STATUS:
THIS PROJECT IS COVERED BY A PREVIOUS EIR (85-2) FOR
THE EAST TUSTIN SPECIFIC PLAN. NO ADDITIONAL
DOCUMENTATION IS REQUIRED.
RECOMMENDATION
It is recommended that the City Council approve Final Vesting Tract'
Map 13796 by adoption of Resolution No. 89-170.
BACKGROUND
On. April 24, 1989, the Planning Commission adopted Resolution No.
2587 recommending to the City Council approval of Vesting Tentative
Tract Map 13796, a request to subdivide 12.268 acres into 5
numbered lots and 4 lettered lots to accommodate a 108 condominium
dwelling units development. The City Council approved Vesting
Tentative Tract Map 13796 on May 15, 1989 by adopting Resolution
No. 89-59. This approval included numerous conditions which the
applicant has complied with. The final map is now ready for
recordation with the Orange County Recorder's Office. Prior to
recordation, the final map must be reviewed and approved by the
Planning Commission and City Council.

On November 13, 1989 the Planning Commission adopted Resolution No.
2698 recommending approval to the City Council of Final Vesting
Tentative Tract Map 13796.
The subject site is bounded by Tustin Ranch Road to the north,
Gallery Way to the east, and the Tustin Ranch GOlf Course to the
south and west. Planned and anticipated development in the
vicinity includes a 170 unit apartment complex (W~stern National),
private park site, and a 115 unit single family detached
subdivision (Bren-Osgood) to the north and a 137 unit single family
detached subdivision (Bren-Osgood) to the west across Tustin Ranch
Road.
CONCLUSION
The Tentative Map for this project included numerous conditions
which were required to be satisfied prior to recordation. All
required revisions and conditions have been met. Staff has
determined that the Final Map is in conformance with the Tentative
Map approval, requirements of the East Tustin Specific Plan,
Development Agreement, the City's Subdivision Code, the East Tustin

EIR and the State Subdivision Map Act. Based upon this
conformance, it is recommended that the City Council approve Final
Tract Map 13796 by adoption of Resolution No. 89-170.

THE CITY OF TUSTIN APPROVING VESTING
FINAL TRACT MAP NO. 13796
The City Council of the City of Tustin does hereby
resolve as 'followS:
I. The City Council finds and determines as follows:

That Final Vesting Tract Map No. 13796 has
been submitted by the Bren Company.

That a Public Hearing was held by the Planning
Commission on April 24, 1989. At this hearing
the Planning Commission recommended approval
of Vesting Tentative Tract Map 13796 to the
City Council. Subsequently, the City Council
approved Vesting Tentative Tract Map 13796 on
May 15, 1989. ·

That the Planning Commission recommended
approval of Final Tract Map 13796 to the City
Council on November 13~, 1989.

That an Environmental Impact Report (EIR 85-
2 for the East Tustin Specific Plan), as
amended, has 'been certified in conformance
with the requirements of the California

project area.

School Facilities Agreement between the Irvine
Company and the Tustin Unified School
District, the East Tustin Specific Plan, EIR
85-2, the impacts of Vesting Tentative Tract
13796 on School District .facilities, and
reviewed changes an State law, and finds and
determines that the impacts on School District
facilities, by approval of this map are
adequately addressed.
That the site is physically suitable for the
type of development proposed.
That the site is physically suitable for the
proposed density of development.
That the design of the. subdivision or the"

substantial environmental damage or
substantially and avoidably injure fish or
wildlife in their habitat.
That the design of the subdivision or the type

to cause serious public health problems.
That the Final Map is in substantial
conformance with the Tentative Map.

II. The City Council hereby approves Final Vesting
Tract Map No. 13796 subject to final approval of
the City Engineer and also authorizes the City
Manager and/or City Engineer to execute any
subdivision bonds or agreements for the subject
parcel.
PASSED AND ADOPTED at a regular meeting of the Tustin
Planning Commission, held on the 20th day of November,
1989.
