REQUEST FOR WAIVER OF STREET DEDICATION - IRVINE BOULEVARD
RECOMMENDATION:
Pleasure of the City Council.
BACKGROUND:
At their meeting of October 16, 1989, the City Council reviewed a
request from Chevron USA for the waiver of street dedication along
Irvine Boulevard and Newport Avenue adjacent to the service station site
at the northeasterly corner of the intersection. A copy of the previous
staff report dated 10/10/89, Chevron USA's letter of request dated
9/15/89, and a preliminary plot plan of the site are attached for the
City Council's reference.
-after discussing this item with the representative of Chevron and the
Yaff, the matter was referred back to.staff to meet with Chevron to
determine what modifications/alterations could be made, if any, along
with the requirements of the street dedications.
DISCUSSION:
On October 19, 1989, staff met with Mr. Fiscus of Chevron USA to review
the impacts of the required street dedications on the existing service
station development and its proposed'modifications/alterations. As a
result of this meeting, the following has been determined:
1. The remaining distances between the existing building footprint
and the proposed street rights-of-way lines inclusive of dedication~
are not adequate for on-site circulation.
2. Adequate on-site circulation per Chevron USA would include a 10-foot
wide service aisle between the dispenser island and the stree~
right-of-way line and a double'20-foot wide aisle between the
dispenser island and the existing building.
3. The movement of the dispenser islands would create the need to
relocate and refabricate the canopy over service aisles in lieu of
the proposed minor alterations.
As a result of this re-evaluation, it has been determined that the
~roposed alterations proposed by Chevron USA would not be compatible
,~ith the staff-requested street dedications. It is also noted that, if
the street dedications are required, Chevron USA would most likely not
proceed with the site improvements due to the resultant impacts to the
operation of the site.

An alternative solution would be to require the dedication by deed or
irrevocable offer of dedication and not exercise the use of the property
until such time the traffic demands require the intersection
improvements. At that time the City would most likely be required to
acquire the remainder of the parcel as a' total acquisition due to the
impacts to the business operation.
In the event the street .dedications are not required and it is
determined that the City has not adequately protected the arterial
highway rights-of-way as prescribed in the County of Orange Arterial
Highway Financing Program (AHFP), the City could be designated
ineligible for future AHFP, OCUTT, or FAU funding programs.

That the Tustin City Council at their meeting of October 16, 1989 deny
the request by Chevron USA, Inc. for waiver of street dedication along
Irvine Boulevard and Newport Avenue adjacent to their development at the
northeasterly corner of the intersection.
BACKGROUND:
Chevron USA, Inc. has requested a waiver of the required street
dedication along Irvine Boulevard and Newport'Avenue at the northeasterly
corner of the intersection with respect to the proposed alterations of
the Chevron site..,
-These proposed alterations to the existing Chevron station generally
~n'sist of the following improvements:~
1. Relocation of restrooms to new location detached from existing
building. ..
2. Construction of new utility building detached from existing'
building.
3. Modification of existing building to provide an office space,
vending area and cashier area.
4. Installation.of..new product dispensers on both service islands.
5. Modification to canopy over service islands.
6. Installation of new concrete service area pavement.
Irvine Boulevard between Newport Avenue and Browning Avenue is currently
classified as a modified major arterial highway 'in · both' the CitY and
County of Orange Master Plan of Arterial Highways. The modified major
arterial requires a right-of-way width of 100 feet except at
intersections. Newport Avenue between Irvine Boulevard and Old Irvine
Boulevard is classified as a primary arterial highway which requires 100
~eet of right-of-way width. Both streets adjacent to the Chevron Station
~rrently exist as 50-foot half street right-of-ways,-

DISCUSSION:
Staff has determined from traffic projections t.hat-the future operation
of the intersection will requ,ire dual left-turn movements from each leg
of the intersection. The installation of dual left-turn movements would
require additional right-of-way (10 feet) along Irvine Boulevard and .... (8
feet) along Newport Avenue. It has been requested in the conditions of
approval of the site plan revigw that street dedication be required on
both streets. "In''' addition to the street dedication, Chevron should
consider relocating the fuel dispenser island under their current project
to conform to the dedications and preclude future ~disruption to the
station operation.
Chevron USA, Inc,~ has requested a waiver of the street dedication per the
attached letter dated 9-15-89, due to the property not being owned by
Chevron. Chevron has a lease on_the property, from Mrs. Shirley Griset
which will run for an additional twelve years. Any street dedication at
this site would require action by the property owner, Mrs. Griset, ~n
lieu of Chevron USA, Inc
~-~The staff is only requesting dedication at this time and is not request-
ng that any street improvements be made at this time. Dedications have
~lready been made at the northwesterly corner of the intersection (Plaza
Lafayette) and the.developers at the southwesterly corner have already
included the required dedication into their preliminary plans for
development. ·

Chevron U.S.A. would like to request that you schedule the
above referenced Design Review Case condition #1 of Public
Works/Engineering Department comments on the City Council
agenda for October 2, 1989. Chevron requests a waiver of
this condition (right-of-way dedication along both Irvine
Blvd. and Newport Ave.) for our latest proposed remodel.
The property is not owned by Chevron, but is owned by Mrs.
Shirley Griset. Chevron's lease Will expire in twelve
years, at which time the owner has expressed a desire to
redevelop all the properties on that corner. At that time
the city would have an opportunity to require the
dedication. You have in your possession copies of our
proposed Site Plan & Elevations for the remodel. If you
