EL MODENA-IRVINE CHANNEL (FACILITY F07) IMPROVEMENTS BETWEEN THE
SANTA ANA (I-5) FREEWAY AND DOWNSTREAM OF MICHELLE DRIVE
RECOMMENDATION: -
That the Tustin City Council at their meeting of November 6, 1989
approve the following actions:
1. Execution of the professional services agreement with the firm of
Robert Bein, William Frost and Associates in the amount of $35,320
to provide the engineering services for the design of the E1 Modena-
Irvine Channel improvements between the I-5 Freeway and downstream
of Michelle Drive.
2. Solicitation of proposals and execution of a professional services
--
agreement for the geotechnical services associated with the E1
Modena-Irvine Channel design.
BACKGROUND:
As a part of the development of the Auto Center Retarding Basin into two
developable building sites, it will be necessary to complete certain
-public. improvements as follows:
1. Extension of Auto Center Drive easterly approximately 600+ feet.
2. Extension of the 81-inch diameter storm drain easterly from its
present terminus to, and connection with, the E1 Modena-Irvine
Channel.
3. The extension of the E1 Modena-Irvine Channel mainline improve-
ments southerly between the Santa Ana (I-5) freeway and Michelle
Drive.
Items number 1 and 2 are currently in progress and this action item
pertains primarily to the extension of the mainline E1 Modena-Irvine
Channel improvements described in number 3 above.
During the budget workshops for the fiscal year 1989-90, the City
Council approved the restriction of funds in the amount of $1,300,000 in
-.--~.he Capital 'Improvement Fund for this E1 Modena-Irvine Channel Improve-
=_nt Project.
DISCUSSION:
At staff' s request, the firm of Robert Bein, William Frost and
Associates has submitted the attached proposal dated October 17, 1989 to
provide engineering services for the design of the E1 Modena-Irvine

Channel improvements between the I-5 freeway through Michelle Drive.
The consultant proposes to perform the tasks outlined in Work Items 1
through 11 for a fee of $31,320 plus reimbursable costs in the estimated
amount of $4,000.00.
Staff did not solicit proposals from other consultants because the firm
of Robert Bein, William Frost and Associates previously completed all of
the channel design upstream of the freeway for the City, as well as all
of the preliminary studies of the subject channel design project. The
fee as submitted is a reasonable amount to complete the tasks as
outlined in the proposal. As indicated within the proposal, the geo-
technical servicesare not inlcuded and it is suggested that the City
request proposals for these services. It is 'estimated that the
geotechnical services for this segment of channel design will cost about
$15,000 - $17,000.
It is staff's desire to commence this channel design work at the
__earliest practical date so that a construction contract can be awarded
o later than May 1990. This will allow five months of construction
_ime prior to the 1990 wet season. As you are aware, this project
location lies totally within the city limits of Irvine and is a Regional
Flood Control Facility under the jurisdiction of the Orange County
Environmental Management Agency. The intent of this project is to
eliminate the backwater effects within the F07 Channel northerly of the
I-5 freeway and reduce the need for the Auto Center Retarding Basin.
In order to proceed with this project design and construction, the
following actions must be completed:

Authorization to hire the firm of Robert Bein, William Frost and
Associates to provide the engineering services for the design of
the E1 Modena-Irvine Channel as described above for the fee of
$35,320.00.
·
Solicit proposals and award a contract for the required geotechnical
engineering services associated with the channel design. Estimated
cost is $15,000 to $17,000.
·
Authorize a supplemental 1989-90 budget appropriation from the
appropriated reserves of the Capital Improvement Fund in the
following amounts for said project:

PROFESSIONAL SERVICES AGREEMENT
AGREEMENT, made and entered into this
, 1989, by and between CITY OF TUSTIN, a
day of
municipal
corporation (hereinafter referred to as "City") and ROBERT BEIN, WILLIAM
FROST AND ASSOCIATES, 14725 Alton Parkway, Irvine, CA 92718 (hereinafter
called "Consultant").
WITNESSETH:
WHEREAS, City desires to employ Consultant to furnish the necessary
services for providing engineering design services for construction of
proposed E1 Modena-Irvine Channel (Facility F07) and appurtenant
facilities between the Santa Aha (I-5) freeway and downstream of Michelle
Drive, hereinafter referred to as "Project"-; and
WHEREAS, Consultant is qualified to provide the necessary design
~ervices in connection with said Project and has agreed to provide the
necessary services; and
WHEREAS, Consultant has submitted to City a proposal dated October
17, 1989, a copy of which is attached hereto and marked Exhibit "A" and is
by this reference incorporated herein as though set forth in full herein
("the Proposal.").
NOW, THEREFORE, City agrees to employ and does hereby employ
Consultant to provide the professional services for the Project, and City
and ~Consultant for the consideration hereinafter set forth, agree as
follows:
Section 1: Scope of Consultant's Services. Consultant agrees to
furnish to City consulting services for the project. These services shall
include all of the services outlined in the Consultant's proposal dated
October 17, 1989, (Exhibit "A").

Section 2: Time for Completion. It is hereby understood and
.~utually agreed that the time for completion of the work to be performed
by Consultant is an essential condition of this agreement. Consultant
agrees that it shall prosecute regularly and diligently the work of this
agreement accordingly to reasonable schedules established by City for the
various items.described and as outlined within Consultant's proposal.
Consultant shall not be accountable for delays in the progress of its work
caused by any condition beyond its control and without the fault or
negligence of Consultant. Any delays shall not entitle Consultant to any
additional compensation, regardless of the party responsible for the
delay.
Section 3: Compensation. The compensation to be paid under this
agreement.shall be as set forth in the Consultant's proposal and marked
'xhibit "B" with a total cost estimated at $35,320.00. Progress payments
for work completed will be paid as the work progresses, within thirty (30)
days of the date of consultant's' invoice.
Section 4. Miscellaneous Provisions.
A. City and Consultant further agree to the following conditions:
(1) City, by notifying Consultant in writing, shall have the
right to terminate any or all of the services covered by this agreement at
any time. In the event of such termination, Consultant shall be paid for
'services rendered to the effective date' of the termination. "
· (2) cOnsultant agrees that it shall proceed immediately and
diligently t° perform the services provided for in this Agreement upon
receipt of notice from city to proceed therewith.
(3) The terms and provisions of this agreement shall extend to
and be binding upon and inure to the benefit of heirs, executors,
administrators, successors and assigns of the respective parties thereto.
(4) Consultant shall perform the services hereunder as an
independent contractor and under no circumstances or conditions shall
Consultant and any of its agents, servants and employees, be considered
as an employee or agent of the City.
(5) Consultant shall perform all services required under this
agreement using that degree of care and skill ordinarily exercised under
similar conditions in similar localities, and shall be responsible for
~11 errors and omissions for services performed by Consultant under the

terms of this Agreement. Consultant agrees to indemnify, defend and hold
City, its agents, employees, successors and assigns harmless from any
·
loss, damage, injury, sickness, death, or other claim made b~ other
persons and from all costs, expenses and charges, including attorney's
fees, arising from Consultant's negligent performance of this agreement.
Consultant shall maintain in full force and effect during the term of
this agreement, its existing policies of insurance for which certificates
of insurance have heretofore been delivered to City.
(6) . Consultant shall carry and pay for such compensation
insurance as is necessary to fully protect Consultant and its employees
under California Worker's Compensation Insurance and Safety laws, to

- relieve City from all responsibility under said laws in connection with
the performance of this agreement, and upon execution of this agreement,
to file with City a certificate certifying to said protection.

(7) Consultant certifies that there shall be no discrimination
against any employee who is employed in the work covered by this
agreement, or against any application for such employment, because of
race, religion, color, sex, or national origin including, but not limited
to, the following:
a. Employment, upgrading, demotion or transfer,
recruitment, or recruitment advertising, lay-off
or termination, rates of pay or other forms of
compensation, and selection for training, including
apprenticeship. "
(8) Consultant shall provide City monthly with a detailed
itemization of all work performed, and the fees accrued thereon, in
complete and sufficient detail to fully apprise City thereof.
IN WITNESS WHEREOF, this Agreement was executed by the parties
on the day and year first above written.

In accordance with your request, Robert Bein, William Frost & Associates (RBF) is pleased
to provide you with this proposal for consulti.ng engineering services- to design and prepare
final engineering plans for the channel improvements from the Santa Ana Freeway through
Michelle Drive. The scope of work includes the preparation and processing of a project
report for the proposed improvements, final engineering design for approximately 900 lineal
feet of channel improvement, and environmental services for preparation and processing
of a Negative Declaration. A critical design item which is not included in our scope of
work is the geotechnical report. It is anticipated that the City would want to contract
separately for this service with a geotechnical firm.
A detailed scope of services and estimate of professional fees has been assembled for your
review. These items are at/ached as "Exhibit A" and "ExhiBit B". We at Robert Bein,
William Frost & Associates appreciate this opportunity to be of service to the City of
Tustin, and are looking forward to as, sisting you on this project.

SCOPE OF SERVICES

Provide engineering services to collect and review existing right-of-way documents
and "as built" plans for the existing improvements along the project .reach of the E1
Modena - Irvine Channel, prepared by others and provided by the City. Review
anticipated fight-of-way requirements iricluding construction easements. Research
and review previous hydrology studies, channel pr. oject reports/masterplan, utility
plans, and proposed freeway improvement plans. Work under this item shall include
review of available background data information related to the channel
improvements, provided by the City report for the proposed channel improvements
provided by the City. The work under this item shall include a field review of the
project storm drain reach. Any work relating to potholing existing underground
facilities is specifically excluded form this scope.
Provide engineering services for the compilation of a Project Report which will serve
as the basis of design fOr the channel alignment and facility sizing. The report shall
include a presentation of the economic analysis of the channel alternatives, final
design discharges.: docum._e_~tatiQn of hydraulics, cost estimates, and construction
schedule acceptable for plan check by the jurisdictional agencies and the City. Work
under this item shall include determination of preliminary vertical and horizontal
alignments for the proposed channel improvements. Preliminary hydraulics will be
performed based upon these alignments to determine facility sizes-. In addition,
analysis of the existing downstream channel from Peters Canyon to the Santa Ana
Freeway will be performed to determine adequate downstream hydraulic control.
A conceptual plan and profile will be prepared for review by the City, Work under
this item is based on the construction Of approximately 900 linear feet of channel
improvements. Existing utility constraints shall be identified for each alternative.
The Consultants shall utilize "value engineering" and investigate alternative
construction materials and methods which may provide economic benefits to the City.

Provide services to prepare negative declaration for the El Modena - Ir{,ine Channel
proposed channel improvements. Consultant will review proposed flood control
improvement designs, as well as additional relevant environmental documents,
including the City of Tustin General Plan, and documentation and technical studies
for Tustin Auto Cch/er and Jamboree Road. The preliminary phase of the work
effort will be followed with site visits and photo surveys of the Project site.
Following the review of available information, prepare an Initial Study in accordance
with the California Environmental Quality Act (CEQA), to determine if the project
may have a significant impact on the environment. If any adverse impacts are
identified, Consultant will suggest measurers to mitigate the impacts, thereby
enabling the project to qualify for a Negative Declaration.
Consultant will provide documentation of factual basis for the finding in the Negative
Declaration that-the project-wilt not have a significant effect on the environment.
The Initial Study will contain the following information:
A description of the project including the location of the project. A
graphic exhibit illustrating the project location will also be provided;
· A description of the environmental setting;
An identification of the environmental effects by use of~ an
environmental checklist, matrix or other method;
· A discussion of ways to mitigate the ~ignificant effects identified, if any;
An examination of whether the project is consistent with existing
zoning, plans, and other applicable land use controls;
Pursuant to recent legislation (Sundstron versus County of Mendicino,
June 30, 1988) Consultant will .provide brief explanations and evidence
for the findings of "No" responses on the. Initial Study.
A Negative Declaration will be prepared for the project if the Initial Study shows
that there is no substantial evidence that the project' will have a significant effect on
the environment.
The Negative Declaration will include:
A brief description, of the project, including a commonly used name for
the project;
· The location of the project, shown on an exhibit;
An attached copy of the Initial Study documenting reasons to support
the finding;
An inventory of mitigation measures, if any, included in the .project to
avoid potentially significant effects.
Consultant shall also provide the City of Tustin with a Notice of Intent to Adopt a
Negative Declaration. Pursuant to CEQA Section 15072 this notice can be sent by
the City of Tustin, to all organizations and individuals who have previously requested
such notices and can also be published in the newspaper.
If after Public Review of the Negative Declaration, the Negative Declaration is
approved by the City of Tustin, Consultant shall prepare a Notice of Determination
for the Negative Declaration.

In addition, in compliance with State Senate Bill AB 3180, Consultant will prepare
a Mitigation Monitoring Plan. The Mitigation Monitoring Plan will include:
Suggested wording for Conditions of apprOval
Identification of responsible monitoring agencies
Indication when monitoring must occur
Frequency of monitoring
Established compliance criteria
Provide field Surveying services to obtain cross sections of the 'existing channel to
augment the existing aerial topography provided_by the. Client. Any other field
information required for the final design of the storm drain shall be obtained under
this work item. Additional culture topography shall also be obtained as required.
This work item does not include obtaining elevations and locations of existing
underground utilities. "As-built" elevations and locations of previously constructed
channel improvements will be field verified.
Provide final engineering services for the hydraulic analysis of the construction plans
generated. A final water surface profile will be determined for the main channel and
storm drain laterals. Work under this item will include the detailed hydraulic
analysis and operation of any specialty hydraulic structure. Analysis will be prepared
for both the interim and u_l_fimate down_stream hydraulic conditions.

Provide final engineering services for the preparation of construction plans for the
proposed channel improvements based upon the recommended results in the Project
Report. Construction plans shall be prepared on standard Orange County
Environmental Management Agency 1" = 40' scale mylar drawings and utilizing all
the compiled base sheet information from research, utility investigation, shrvey data,
and aerial topography. Utilities within the proximity of the .construction will be
located on the plan and crossings also shown in the profile. The construction plans
will include all structural details; pipe schedules, quantity estimate, lateral profiles,
and utility relocations/replacements. The drawings will be prepared using the
OCEMA Standard Plans and Design Manual. This work item is based on the
proposed construction of 900 linear feet of channel improvements.
Provide engineering services for the structural design of all proposed channel
structures. Work under this item shall include design of all specialty structures,
channel sections, junction structures, and transition structures.' Structural calculations
will be provided in an acceptable format for the review by the governing agency. In
addition, this item will include special channel design requirements for protecting the
existing Michelle Drive Bridge. This item includes the development of all structural
details necessary to construct these facilities.
Provide final engineering services to prepare a basis of design report which will
consist of a compilation of all hydraulic calculations, hydrology, design assu'inptions
and criteria, structural calculations, backup for quantity and cost estimates. The
basis of design report will serve as a reference document for the channel design and
'be utilized during the review process for the various agencies.

The work item shall include the final hydraulic analysis of the channel system as
indicated on the plan and profile drawings. Analysis of the channel hydraulic
gradient shall be performed utilizing the Los Angeles County "Water Surface Profile
Gradient Program" and existing downstream hydraulics utilizing HEC-2.
Provide engineering services for the preparation of the special provision portion of
the construction specifications. This document shall be prepared, in a standard
format acceptable to the Client and from example "boiler plate" provided by the
Client. The Consultant shall work closely with the City in the preparation of this
document.
Provide engineering services for post-design consultation. Consultant shall furnish
advice to the City concerning construction difficulties and plan interpretation to
insure the timely completion of the project. In addition this work item shall include
plan and specification interpretation during both the construction and bidding phases
of the project. The fee indicated is based on providing 16 manhours at an average
billing rate of $70/hour. Should the required work effort exceed this budget amount,
the Client will be notified and additional work will be billed on a time and materials
basis.
Provide engineering services required for consultation, meeting attendance,
presentation, and project administration. Work under this item shall include
processing the plans through the various jurisdictional agencies. The fee indicated
is a budget amount. Should the budget amount be exceeded, the Consultant will
provide additional service as required on a time and materials basis with the
approval of the City.

Client agrees to compensate the Consultant for such services as follows:
Consultant shall complete the work outlined above and 'invoice City on a percentage
completion basis. The maximum fees indicated below shall be in addition to direct costs
including all filing fees, computer time, reproduction and blueprinting costs, photo costs,
etc., advanced by the Consultant, and invoiced monthly.
