TUSTIN CITY CODE CITATION PROCEDURE
RECOHMENDATION;
That Tustin City Code citations be .sent directly to the
District Attorney's Office for review and prosecution.
BACKGROUND;
Approximately eight years ago, we contracted with the
District Attorney's Office to prosecute most Tustin City
Code citations issued by the Police Department at a cost of
$35.00 per cite. This procedure was approved and author-
ized by minute order of the City Council at that time.
The City Council approved this procedure subject to the
requirement that the City Attorney approve all citations
before sending them to the District Attorney's Office.
In reviewing the process, the Police Department now feels
it would increase efficiency and reduce paperwork if rou-
tine citations for Tustin City Code violations issued by
the Police Department were sent to the District Attorney
without the City Attorney's approval. The City Attorney
concurs and anticipates no problem if we were to change the
procedure and mail them directly to the District
Attorney's Office as we currently do with all other
violations.
This procedure would solve the problem of multiple starting
of arrestees, as well as save time in processing for the
City Attorney's Office and our Records Bureau.
