HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT GENERAL PLAN AMENDMENT 89-03, ZONE CHANGE 89-01 TENTATIVE PARCEL MAP 89-110; APPLICANT IRVINE INDUSTRIAL COMPANY RECOMMENDATION It is recommended that the City Council take the following actions: 1. Adopt Resolution No. 89-182 certifying the Negative Declaration for General Plan Amendment, Zone Change 89-01 and Tentative Parcel Map 89-110; 2. Adopt Resolution No. 89-183 approving General Plan Amendment 89-03; 3. Minute Order to introduce and hold first reading of Ordinance No. 1040 by title only. 4. Adopt Resolution No. 89-184 approving Tentative Parcel Map 89-110, subject to conditions. BACKGROUND At their regular meeting on November 13, 1989, the Planning Commission adopted Resolution No.'s 2699, 2700, 2701 and 2702 recommending approval to the City Council of General Plan Amendment 89-03, Zone Change 89-01 and Tentative Parcel Map 89-110 (Attachment A). The applicant is requesting a General Plan Amendment, Zone Change and Tentative Parcel Map for a 2.6 acre site located southeasterly of the future alignment of Jamboree Road and north of Warner Avenue to accommodate industrial development. The proposed General Plan Amendment would change the land use designation on the subject site from P&I (Public and Institutional) to I (Industrial). The proposed Zone Change would change the zoning designation from P&I (Public and Institutional) to M (Industrial). The Tentative Parcel Map would make a remnant parcel created by the Jamboree Road extension through the military base a buildable legal site. The subject site is currently vacant and was created with the future plans to extend Jamboree Road from Edinger Street south through MCAS Tustin. City Council Re~ort General Plan Amendment. 89-03 December 4, 1989 Page 2 Prior to the proposed alignment of Jamboree Road, the site was part of MCAS Tustin, which accounts for the P&I land use and zoning designations. Surrounding uses include MCAS Tustin to the west and north across the future Jamboree Road, Peters Canyon Wash to the east with military housing across the wash and the city of Irvine to the south. A public hearing notice denoting the time, date and location of the hearing was published in the Tustin News. Property owners within 300 feet of the project site were notified by mail pursuant to State law. In addition, a copy of the agenda for the meeting and a.staff report for this item have been forwarded to the applicant and consultant. DISCUSSION i · General Plan Amendment - As noted, the proposed General Plan Amendment would change the existing land use designation from P&I to I. The designation' of this site to accommodate industrial development would be compatible with existing adjacent land uses, particularly when considering the military base operations to the west and proposed development plans within the City of Irvine to the south which is identified or industrial development. The Land Use Element of the General Plan encourages industrial type land uses in this area of the community to buffer the operations of the military base from other more sensitive uses in the community. , Zone Change - The proposed zoning designation of M (Industrial) would allow for compatible industrial land uses and consistent development with proposed development in the City of Irvine immediately to the south. Permitted and conditionally permitted uses, as well as development standards, would be governed by Tustin City Code Section 9242 (see Attachment A). These standards and regulations include uses such as light industrial, research and development and manufacturing. Restaurants and retail commercial uses would be permitted, subject to approval of a conditional use permit. Community Development Department. City Council Report General Plan Amendment 89-03 December 4, 1989 Page 3 · At this time, no specific development plans are proposed. Any site specific proposals would be subject to the City's Design Review process and review by outside agencies to ensure that the applicable development standards and other concerns are satisfied and implemented. Tentative Parcel Map - The proposed map would create a single lot subdivision which would be approximately 2.6 acres in size. The site would be created with the southerly extension of Jamboree Road through MCAS Tustin. The proposed parcel is immediately north of Parcel 4 of Parcel Map 88-151 in the City of Irvine. The subject site would take access through that parcel in the City of Irvine via future Warner Avenue as there would be no street access to Jamboree Road to the~ subject site. A 20 foot ingress/egress easement has been provided on PM 88-151 in the City of Irvine to accommodate this access. The exact location of the access easement to the site would be reviewed and approved with the final map prior to recordation. A conceptual grading plan has been prepared which would rough grade the site with a cross slope of 1% draining to the north corner. The plan identifies that the grade of the site would be raised approximately five feet at the north end and 11 feet at the south end of the site. This would provide compatibility with proposed grading to the south in the City of Irvine (PM 88-151) and proposed road alignment of Jamboree Road which would be at a similar elevation. Sections A-A and B-B identify both interim and ultimate grading improvements upon completion of Jamboree Road. Southern California Edison (SCE) and Marine Corps Air Station (MCAS-Tustin) have also provided comments related to existing utilities on the site. SCE identified a need to provide adequate electrical service in the Jamboree Road improvements to accommodate the anticipated scale of development. In addition, coordination of the improvements should begin early in the process to ensure adequate timing for the improvements. MCAS-Tustin noted concerns related to the utilities in that they are owned by the United States Government and provisions for their relocation and replacement should be constructed as part of the Jamboree extension prior to the abandonment. CONCLUSION The proposed General Plan Amendment, Zone Change and Tentative Parcel Map are appropriate in light of the surrounding military land uses, future development to the south in the City of Irvine and proposed road alignment for the southerly extension of Jamboree Road and would provide for .orderly and harmonious development of the area and City. Staff recommends that the City Council adopt Resolution No. 89-182 certifying the Negative Declaration and Resolution No. 89-183 'approving General Plan Amendment 89-03, introduce Ordinance No 1040 approving Zone Change 89-01, and adopt Resolution No. 89-184 approving Tentative Parcel Map 89-110. · Daniel Fox, Senior Planner Christine A. A Negative Declaration has been completed in' compliance with CEQA and State guidelines. Exhibit A Resolution No. 2702 Page 2 (6) 1.2 Ail construction within a public right-of-way and/or public easement must be shown on a separate 24" X 36" plan with-all construction referenced to applicable City, County or Irvine Ranch Water District standard drawing numbers. (1) 1.3 Ail changes in existing curbs, gutters, sidewalks and (6) other public improvements shall be responsibility of Subdivider. (1) 1.4 Preparation of plans for and construction of: (2) (6) A. All sanitary sewer facilities must be submitted as required by the City Engineer and local sewering agency. These facilities shall include a gravity flow system per standards of the Irvine Ranch Water District. Be A domestic water system must be to the standards of the Irvine Ranch Water District/City of Tustin Water Service, whichever is applicable at the time of plan preparation. Improvement plans shall also be reviewed and approved by the Orange County Fire Department for' fire protection purposes. The adequacy and reliability of water system design and the distribution of fire hydrants will be evaluated. The water distribution system and appurtenances shall also conform to the applicable laws and adopted regulations enforced-by the Orange County Health Department. Any required reclaimed water system shall be to the standards as required by the Irvine Ranch Water District. (1) 1.5 Private streets, storm drain, water and sewer improvement (6) plans shall comply with the "city of Tustin" Minimum (8) Design Standards for on-site Private Street and Storm Drain Improvements. (6) 1.6 The applicant shall secure all applicable permits from Orange County Environmental Management Agency for drainage into Peters Canyon Wash. (1) 1.7 The subject property shall be annexed into the lighting district. The applicant shall provide the City with a letter stating that they will not protest the annexation. Exhibit A Resolution No. 2702 Page 3 DEDICATIONS/RESERV'ATIONS/EASEMENTS (1) 2.1 The (2) (5) (6) (S) · subdivider shall satisfy dedication and/or reservation requirements as applicable, including but not limited to dedication of all required street and flood control right-of-way easements, vehicular access rights, sewer easements and water easements defined and approved as to specific location by the City Engineer and other responsible agencies. *** 2.2 The applicant shall provide evidence to the City Engineer and Community Development Director that appropriate access easements to serve the site through Parcel 4 of Parcel Map 88-151 (City of Irvine) have been secured and recorded in favor of the applicant as no site access will be granted to Jamboree Road. *** 2 3-~The northwesterly boundary of the Tentative Parcel Map Shall be modified to be along the southeasterly right- of-way line of future Jamboree Road. (2) 2.4 A deed notification shall be recorded on the property (6) that includes an approved aircraft/helicopter noise statement and that it is the responsibility of the property owner to inform any tenants of this statement. 2.5 Prior to final map approval, the precise alignment of Jamboree Road extension shall be determined and all required right-of-way along the Jamboree Road frontage shall be dedicated to the City in accordance with said alignment as determined by the Director of Public Works. (1) (2) (6) CONSTRUCTION ACTIVITIES ADJACENT TO PUBLIC RIGHT-OF-WAY -. 3.1 Prior to recordation of the final map, subdivider shall post with the Community Development Department a minimum $2,500 cash deposit or letter of credit to guarantee the sweeping of streets and clean-up of streets affected by construction activities. In the event this deposit is depleted prior to completion of development or City appearance of public streets, an additional incremental deposit will be required. Exhibit A Resolution No. 2702 Page 4 (1) 3.2 Any damage done to existing street improvements and (6) utilities shall be repaired before acceptance of the tract and/or issuance of a Certificate of Occupancy for the development on any parcel within the subdivision. (1) 3.3 Prior to any work in the public right-of-way, an Excavation Permit must be obtained and applicable fees paid from the Public Works Department. GRADING/GENERAL (1) 4.1 Prior to issuance of grading permits: (2) (6) A. A detailed soil engineering report shall be submitted to and approved by the Building Official conforming to the requirements, of the Uniform Building Code, City Grading Requirements, and all other applicable State and local laws, regulations and requirements. Be Preparation and submittal of a grading plan subject to approval of the Department of Community Development based on Orange County Surveyor's. benchmark datum delineating the following information: · · · Methods of drainage in accordance with all applicable City standards. A drainage plan and necessary support documents such as hydrology calculations to comply with the following requirements: a. Provision of drainage facilities to remove any flood hazard to the satisfaction of the City Engineer which will allow building pads to be safe from inundation from rain fall which may be expected from all storms up to and including the theoretical 100 year storm and dedication of any necessary easements on the final map as required. Exhibit A Resolution No. 2702 Page 5 · b. Elimination of any sheet flow and ponding. c. Provision of drainage facilities to protect the lots from any high velocity scouring action. d. Provision for contributory drainage from adjoining properties. All flood hazard areas of record. A note shall be placed on the grading plan requiring Community Development Department approval of rough grading prior to final clearance for foundations. The Department will inspect the site for accuracy of elevations, slope gradient, etc., and may require certification of any grading related matter. Ce Preparation of a sedimentation and erosion control plan for all construction work related to the subject Tract including a method of control to prevent dust and windblown earth problems. De Submittal of a construction traffic routing plan to be reviewed and approved by the Director of Public Works. Written approval must be obtained from adjacent property owners for rights-of-entry for construction activity across lot lines. (1) 4.2 Ail earthwork shall be performed in accordance with the (3) City of Tustin Municipal Codes and' grading requirements. FIRE'DEPARTMENT (1) 5.1 The subdivider shall comply with all requirements of the (6) Orange County Fire Marshal, including required fire flow, installation where required of fire hydrants subject to approval as to location by the Fire Department, City of Tustin Public Works Department and Irvine Ranch Water District, and compliance with all requirements pertaining to construction. No'actual development plans are being considered at this time. Unless otherwise specified in the following sections, any physical deVelopment of the property will require, at minimum, plans to be reviewed and approved by the Community Development Department and separate environmental review as part of the City's Design Review process. Appropriate mitigationmeasures and mitigation monitoring in response to the site specific plans would be developed at the time bf any subsequent reviews. The project is situated in an urban area. The U.S. Marine Corps Air Station (MCAS-Tustin) is located to the west across the future alignment of the Jamboree Road (zoned P&I), the City of Irvine to the immediate south, and Peters Canyon Wash to the east with military housing across the wash. le EARTH - The proposed land use designation amendment and zone change would not result in any change to the existing earth conditions.
