18th,
subsequently appealed the Planning Commission's decision.
D. Pursuant to Section 9291 of the Tustln Municipal Code, the
Council finds that the proposed amendments to the Master Sign
Program will not be detrimental to the health, safety, morals,
comfort, general welfare of the persons working or residing in
the neighborhood nor will it be injurious or detrimental to
property and improvements in the area. The Council further
finds that the amended Master Sign Program will provide for
signs that are compatible with, and complimentary to the
architectural design and treatments of the Tustin Market Place.
E. The subject amendment to Conditional Use Permit has been
determined to be Categorically Exempt pursuant to the provisions
of Section 13511(a) (Class 11) of the California Environmental
Quality Act.

II.
The City Council hereby upholds the Planning Co~mission's approval of
an amendment to Conditional Use Permit 88-15, amending the Master
Sign Program for the Tustin Market Place, including a revised color
combination for project identification signage consisting of a
subdued purple background with white letters, subject to the
conditions contained in Planning Commission Resolution No. 2657,
incorporated herein by reference.
