If this proposed Ordinance is adopted, the City's general election date would be returned to the second Tuesday of April of e.ven numbered years instead of the first Tuesday after the first Monday in November. -- Before the proposed Ordinance could be effective, it would have to be approved, by the Board of Supervisors pursuant to Government Code Section 36503.5. Once the Ordinance is effective, the City Clerk would be r'~quired to mail a notice to all registered voters informing the voters of the change in the election date, and that elected city officeholders' terms in office would be changed. The effect of the Ordinance, in addition to changing the election date, would be to decrease the terms of all members" of the City Council by approximately seven months. Huston (w/attachments) 1 ORDINANCE NO. 1032 10 11 12 13 15 16 17 18 19 2O 21 AN ORDINANCE OF' THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA REPEALING ORDINANCE NO. 980 WHICH REQUIRED THE CITY'S GENERAL MUNICIPAL ELECTION TO BE CONSOLIDATED WITH THE STATEWIDE GENERAL ELECTION HELD IN NOVEMBER OF EVEN NUMBERED YEARS, PURSUANT TO SECTION 36503.5 OF THE GOVERNMENT CODE The City Council of the City of Tustin does hereby ordain as follows: Section...1: Ordinance No. 980 is hereby repealed. Section 2: This Ordinance shall be effective upon the approval of the Board of Supervisors of the County of Orange pursuant to Government Code Section 36503.5. Section 3: The City-Clerk is directed to conduct the general municipal election on the 2nd Tuesday in April of an even numbered year, to canvass the return of the general municipal election, and to otherwise conduct t~e election in all respects pursuant to the pro%isions of Election Code Section 22800, and following, pertaining to municipal elections. Section 4: Those city officers whose terms of office would have, prior to the adoption of this Ordinance, expired on the 4th Tuesday after the day of the general municipal election in November of an even numbered year, shall instead have their terms of office expire on the Tuesday succeeding the second Tuesday in April of an even numbered year. Section 5: No term of office shall be decreased by more than twelve (12) months as a result of the adoption of this Ordinance. Section 6: The period to nominate candidates for the general municipal election shall be as set forth in Elections Code Section 22836. Section 7: Within thirty (30) days after this Ordinance becomes effective upon approval of the Board of Supervisors, the City Clerk shall cause a notice to be mailed to all registered voters informing the voters of the change in the election date, and that elected city officeholders' terms in office will be changed. 10 11 12 13 15 16 17 18 19 20 21 26 Section. ,: The general municipal election following adoption of this Ordinance and each municipal election thereafter shall be held on the date for general municipal · elections held in April of even numbered years. ELECTION FROM NOVEMBER TO APRIL i · October 16, 1989 - City Council introduces Ordinance repealing Ordinance No. 980 pursuant t.o Government Code Section 36934. · November 6, 1989 - City Council adopts Ordinance repealing Ordinance No. 980. · November 7, 1989 - City sends letter with certified copy of Ordinance repealing Ordinance No. 980 to Board of Supervisors requesting its approval of Ordinance repealing Ordinance No. 980. · November 21 or 22, 1989 - Board of Supervisors approves Ordinance repealing Ordinance No. 980. Ordinance becomes effective pursuant to Government Code Section 36503.5(a) (1). · Week of November 27, 1989 - City Clerk mails a notice pursuant to Government Code Section 36503.5(e) to all registered voters informing the voters of the change in the election date. The notice must also inform the voters that as a result in the change in the election date, elected city officeholders' terms in office will be changed· ~' · January 11, 19~0 - First day that nomination papers may be made available and also the first day that the City Clerk can publish a notice of the election pursuant to Election Code Sections 22836 and 22830, respectively. · January 25, 1990 - Last day for publication of notice of election pursuant to Election Code Seciton 22830. · February 1, 1990 - Last day for filing nomination papers pursuant to Elections Code Section 22840 unless extended pursuant to Elections Code Section 22840.5. · February 6, 1990 - Last day for filing nomination papers where nomination papers are 'not filed for an incumbent. 10. April ~0, 1990.' Election day. There are other deadlines that must be met between the date the notice of election is published and the date of election. However, presumably, these are the routine matters that must be taken care of in any municipal election and will be covered by the election calendar that is prepared by the officer or consultant who is actually assisting in conducting the e~ection.
