BACKGROUND
The applicant proposes to develop a 115 single family detached units project on
a 27.06 acre site currently described as Lots 24, 25, '00' 'UU', and 'VV' of
sector level Tract 12870 (Phase III). Portions of this tract are in the East
Tustin Hillside District.
Located in Sector 7 of the East Tustin Specific Plan, the proposed project is
bordered by the Tustin Ranch Golf Course on the east and south, Tustin Ranch
Road on the northeast, Rawlings Way on the southeast and a future community park
to the north. Other existing and anticipated development in the vicinity of the
project include a 170 unit apartment development and a private park site to the
southeast across Rawlings Way, a future public park to the north and the Tustin
Ranch Golf Course to the east and south.
Prior to development as proposed, the City Council must approve a Hillside and
Design Review or'the project pursuant to provisions of the East Tustin Specific
Plan. The map would create 115 numbered lots and 17 lettered lots (lettered
lots are for landscaping purposes). The Planning Commission reviewed this
project on September 25, 1989 and recommended Q. pproval l of the project s.ubject to
the conditions contained in the attached resolutions provided as exhibits to
this report.
PROJECT DESCRIPTION/SITE PLAN
Submitted development plans for the project propose 115 single family, two story
homes on a 27.06 acre parcel. The project site is in the Medium Density
Residential category which permits a maximum of 18 dwelling units per acre.
Since the project is proposed for single family detached homes it is required to
conform with the Medium Low Residential District Development Standards. Actual
density proposed for the project is 4.28 units per acre. The proposed dwellings
range from 3,000 to 3,400 square feet and four to five bedrooms per unit.
There is one ingress/egress point along Rawlings Way for the project. The
project includes one main gated vehicular entry with a 22 foot wide entrance and
24 foot wide exit per the public Works Department requirements. The circulation
system consists of private streets and a primary branch street that runs
lengthwise through the project, private streets branch from the main feeder.
All streets are 36 feet in width which allows for parking on each side with two
travel lanes. In addition, a total of 112 on street parking spaces are
provided. A total of 457 parking., spaces are provided which includes 112 on-
street parking spaces. Each unit is equipped with a three car garage and
parking may be accommodated in driveways which are a minimum of 19 feet long.

The proposed project, wi th recommended conditions, will meet all adopted
requirements of the East Tustin Specific plan as well as fire, police, and
engineering. A statistical summary of the project is attached to this staff
report for reference.
ARCH XTECTURE/LANDSCAPING
The proposed architectural design for the project is of an Early California
character. The two-story buildings are proposed with terra-cotta spanish tile
roof treatments and off-white stucco siding. Mass is broken up with covered
balconies, patios, and various trim treatments. Stained wood multi-paned
windows and stucco surrounds characterize the detail of the architecture. Each
of the four unit styles has three different exterior architectural treatments.
Each with a varying from spanish missien to monterey styles.
The applicant has submitted a conceptual landscaping plan for the lettered lots
which are common areas for streetscape and en.try areas. HoweVer, the plan is
only illustrative with the actual quanti~ies, species and location of
landscaping to be determined at plan check. In addition, complete irrigation
plans will be submitted at plan check.
The proposed landscaping consists of a combination of trees, shrubs, vines and
ground cover enhancing the project's streets, common areas and perimeter. The
proposed plant materials include: Eucalyptus trees (spotted and desert gum
varieties) along the loop collector road, magnolia, and ficus trees at the
project entry, brisbane and victorian box pines as the neighborhood street
trees. Various shrubs, vines and ground covers have been proposed throughout
the project.
A perimeter wall consistent with the sector theme wall separates the project
from the Park, Tustin Ranch Road and Rawlings Way. A combination block and
wrought iron fence is proposed along the Golf Course edge. Decorative paving is
proposed for the entry area. Pedestrian sidewalks have been included' throughout
the project with (5) five foot walks adjacent to the street curbs.
ISSUE S
There are no outstanding issues associated with this project.

CONCLUSION

Given the analysis conducted by the Planning Commission and consideration of
comments from other agencies and the public, it is concluded that the proposed
project meets the requirements of the East Tustin Specific Plan, the Subdivision
Map Act as adopted and the California Environmental Quality Act. With the
inclusion of conditions of approval listed in Resolutions No. 2677, 2678, 2679
and 2680 adopted by the Planning Commission on September 25th, it is recommended
that the City Council approve Vesting Tentative Tract Map 13902, Hillside Review
No. 89-02 and Design Review 89-08.

REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN (FINAL
EIR 85-2), AS MODIFIED BY SUBSEQUENTLY ADOPTED
SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO SERVE AS THE
PROGRAM EIR FOR VESTING TENTATIVE TRACT MAP 13902,
HILLSIDE REVIEW NO. 89-02 AND DESIGN REVIEW 89-08 AND
ALL FEASIBLE MITIGATION MEASURES HAVE BEEN INCORPORATED
AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT.

The Planning Commission of the City of Tustin does hereby resolve as

I. The Planning Commission 'finds and determines as follows'
A. That Vesting Tentative Tract Map 13902, Hillside Review No.
89-02 and Design. Review 89-08 respective development plans are
considered "projects" pursuant to the terms of the California
Environmental Quality Act; and

B. The projects are covered by a previously certified final
environmental impact report for the East, Tustin Specific Plan
which serves as a Program. EIR for the proposed project.
II. The East Tustin Specific Plan final Environmental Impact Report
(85-2), previously certified on March 17, 1986 as. modified by
subsequently adopted supplements and addenda, was considered prior to
approval of the subject projects. The Planning Commission hereby
finds: these projects are within '~the scope of the East Tustin
Specific Plan previously approved; the effects of this project,
· related to grading., hillside grading and slopes, drainage,
circulation, public services and utilities, were examined in the
Program EIR. All feasible mitigation measures~ and alternatives
developed in the Program EIR are incorporated into these projects.
The Final EIR, as modified by all subsequently adopted supplements
and addenda, is therefore determined to be adequate to serve as a
Program EIR for this project and satisfies all requirements of CEQA.

Applicable mitigation measures identified in the Final EIR have been
incorporated into this project which mitigate any potential
significant environmental effects thereof including hillside grading
measures. The mitigation measures are identified as Conditions on
Exhibit A, Resolution No. 2678 approving Hillside Review No. 89-02
.and Design Review 89-08 and Exhibit A of Resolution No. 267,9
recommending approval of Tentative Tract Map 13902.

GENERAL
(1) 1.1 The proposed project shall substantially conform with the submitted plans

(1) 3.4 Note on final plans that a six foot high chain linked fence shall be installed
around the site prior to building construction stages. Gated entrances shall
be permitted along the perimeter of the site for construction vehicles.

(7) 4.1 Submit at plan check complete detailed landscaping and irrigation plans for
all landscaping areas for all lettered lots to be maintained by the
Homeowner's Association and the model complex 'which are consistent with
adopted City of Tustin Landscaping and Irrigation Submittal Requirements.
Provide summary table applying indexing identification to plant materials in
their actual location. The plan and table must list botantical and common
names, sizes, spacing, actual location and quantity of the plant materials
proposed. Show planting and berming details, soil preparation, staking, etc.
The irrigation plan shall show location and control of backflow prevention
devices, pipe size, sprinkler type, spacing and coverage. Details for all
equipment must be provided. Show all property lines on the landscaping and
irrigation plan, public right-of-way areas, sidewalk widths, parkway areas,
and wall locations. The Department of Community Development may request minor
substitutions of ,plant materials or request additional sizing or quantity
materials during-plan check. Note on landscaping plan that coverage of
landscaping irri'gati'on materials is subject to the review and'approval of the
Director of Community Development.

All plant materials shall be installed in a healthy vigorous condition
typical to the species and landscaping must be maintained in a neat and
healthy condit~ion, th~s w.ill include but not be limited to trimming,
mowing, weeding, removal of litter, fertilizing, regular watering, or
replacement of diseased or dead plants. Irrigation timing and/or water
regulation devices shall be installed to. protect against overwatering,
especially in sloped areas.
Hi Earth mounding is essential and must be provided to applicable heights
whenever it is possible in conjunction with the submitted landscaping
plan. Earth mounding should be particularly provided along Keller Drive
and Robinson Drive for buffering across from a proposed school and active
community park site.
I. Landscape adjacent to the right-of-way shall be coordinated with pJrkway
landscaping. Perimeter walls should be treated with vines in order to
relieve large expanses of walls by adding greenery and color. Vines
should be informally grouped with training devices installed.
J. All landscaped lots shall be graded with an undulating surface to provide
a natural appearence consistent with the Hillside Grading Requirements.

(1} 4.3 Screening adjacent to roadways, whenever possible, shall compliment the

(1) 4.4 The use of decorative paving techniques in the project entry area such as

(4) sidewalks/pedestrian areas along private streets and in paseos.

6. A note shall be placed on the grading plan requiring community
Development Department approval of rough grading prior to final
clearance for foundations. The De. partment will inspect the site 'for
accuracy of elevations, slope gradients, etc. and may require
certification of any grading related matter.
7. Note on plans that a qualified paleontologist/archealogist, as
appropriate shall be present at a pre-grading contractor conference
to provide information about what to look for during rough grading
operations that might indicate the presence 'of paleontological or
archealogical resources. If resources are found, work shall stop in
the affected area, the paleontologist/archeologist shall be notified
and all resources shall be excavated or preserved as deemed
appropriate or as recommended by the pal eontologist/archealologist
subject to review and approval by the Department of Public Works and
Community Development. All "finds" shall be reported immediately to
the Department of Community Development. The
paleontologist/archealogist shall attend the pregrade construction
meeting to ensure that this condition and necessary procedures in
the event of a "find" are explained.
8. Preparation of a sedimentation and erosion control plan for all
construction work related to the subject Tract including a .method of
control to prevent dust and windblown earth problems.
9. Verification of compliance with Grading and Excavation Code, Grading
Manual and Hillside District Requirements including the following:

Where manufactured slope banks approach roadways at or near
right angles above the elevations of the roadway, the slope

5.1 Prior to the recordation of a final tract map, water improvement plans shall
be submitted to and approved by the Fire Chief for adequate fire protection
and financial security posted for the installation. The adequacy and
reliability of water system design, location of valves, and the distribution
of fire hydrants will be evaluated in accordance.with Insurance Services
Office suggested standards contained in the "Grading Schedule" for Municipal
Fire Protection. ' '
$.Z Prior to the issuance of any building permits for combustible construction,
evidence that .a water supply for fire protection is availabl'e shall be be
submitted to and approved by the Fire Chief. Fire hydrants shall be in place
and operational to meet required fire-flow prior to commencing construction
with combustible materials.
5.3 Prior to the issuance of any building permits, a cons.truction phasing plan
shall be submitted to and approved by the Fire Chief. The purpose of this
review is to evaluate the adequacy of emergency vehicle access for the number
of dwelling units served.
5.4 Prior to the issuance of any certificates of use and occupancy, the private
streets shall be red curbed and posted "No Parking-Fire Lane" locations
determined by the Fire .Chief as per 1985 Uniform Fire Code Section 10.207 in a
manner meting the approval of the County Fire Chief.
5.5 .The project entry gate shall be designed and equipped with devices to ensure
"compliance with all fire code requirements as determined by the' Fire Chief.
5.0 Prior to issuance of any building permits, all emergency vehicle access points
shall be designed to meet all Fire Code requirements subject to review and
approval of the Fire Chief.

features of the structures required to satisfy the exterior and interior
noise standards shall be submitted to the Tustin Community Development
Department for approval along with satisfactory evidence which indicates
that the sound attenuation measures specified in the approved acoustical
report(s) have been incorporated into the design of the project-. The
acoustical analysis shall be prepared by an expert or authority in the
field of acoustics.
All residential lots and dwellings shall be sound attenuated against
present and projected noises, which shall be the sum of all noise
impacting the project, so as not to exceed an exterior standard 65 dba
CNEL in outdoor living areas and an interior standard of 45 dBa CNEL in
all habitable rooms is required. Evidence prepared under the supervision
of an acoustical consultant that these standards will be satisfied in a
, .manner consistent with appli, cable zo.ning regulations',Shall be, provided.
B. Due to the project's location under the Browning Corridor, 'a complete
noise study shall be conducted and submitted to the City for review. In
addition to Commu'nity Noise Equivalency Levels (CNEL) said study provides
information on single event noise measurements as generated by helicopter
flyovers for information purposes only.
(1) 6.2 Prior to issuance of any Certificates of Use or Occupancy, field testing in

Official to verify compliance with STC and IIC design standards.

CCR'S
(1) ?.1 Prior to approval of the final map, all organi.zational documents for the

under control of a Homeowner's Association and Master Association,
the City shall be included as a party to the CCR's for enforcement

be obligated to enforce the CCR's.

Maintenance standards shall be provided for applicable items listed
in Section C above in CCR's. Examples of maintenance standards are

(1) All common area landscaping and private lawn areas visible from
any public way shall be properly maintained such that they are
evenly cut, evenly edged, free of bare or brown spots, free of
debris and free of weeds above the level of the lawn. All
planted areas other than lawns shall be free of weeds, dead
vegetation and debris. All trees and shrubs shall be trimmed
so they do not ~mpede pedestrian traffic along the walkways.
Trees shall be pruned so thQy do not intrude into neighboring
property and shall be maintained so they do not have droppings
or create other nuisances to neighboring property. All trees
shall also be root pruned to eliminate exposed surface roots
and damage to sidewalks, driveways and st.ructures.
(2) All private roadways, sidewalks and paseos shall be maintained
so that they are safe for users. Significant pavement cracks,
pavement distress, excessive slab settlement, abrupt vertical
variations and debris on travel ways should be removed or

(3) Common areas shall be maintained in such a manner as to avoid
the reasonable determination of a duly authorized' official of
the City that a public nuisance has been created by the absence
of adequate maintenance such as to be detrimental to public
health, safety, or general welfare, or that such a condition of
deterioration or disrepair cause harm or is materially
detrimental to property values or improvements within the
_ boundaries of the subdivision and Homeowner's Association, to
surrounding property, or to property or improvements within
three hundred (300) feet of the property may also be added as
alternative 1 anguage.
Homeowner's Association approval of exterior improvements requiring
a building permit shall b.e obtained prior to requesting a building
permit from the City of Tustin Community Development Department.
All plans for exterior improvements shall conform to requirements
set forth by the City and the CCR's.
Residents shall ' not store or park any non-motorized vehicles,
trailers or motorized veh'icles.-~at exceed 7 feet high, 7 feet wide
and 19 feet long in any parking, driveway or private street area
except for purpose of loading, unloading, making deliveries or

B. The Subdivider shall submit for review and approval of content by the
Director of Community Development, a copy of sales literature for the
residential project with the approved aircraft/helicopter noise statement
and the approved schools notification Statement, printed on it. Any
changes to the sales literature after initial City approval shall be

C. The Subdivider shall provide the City with a copy of the approved
aircraft/helicopter noise statement which shall contain a disclosure
document on aircraft notification. Said document must be signed by each
tenant/homeowner prior to occupancy of any unit. The content of the
statement shall be approved by the Director of Community Development
prior to circulation.
D. The developer shall provide the City with a schools notification
statement which shall be reviewed and approved by the Director' of
Community Development and participation by the governing school district

subsequently adopted supplements and addenda, was considered prior to
approval of the subject projects. The City Council hereby finds'
these projects are within the scope of the East Tustin Specific Plan
previously approved; the effects of this project, related to qrading,
hillside grading and slopes, drainage, circulation, public services
and utilities, were examined in the Program EiR. All feasible
mitigation measures and alternatives developed in the Program EIR are
incorporated into these projects. The Final EIR, as modified by all
subsequently adopted supplements and addenda, is therefore determined
to be adequate to serve as a Program EIR for this project and
satisfies all requirements of CEQA.
Applicable mitigation measures identified in the Final EIR have been
incorporated into this project which mitigate any potential
significant environmental effects th'ereof including hillside grading
measures. The mitigation measures are identified as Conditions on

RESOLUTION NO. 89-152
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN APPROVING VESTING TENTATIVE TRACT MAP NO.
13902
The City Council of the City of Tustin does hereby resolve as follows'
I. The Clty Council finds and determines as follows-

That Vesting Tentative Tract Map No. 13902 was submitted to the
City Council by Bren Osgood Company, for consideration.
That a public hearing was duly called, noticed and held for said
map by the Planning Commission on September 25, 1989.
C. That an Environmental Impact Report (EIR 85-2 for the East
Tustin Specific Plan) has been certified in conformance with the
requirements of California Environmental Quality Act for the
subject project area.
D. That the proposeC subdi vi si on is in conformance with the Tustin
Area General Plan, adopted East Tustin Specific Plan,
Development Agreement and Subdivision Map Act as it pertains to
the development of single.ofamily ~wellings..
E. The parkland requirement for this project was previously
dedicated wi th recordation of Tract 12870.
F. That the City has reviewed the status of the School Facilities
Agreement between. The Irvine Company and the Tustin Unified
School District, the East Tustin Specific Plan, EIR 85-2 with
subsequently adopted supplements and addenda, the impacts of
Vesting Tentative Tract Map 13902 on School District facilities,
and reviewed changes in State law, and finds and determines that
the impacts on School District facilities by approval of this
map have been adequately addressed.
G. That the site is physically suitable for the type of development
proposed.
Ho That the site is physically suitable for the proposed density of
development.

are not likely to cause substantial environmental damage or
substantially and avoidably Injure flsh or wildlife In their

public-at-large, for access through or use of the property
within the proposed subdivision.
K. That the design of the subdlvlsion or the types of Improvements
proposed are not likely to cause serious publlc health problems.

The Clty Counctl hereby approves Vesting Tentative Tract Nap No.
13902 subject to the conditions attached to Exhibit A of Planning
Commission Resolution No. 2679 with the addition of the following
condt ti on' -
Pursuant to the conditions on Tract No. 12870, as amended, no
structural building perm~tts shall be issued for this project
until Peter's Canyon Wash is completed to the satisfaction of
-the Public Works Director.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CONDITIONALLY APPROVING DESIGN REVIEW 89-08
FOR A PROJECT WITH115 SINGLE FAMILY DETACHED
DWELLINGS ON 27.06 ACRES ON LOTS 24, 25, "00", "UU",
AND "VV" OF TRACT 12870
The City Council of the City of Tustin does hereby resolve as follows'
I. The City Council finds and determines as follows'
A. That proper applications, Design Review No. 89-08 and Tentative
Tract Map No. 13902, were fi led by Bren Osgood Company,
requesting approval of a 115 single family detached unit project
on a 27.06 acre site identified as Lots 24, 25, "00", "UU", and
"VV" of Tract 12870.
B. That a public hearing was duly called, noticed and held on said
application by the Planning Commission on September 25, 1989.

Pursuant to Sec~lon 9291 of the Tustin Municipal Code, the
Council finds the following'
1..-That establishment, maintenance, and '.operation of the use
applied for will ~ot~ under the circumstances of this case,
be detrimental to the health, safety, morals, comfort or
general welfare of the persons residing or working in. the
neighborhood since the project design and architecture is
compatible wi th existing surrounding urban area'. The
project is also consistent with the East Tustin Specific
Plan Regulations and Development Standards and the East
Tustin Development Agreement.

2. That the establishment, maintenance, and operation of the
use applied for will not be injurious or detrimental to the
property and improvements in the neighborhood of the subject
property, nor to the general welfare of the City of Tustin,
and should be granted.
Pursuant to Section 9272 of the Tustln Municipal Code, the
Council finds that the location, size, architectural features
and general appearance of the proposed development will not
impair the orderly and harmonious development of the area, the
present or future development therein, or the occupancy as a
whole. In making such findings, the Council has considered at
least the following items:
1. Height, bulk and area of building
2. Setbacks and site planning.

3. Exterior materials and colors.
4. Type-and pitch of roofs.
5. Size and spacing of windows, doors and other openings.
6. Towers, chimneys, roof structures, flagpoles, radio and
television antennae.
7. Landscaping, parking area design and traffic circulation.
8. Location, height and standards of exterior illumination.
9. Location and appearance of equipment located outside of an
enclosed structure.
10. Physical relationship of proposed structures to existing
structures in the neighborhood.
11. Appearance and design relationship of proposed structures to
existing structures and possible futu?e structures in the
neighborhood and public thoroughfares. ~
12. Development Guidelines and criteria as adopted by the City
Council.
II. The City Council hereby conditionally approves and Design Review
89-08, authorizing construction of a 115 single family dwelling unit
project subject to the conditions contained in Exhibit A to Planning
Commission Resolution No. 2678.
