NO ADDITIONAL DOCUMENTATION IS REQUIRED. 1) AUTHORIZATION TO CREATE 115 NUMBERED AND 17 LETTERED LOTS FOR SINGLE FAMILY RESIDENTIAL PURPOSES; 2) APPROVAL OF SITE PLAN AND ARCHITECTURAL DESIGN OF THE PROPOSED PROJECT. 3) APPROVAL OF HILLSIDE REVIEW NO. 89-02 RECOFI4ENDATION It is recommended that the City Council take the following actions: 1. Approve Environmental Determination for the project by adoption of Resolution No. 89-150. · · . Approve Hillside Review No. 89-02 by adoption of Resolution No. 89-151. Approve Design Review 89-08 by adoption of Resolution No. 89-153. Approve Vesting Tentative Tract Map 13902 by adoption of Resolution No. 89-152. City Counc11 Report October 16, 1989 Tentative Tract 13902 Page t~o BACKGROUND The applicant proposes to develop a 115 single family detached units project on a 27.06 acre site currently described as Lots 24, 25, '00' 'UU', and 'VV' of sector level Tract 12870 (Phase III). Portions of this tract are in the East Tustin Hillside District. Located in Sector 7 of the East Tustin Specific Plan, the proposed project is bordered by the Tustin Ranch Golf Course on the east and south, Tustin Ranch Road on the northeast, Rawlings Way on the southeast and a future community park to the north. Other existing and anticipated development in the vicinity of the project include a 170 unit apartment development and a private park site to the southeast across Rawlings Way, a future public park to the north and the Tustin Ranch Golf Course to the east and south. Prior to development as proposed, the City Council must approve a Hillside and Design Review or'the project pursuant to provisions of the East Tustin Specific Plan. The map would create 115 numbered lots and 17 lettered lots (lettered lots are for landscaping purposes). The Planning Commission reviewed this project on September 25, 1989 and recommended Q. pproval l of the project s.ubject to the conditions contained in the attached resolutions provided as exhibits to this report. PROJECT DESCRIPTION/SITE PLAN Submitted development plans for the project propose 115 single family, two story homes on a 27.06 acre parcel. The project site is in the Medium Density Residential category which permits a maximum of 18 dwelling units per acre. Since the project is proposed for single family detached homes it is required to conform with the Medium Low Residential District Development Standards. Actual density proposed for the project is 4.28 units per acre. The proposed dwellings range from 3,000 to 3,400 square feet and four to five bedrooms per unit. There is one ingress/egress point along Rawlings Way for the project. The project includes one main gated vehicular entry with a 22 foot wide entrance and 24 foot wide exit per the public Works Department requirements. The circulation system consists of private streets and a primary branch street that runs lengthwise through the project, private streets branch from the main feeder. All streets are 36 feet in width which allows for parking on each side with two travel lanes. In addition, a total of 112 on street parking spaces are provided. A total of 457 parking., spaces are provided which includes 112 on- street parking spaces. Each unit is equipped with a three car garage and parking may be accommodated in driveways which are a minimum of 19 feet long. Community Development Department Cit. y Council Report October 16, 1989 Tentative Tract 13902 Page three The proposed project, wi th recommended conditions, will meet all adopted requirements of the East Tustin Specific plan as well as fire, police, and engineering. A statistical summary of the project is attached to this staff report for reference. ARCH XTECTURE/LANDSCAPING The proposed architectural design for the project is of an Early California character. The two-story buildings are proposed with terra-cotta spanish tile roof treatments and off-white stucco siding. Mass is broken up with covered balconies, patios, and various trim treatments. Stained wood multi-paned windows and stucco surrounds characterize the detail of the architecture. Each of the four unit styles has three different exterior architectural treatments. Each with a varying from spanish missien to monterey styles. The applicant has submitted a conceptual landscaping plan for the lettered lots which are common areas for streetscape and en.try areas. HoweVer, the plan is only illustrative with the actual quanti~ies, species and location of landscaping to be determined at plan check. In addition, complete irrigation plans will be submitted at plan check. The proposed landscaping consists of a combination of trees, shrubs, vines and ground cover enhancing the project's streets, common areas and perimeter. The proposed plant materials include: Eucalyptus trees (spotted and desert gum varieties) along the loop collector road, magnolia, and ficus trees at the project entry, brisbane and victorian box pines as the neighborhood street trees. Various shrubs, vines and ground covers have been proposed throughout the project. A perimeter wall consistent with the sector theme wall separates the project from the Park, Tustin Ranch Road and Rawlings Way. A combination block and wrought iron fence is proposed along the Golf Course edge. Decorative paving is proposed for the entry area. Pedestrian sidewalks have been included' throughout the project with (5) five foot walks adjacent to the street curbs. ISSUE S There are no outstanding issues associated with this project. Community Development Department City Council Report October 16, 1989 Tentative Tract 13902 Page four CONCLUSION _ mi Given the analysis conducted by the Planning Commission and consideration of comments from other agencies and the public, it is concluded that the proposed project meets the requirements of the East Tustin Specific Plan, the Subdivision Map Act as adopted and the California Environmental Quality Act. With the inclusion of conditions of approval listed in Resolutions No. 2677, 2678, 2679 and 2680 adopted by the Planning Commission on September 25th, it is recommended that the City Council approve Vesting Tentative Tract Map 13902, Hillside Review No. 89-02 and Design Review 89-08. The East Tustin Specific Plan final Environmental Impact Report (85-2), previously certified on March 17, 1986 as. modified by subsequently adopted supplements and addenda, was considered prior to approval of the subject projects. The Planning Commission hereby finds: these projects are within '~the scope of the East Tustin Specific Plan previously approved; the effects of this project, · related to grading., hillside grading and slopes, drainage, circulation, public services and utilities, were examined in the Program EIR. All feasible mitigation measures~ and alternatives developed in the Program EIR are incorporated into these projects. The Final EIR, as modified by all subsequently adopted supplements and addenda, is therefore determined to be adequate to serve as a Program EIR for this project and satisfies all requirements of CEQA. .. Applicable mitigation measures identified in the Final EIR have been incorporated into this project which mitigate any potential significant environmental effects thereof including hillside grading measures. Walls and fences which do not also serve as perimeter walls for project shall be consistent with main building treatments. A protective rail or guard must be installed on top of retaining walls where there is more than a thirty (30) inch drop. (1) 3.8 Submit mailbox architectural detail indicating color and exterior treatment (4) (number of coats of paint, wear. and durability features)for review and approval of Director of Community Development. LANDSCAPING, GROUNDS AND HARDSCAPE ELEI~NTS ii i i ii (7) 4.1 Submit at plan check complete detailed landscaping and irrigation plans for all landscaping areas for all lettered lots to be maintained by the Homeowner's Association and the model complex 'which are consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Provide summary table applying indexing identification to plant materials in their actual location. The plan and table must list botantical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. Show planting and berming details, soil preparation, staking, etc. The irrigation plan shall show location and control of backflow prevention devices, pipe size, sprinkler type, spacing and coverage. Details for all equipment must be provided. Show all property lines on the landscaping and irrigation plan, public right-of-way areas, sidewalk widths, parkway areas, and wall locations. The Department of Community Development may request minor substitutions of ,plant materials or request additional sizing or quantity materials during-plan check. Note on landscaping plan that coverage of landscaping irri'gati'on materials is subject to the review and'approval of the Director of Community Development. A combination of planting materials must be used, ground cover on large areas alone is not acceptable. B. Ce Provide a minimum of one 15 gallon size tree for every 30 feet of property line on the property perimeter a'nd five 5 gallon shrubs. Shrubs 'sh~il be a minimum of 5 gallon size and shall be spaced a minimum of 5 feet on center when intended as screen planning. D. Ground cover shall be planted between 8 to 12 inches on center. E. All plant materials shall be installed in a healthy vigorous condition typical to the species and landscaping must be maintained in a neat and healthy condit~ion, th~s w.ill include but not be limited to trimming, mowing, weeding, removal of litter, fertilizing, regular watering, or replacement of diseased or dead plants. Irrigation timing and/or water regulation devices shall be installed to. protect against overwatering, especially in sloped areas. Hi Earth mounding is essential and must be provided to applicable heights whenever it is possible in conjunction with the submitted landscaping plan. Earth mounding should be particularly provided along Keller Drive and Robinson Drive for buffering across from a proposed school and active community park site. I. Landscape adjacent to the right-of-way shall be coordinated with pJrkway landscaping. Perimeter walls should be treated with vines in order to relieve large expanses of walls by adding greenery and color. Vines should be informally grouped with training devices installed. J. All landscaped lots shall be graded with an undulating surface to provide a natural appearence consistent with the Hillside Grading Requirements. Exhibit A -- ~lut~'on No. 2678 ~e five (1} 4.3 Screening adjacent to roadways, whenever possible, shall compliment the {7) architecture, color and construction material of primary buildings on the (4) site. (1) 4.4 The use of decorative paving techniques in the project entry area such as (7) stamped and colored concrete is encouraged, particularly for (4) sidewalks/pedestrian areas along private streets and in paseos. (1) 4.5 Provide details, colors, and materials for alol exterior walkways, stairs and (7) walls. Design interior walkways to create a reinforced pedestrian corridor (4) with accessory landscaping treatment. (1) 4.6 All walls, fences or landscaping adjacent to streets should be designed to {7) provide adequate sight distance for vehicles exiting the tract via the private (4) streets. (1) 4.7 The entry should'be a focal point. In addition to larger tree treatments this (7) area should be provided with a v~riety of color and treatment of landscaping ~-~ as well as a incorporation of special decorative signage or pavement treatment (i.e., walls, gates, lighting, etc.). ~.. (1) 4.8 A complete, detailed project sign program including design, locati'on, sizes, (4) colors, and materials, shall be submitted for review and approval by the Department of Community Development. . 4.9 Indicate lighting scheme for project, note locations of all exterior lights and types of fixtures, lights to be installed on buildings shall be a 'decorative design. No light's shall be permitted which may create any gl are or have a negative impact on adjoining properties. The location and types of lighting shall be subject to the approval of the Director of Con~unity Development. If resources are found, work shall stop in the affected area, the paleontologist/archeologist shall be notified and all resources shall be excavated or preserved as deemed appropriate or as recommended by the pal eontologist/archealologist subject to review and approval by the Department of Public Works and Community Development. All "finds" shall be reported immediately to the Department of Community Development. The paleontologist/archealogist shall attend the pregrade construction meeting to ensure that this condition and necessary procedures in the event of a "find" are explained. 8. Preparation of a sedimentation and erosion control plan for all construction work related to the subject Tract including a .method of control to prevent dust and windblown earth problems. 9. A final acoustical analysis report describing the acoustical design features of the structures required to satisfy the exterior and interior noise standards shall be submitted to the Tustin Community Development Department for approval along with satisfactory evidence which indicates that the sound attenuation measures specified in the approved acoustical report(s) have been incorporated into the design of the project-. The acoustical analysis shall be prepared by an expert or authority in the field of acoustics. All residential lots and dwellings shall be sound attenuated against present and projected noises, which shall be the sum of all noise impacting the project, so as not to exceed an exterior standard 65 dba CNEL in outdoor living areas and an interior standard of 45 dBa CNEL in all habitable rooms is required. Evidence prepared under the supervision of an acoustical consultant that these standards will be satisfied in a , .manner consistent with appli, cable zo.ning regulations',Shall be, provided. B. Due to the project's location under the Browning Corridor, 'a complete noise study shall be conducted and submitted to the City for review. In addition to Commu'nity Noise Equivalency Levels (CNEL) said study provides information on single event noise measurements as generated by helicopter flyovers for information purposes only. (1) 6.2 Prior to issuance of any Certificates of Use or Occupancy, field testing in (3) accordance with the Title 25 regulations shall be required by the Building Official to verify compliance with STC and IIC design standards. All planted areas other than lawns shall be free of weeds, dead vegetation and debris. All trees and shrubs shall be trimmed so they do not ~mpede pedestrian traffic along the walkways. Trees shall be pruned so thQy do not intrude into neighboring property and shall be maintained so they do not have droppings or create other nuisances to neighboring property. All trees shall also be root pruned to eliminate exposed surface roots and damage to sidewalks, driveways and st.ructures. (2) All private roadways, sidewalks and paseos shall be maintained so that they are safe for users. Homeowner's Association approval of exterior improvements requiring a building permit shall b.e obtained prior to requesting a building permit from the City of Tustin Community Development Department. All plans for exterior improvements shall conform to requirements set forth by the City and the CCR's. The City Council finds and determines as follows' A. That proper applications, Design Review No. 89-08 and Tentative Tract Map No. 13902, were fi led by Bren Osgood Company, requesting approval of a 115 single family detached unit project on a 27.06 acre site identified as Lots 24, 25, "00", "UU", and "VV" of Tract 12870. B. That a public hearing was duly called, noticed and held on said application by the Planning Commission on September 25, 1989. Ce Pursuant to Sec~lon 9291 of the Tustin Municipal Code, the Council finds the following' 1..-That establishment, maintenance, and '.operation of the use applied for will ~ot~ under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in. the neighborhood since the project design and architecture is compatible wi th existing surrounding urban area'. The project is also consistent with the East Tustin Specific Plan Regulations and Development Standards and the East Tustin Development Agreement. De 2. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. Pursuant to Section 9272 of the Tustln Municipal Code, the Council finds that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Council has considered at least the following items: 1. Height, bulk and area of building 2. Location, height and standards of exterior illumination. 9. Location and appearance of equipment located outside of an enclosed structure. 10. Physical relationship of proposed structures to existing structures in the neighborhood. 11. Appearance and design relationship of proposed structures to existing structures and possible futu?e structures in the neighborhood and public thoroughfares. ~ 12. Development Guidelines and criteria as adopted by the City Council. II. The City Council hereby conditionally approves and Design Review 89-08, authorizing construction of a 115 single family dwelling unit project subject to the conditions contained in Exhibit A to Planning Commission Resolution No. 2678.
