BOX I NEWPORT BEACH, CA 92658-8904 EAST TUSTIN SPECIFIC PLAN MINISTERIAL EXEMPTION REQUEST TO RECONFIGURE 2 LOTS IN TRACT 12763 TO CREATE 2 NEW NUMBERED LOTS RECOMMENDATION It is recommended that the City Council adopt Resolution No. 89- 163 approving Final Parcel Map 88-315. BACKGROUND At their regular meeting on June 12, 1989 the Planning Commission adopted Resolution No. 2627 recommending to the City Council approval of Tentative Parcel Map 88-315. The City Council subsequently approved Tentative Parcel Map 88-315 by adopting Resolution No. 89-78 at their regular meeting on June 19, 1989. The applicant is now requesting permission to finalize the subject Parcel Map since all applicable conditions of approval of the project have been reviewed and released by the Public Works Department. At their regular meeting on October 23, 1989, the Planning Commission adopted Resolution No. 2697, recommending to the City Council approval of Final Parcel Map 88-315. Final Parcel Map 88-315 would create 2 parcels: Parcel 1, a 10 acre development site, and; Parcel 2, a 40 acre high school site. Future development on Parcel 1 will require Planning Commission review and approval. City Council Report Final Parcel Map 88-315 November 6, 1989 Page two To establish consistency with adjacent residential projects, Parcel Map 88-315 also creates landscape easements along Irvine Boulevard, Myford Road, and Heritage Way with landscaping along Irvine Boulevard to be maintained by the Tustin Lighting and Landscape District and areas adjacent to Heritage Way and Myford Road to be maintained by the' adjacent property owner or Homeowner's Association. Resu~division of the subject property is required pursuant to an executed Letter of Understanding between the Irvine Company and the City of Tustin dated March 11, 1988, which will result in expansion of the proposed high school site to 40 acres and relocation of a proposed community park to the north of Irvine Boulevard. Parcel Map 88-315 is bounded by Myford Road On the east, Heritage Way on the south, Irvine Boulevard on the north and Tustin Ranch Road on the west. CONCLUSION Final Parcel Map 88-315 is consistent with the General Plan, Zoning and East Tustin Specific Plan and staff review has indicated that all applicable conditions of approval of Tentative Parcel Map 88- 315 have been met. . The city Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: ae That Final Parcel Map 88-315-was submitted to the Planning Commission on behalf of the Irvine Company requesting authorization to subdivide lots 7 and S of Tract 12763 as per map recorded in Book 581, pages 16.25 of Tract maps in the. office of the Orange County Recorder. Be That the Planning Commission adopted Resolution No. 2697, recommending approval of Final Parcel Map 88- 315 to the City Council at their regular meeting on October 23, 1989. Ce That the Planning Commission and City Council approved Tentative Parcel Map 88-315 on June 12th and 19th, respectively. Do That the project is a ministerial exemption from the requirements of the California Environmental Quality Act. Ee That the proposed subdivision is in conformance with the Tustin Area General Plan, Tustin Zoning Code, East Tustin Specific Plan, and State Subdivision Map Act. Fe That the site is physically suitable for the type of development proPosed. Ge That the site is physically suitable for the proposed density of development.'
