BACKGROUND
Mr. and Mrs Shumar have requested that the City consider granting them a
Temporary Certificate of Occupancy for the residence at 175 Mountain View prior
to completion of certain exterior site improvements.
The Shumar's have been temporarily residing in a trailer on the subject property
during their construction of an approximately 3,244 square foot single family
home and garage. Construction of the home commenced on May 30, 1985 when
building permits were issued for the relocation and consolidation of two older
dwellings and construction of additional floor area to combine the units and to
but lda garage.
A walk through inspection of the subject property was conducted in late June by
the' Building Division to determine what progress has taken place since the last
recorded inspection, and to come up with a "punch list" of required work to be
performed before final occupancy. Since the City's last inspection nearly a
year ago for drywall nailing, work on the project has continued on the inside
with such items as flooring, cabinets, finish carpentry and mechanical work in
the kitchen, hood (large commercial type). Staff still has concerns that final
inspection and completion will be needed on exterior stairs/landings, electrical
work, plumbing, mechanical work, fireplace construction, carpentry, doors, fire
protection between the house and garage and exterior door weatherstripping.

The property owner stated that all the above work would be completed by the time
a "Temporary Occupancy" is requested which is anticipated sometime in late July.
Exterior site improvements that are also not completed that the property owner
would like to defer for up to a year include: completion of grading plans;
finished grading and drainage line installation; the driveway approach; the
driveway and landscaping. Original conditions of the building permit issued in
November, 1985 required the applicant to submit a grading plan prepared and
signed by a registered Civil Engineer, which has not been submitted. Prior to
final Certificate of Occupancy for the project, the Public Works Department
would also require reconstruction or replacement of any missing or damaged
public improvements (curb and gutter, drive aprons, street trees); completion of
a driveway apron to City standards and allocation of the southerly driveway
northerly to provide a minimum two foot clearance between the property line and
top of~ curb cut for the driveway.
Pursuant to Section 308 of the Untform Building Code, no building or structure
shall be used or occupied until a Certificate of Occupancy is issued.
Provisions of this Section of the Code also permit the Building Official,
Subject to his discretion to issue a Temporary Certificate of Occupancy prior to
completion of a project. It is generally not department policy to issue a
Temporary Certificate of Occupancy for anything but minor improvements such as
landscaping; even then the building permit applicant would generally execute a
written agreement to complete all improvements within 30 days and would post a
cash bond to guarantee completion of the improvements.
Since the request of the Shumar's is for up to a year and they have indicated
some hardship in posting a cash deposit, staff would feel more comfortable in
obtaining direction from the City Council on this matter. In the event the
Council wi shes the department to issue a Temporary Certificate of Occupancy,
staff would recommend that all interior building improvements needed for final
occupancy be completed and that a written agreement be executed with a time
schedule for completion on exterior site improvements.
