REQUEST FOR WAIVER OF STREET DEDICATION - IRVINE BOULEVARD
RECOMMENDATION:
Pleasure of the City Council.
BACKGROUND:
At their meeting of October 16, 1989, the City Council reviewed a
request from Chevron USA for the waiver of street dedication along
Irvine Boulevard and Newport Avenue adjacent to the service station site
at the northeasterly corner of the intersection. A copy of the previous
staff report dated 10/10/89, Chevron USA's letter of request dated
9/15/89, and a preliminary plot plan of the site are attached for the
City Council's reference.
After discussing this item with the representative of Chevron and the
staff, the matter was referred back to staff to meet with Chevron to
determine what modifications/alterations could be made, if any, along
with the requirements of the street dedications.
DISCUSSION:
On October 19, 1989, staff met with Mr. Fiscus of Chevron USA to review
the impacts of the required street dedications on the existing service
station development and its proposed modifications/alterations. As a
result of this meeting, the following has been determined:
1. The remaining distances between the existing building footprint
and the proposed street rights-of-way lines inclusive of dedication,
are not adequate for on-site circulation.
2. Adequate on-site circulation per Chevron USA would include a 10-foot
wide service aisle between the dispenser island and the street
right-of-way line and a double 20-foot wide aisle between the
dispenser island and the existing building.
3. The movement of the dispenser islands would create the need to
relocate and refabricate the canopy over service aisles in lieu of
the proposed minor alterations.
As a result of this re-evaluation, it has been determined that the
proposed alterations proposed by Chevron USA would not be compatible
with the staff-requested street dedications. It is also noted that, if
the street dedications are required, Chevron USA would most likely not
proceed with the site improvements due to the resultant impacts to the
operation of the site.

An alternative solution would be to require the dedication by deed or
irrevocable offer of dedication and not exercise the use of the property
until such time the traffic demands require the intersectic
improvements. At that time the City would most likely be required to
acquire the remainder of the parcel as a total acquisition due to the
impacts to the business operation.
In the event the street dedications are not required and it is
determined that the City has not adequately protected the arterial
highway rights-of-way as prescribed in the County of Orange Arterial
Highway Financing Program (AHFP), the City could be designated
ineligible for future AHFP, OCUTT, or FAU funding programs.
