Pledge of Allegiance Moment of prayer for daughter_in. law of Councilman Humeston. Present: Doney, Sheridan, Humeston, Mack, Klingelhofer. Absent: None Also present: City Attorney Rourke, Engineer Carlsen, Planni~ Adviso~ Reinland, Building inspector Brook. At 7:35 P.M. the Hering on abandonment of portions of First and Newport was contihued to February 17th - Hearing Hearing to be re-n~ticed. Newport &First C~ Hearing opened at 7:36 P.M. on Ralphs Industries to Hearing ~- permit a zone change from C j2, R-3 and R-1 to C-2 zone Ralphs ~ on proper~y on N/W corner of 17th St. 'and Yorba. Location and use ~nd zoning of surrounding area explained by Mr. Reinland. Correspondence from the following read by Clerk: Panston Ranch owners: County Planning~ Byron EvanS, Phillip Rocco, and petition originally fLled with Planning Commission andprotesting said change and consisting of approximately 445 home owners presented. --- Those speaking in favor of zone change: Alex Bowie, attorney for appiicant spoke and submitted document of eight adjoining property o~ners stating "no objections" to the change. Those spe~aking against zone change: A. Theurich, representing TAHOA Mrs. Flearuing, 14401 Howland Way Mrs. E. McKown, representing Citizens' Committee There being no further comments or objections, the Hearing was closed at 8:21 P.M. Mr. T. Adsit, Planning C6nsul'tant, p~sented results of study to the Council. Moved by Klingelhofer, seconded by Mack that due to the substantial change in plans, zone change 63-133 be Ralphs back referred back to the Planning Commission for further to Comm study and reconsideration. Motion passed. Mr. Sheridan voting no. Minutes of the Planning Commission relative to ZC 63'133 read. Mayor Doney called a five ~inute recess. ' Meeting reconvened at 8:41 P.M. · Hearing opened at 8:43 P.M. on UP 63~155 of Newport Hearing Colonial to permit the construction of a planned Newport development on property ~ncated at ~/W corner Of Main and Colonial Willisms Street. Application explained and fifteen recommehded condi%ions presented by Mr. Reinland. 246 Fetition in favor of application and signed by five property owners within 300' radius read by clerk. Mr. Humston was absent 'from Ithe meeting from 8:43 to 8:49 P.M. Mr. J. Wall, attorney, spoke on behalf of applicant and filed comparison brochure. Those speaking agains UF 63-155: E. McKowan, M.~ DeMong, Mrs. Jane DeMong. There being no further coments or objections, the hearing was closed at 9:02 F.M. Moved by Sheridan, seconded by Humeston that UP 63-155 be denied. Motion failed - roll call: Ayes: Sheridan, Humeston. Noes: Klingelhofer, Mack, Doney. Moved by Klingelhofer, seconded by Mack that Resolution Res. 695 No. 695 approving UP 63-155 be passed and adopted. Motion carried. Aues: Klingelhofer, ~M~ck, Doney. Noes: Sheridan, Humeston. Hearing opened a~ 9:12 on ZC 64-13~ of Fete Meyer to Hearing change the rear 50' of proper~y at 540 W. First Stree~ ZC 64.134 from R-3 to C-1 zone. Myers Application and reasons for change explained by Mr. Reinland andfindings ~and recommendations of the planning Comission read. Mr. Ij. Stafford spoke on behof of the applicant. There being no objections or further comments, the Hearing was closed at 9:16 F.M. Moved by Sheridan, seconded byM~ck that ZC 64-1~ b~ granted and attorney to draft Ordinance. Carried by roll call -Ayes: Doney, Sheridan, Mack, Kli~elhofer. Abstained: Humeston. Hearing Hearing opened at 9~21 P.M. on Z.C. application 64-135 ZC 64-135 of Siegel andGreenwood to rezone property on S/E corner Siegel-Greenwood of Fourth and Prospect from R-4 to C-1 or on recommendation of the Planning Commission-that easterly 517' of subject property be zoned 100-C-l-15,000. Application and surrounding area explained by Reinland and recommendations of ~lanning Commission read. Those speaking in favor of change: John Siegel, Skyline Drive. B. Windolph ' C. Greenwood. Those speaking against change: H. Badger, Brookline Way R. Ballison, Olive Tree Circle B. Underwood, Olive Tree Circle There being no further comments or objections, the Hearing was closed at 9:45 P.M. Moved by Humeston, seconded by Sheridan that further action Hearing on ZC 6~-135 be continued to the first meeting in March cont. being March 2nd, for further study and~recomendations of Mr. T. Adsit. Carried. Recess called by Mayor Doney - ~eeting reconvened at lO P.M. Hearing opened at 10:02 P.M. to consider appointment Hearing of a member to the Tustin Planning Comission and appt. nine applications submitted. Planning Corm. 247 There being no comments~ the Hearing was closed at 10:05 P.M. Moved by Klingelhofer, seconded by Mack that Resolution No. 696 be passed and adopted appointing Mr. Eugene Jacobson JacObson to fill vacancy on Planning Commission - ~erm appt. to be effective immediately and to expire November 8, 1964. Carried by roll call: Ayes: Doney, Humeston, Mack, Klingelhofer. Abstained: Sheridan. Moved by Humeston, seconded by Mack that Civil Defense Director Williamson be authorized to accept appointment Williamson to National Civil Defense Council ~o represent Region Nat'l CD 7 - Schools~ and Institution Comittee. Carried. Council City Engineer reported that improvements for Tract 493~I had been completed to satisfaction of Street Department~ Tract 4934 and Engineer and recommended that Improvements be Imprev. accepted and bonds exonerated. Moved by Klingelhofer, seconded by Humeston! that imp- rovements in Tract 4934 be accepted and bonds be exonerated as recommended. Carried. ~ ' Moved by Mack, seconded by Sheridan that the Mayor and e~ City Clerk be authorized to execute agreement with the Agreement County relative to traffic signal at First and Newport. Signal Carried. 1st & Newport Moved by Humeston, seconded by Mack, that City Engineer Concrete for be authorized to purchase additional $150.00 in concrete Third & Pacific work for gutter drainage a~ Third and Pacific Streets. Carried. __ Request f~om Police Commissioner and Chief ~o hire additional patrolman and reco~mmendations submitted and Additional re~d by ~lerk. Patrolman Moved by Sheridan, seconded by Klingelhofer that Madden appt. request and recommendation be appreved and Mr. patrolman Richard Madden be employed effectiv~ February 1964. Carried. Moved by Sheridan, seconded by Mack that Resolution 697 a Resolution of intention to abandonI and vacate~ the portion of First and Newport Streets within the City Res. 697 of Tastin, b~ ~ead by ~ti~le only. Carried unanimously. Administrator Mr. Coco requested that adoption of Ordinance defining duties snd powers of City Administrator be deferred to March 2nd meeting. 248 Ord. 250 Moved by Sheridan, seconded by Humeston that second reading of Ordinance No. 250 relative to City Administrator be continued to March 2nd Meeting. Admin. Moved by Klingelhofer, seconded by Mack that above motion committee be referred to a committee design~at~d by the Mayor to try to expedite and bring decision prior to March 2nd.~ Carried. Moved by Sheridan, seconded by Mack that committee appointed by the~Mayor be from the citizenry at large and no member of Council or Planning Commission be appointed. Carried. DeMong Moved by Mack, seconded by Sheridan that Ordinance No. Ord. 251 251 mending the Business License O~dinance be read by title only. Carried unanimously. Moved by Mack, seconded by Sheridan that Ordinance No. 251 be passed and adopted as an urgency measure. Carried by roll call: Ayes: Doney, Sheridan, Humeston, Mack. NoEs: Klingelhofer. Recall Mr. E. McKown informed the Council that recall p~o- ceedings would he instigated immediately on Councilman Klingelhofer, COuncilman Mack and Mayor Doney. Moved by Sheridan, seconded by Mack that cerrespohdence Taxi Permit from Glen T. Gaines requesting Taxi Permit be refe rre~ to Chief Sissel for report at next regular meeting. and that Yellow Cab and Black and Green Checker Cabs of' Mr.- Gaines be penaitted to continue temporarily' until recommendation of Police Chief is submitted.
