1988-89 SOLID WASTE COLLECTION FEES TAX ROLL ASSESSMENT
RECOm~ENDED ACTION-
Adopt Resolution No. 88-86 adopting the Solid Waste Collection Report and
approving the Annual Residential Charge of $72.72 per unit for solid waste
collection and the annual commercial can charge of $77.28 per unit for solid
waste collection.
DISCUSSION-
The proposed rates for solid waste collection to be placed on the tax roll for
fiscal year 1988-89 reflect the 3.33% increase in the collection rate based on
the seven adjustment factors and the January 1, 1989 County landfill fee increase
of $3.50 per ton. Our currer, t ~, ~n'lt landfill' gate fee is $1.54 per unit per
month or $18.48 per year. On January 1, 1989 it will increase to $2.43 per month
or $29.16 per year, increasing again on July 1, 1989 to $2.82 per mont'h or $33.84
per year. Using a constant 5,500 units, by July, 1989 the landfill fees alone
will cost the City of Tustin $186,000 per year; constituting 40% of the annual
cost of solid waste collection.
By comparison, the collection fee has been increasing very conservatively since
1985-86, only 7.12% from 1986-87 through 1988-89 for an average annual increase
of only 2.37%. Because the gate fees are increasing so rapidly, the collection
fee has been decreasing as a percentage of the total fee from 72% in 1987-88 to a
projected 60% in 1989-90.
We are introducing the addition of a commercial can service to the tax roll this
year. This will standardize all can service so that it will appear and be
collected from the tax rolls and only commercial bin service will be collected
directly by the contractor. Currently, commercial can service is billed by Great
Western Reclamation. As with residential cans, it is cheaper for the consumer
for the fee to be collected through the property tax bill than direct billing.
In compliance with the Government Code we have mailed approximately 600 notices
for this hearing to all parcels that have not previously had an assessment for
trash collection. This includes primarily the new residential units in the
Tustin Ranch project.

The County has not completed their annual survey of refuse collectqon rates .as of
the date of this staff report but will forward a co)~y when it becomes available.
We have contacted our neighboring communities and find that in the Cowan Heights
and Lemon Heights areas of the County, the annual rate for residential trash
pickup is $82.80. In the cities of Santa Ana and Irvine it is $82.44 per year
and in the City of Orange it is $76.29 per year. On average the proposed City of
Tus.tiy~ate will be 10% below these stated rates.

RESOLUTION NO. 88-86
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ADOPTED PURSUANT TO THE PROVISIONS OF
SECTION 5473 ET SEQ. OF THE HEALTH AND SAFETY CODE OF
THE STATE OF CALIFORNIA, FINALLY APPROVING AND ADOPTING
A REPORT RELATIVE TO PARCELS OF REAL PROPERTY RECEIVING
SOLID WASTE COLLECTION SERVICES, DETERMINING THE
CHARGES FOR SOLID WASTE COLLECTION TO BE ASSESSED
AGAINST THE RESPECTIVE LOTS OR PARCELS OF LAND AS THEY
APPEAR ON THE CURRENT ASSESSMENT ROLL.
The City Council of the City of Tustin does hereby
resolve as follows:
1. The City Council finds an~i determines as follows:
A. That proceedings were duly institute.d,
conducted and completed pursuant to provisions of Section
5473 et seq. of the Health and Safety Code of the State of
California.
B. A written report dated July 22, 1988,
containing a description of each parcel of real property
receiving solid waste collection services and facilities and
the amount of the charge proposed to be levied upon each
parcel fu~. the ' ~
=o~ection of solid waste for the fiscal year
1988-89, was prepared and filed wi.th the City Clerk of the
City of Tustin on July 22, 1988.
C. That a public hearing to hear and consider all
objections or protests, if any, to the aforesaid report and
proposed charges was duly set for August 1, 1988 at 7:00
o'clock p.m. in the Council Chambers 'of the City of Tustin
at 300 Centennial Way, Tustin, California.
D. Said hearing was duly noticed as required by
law, by publication once each week for two successive weeks
on July 21, 1988 and July 28, 1988 in the Tustin News, a
newspaper of general circulation printed and published in
the City of Tustin.
E. At the aforesaid time and place the duly
noticed hearing was held and all persons who were present
were heard and all comments, objections and protes'ts to the
aforesaid report and proposed charges were duly heard and
considered by the City Council.
F. The charges proposed in the aforesaid report
are fair and reasonable, are commensurate with the services
provided, and the charge therefore should properly be
collected on the tax roll in the same manner, by the same

persons and at-the same time as, together with and not
s~parately from, general taxes.
2. The City Council hereby elects to have the charges
set forth in the aforesaid report collected on the tax roll
in the same manner, by the same persons, at the same time
as, and together with and not separately from its general
taxes and hereby authorizes that such charges be collected
on the tax roll, as all prescribed to the provisions of
Health and Safety Code Section 5473 et seq.
3. The resolution shall be effective following its
adoption by a two-thirds vote of the members of the City
Council and shall remain in force and effect and said
charges shall be collected in the manner as aforesaid for
the year 1988-89 and for eac'~ subsequent year as authorized
by the hereinabove referenced sections of the Health and
Safety Code.
4. The City Clerk is authorized and directed to
forthwith file a certified copy of this resolution with the
Auditor of the County of Orange, together with a copy of the
hereinabove-described report and a statement endorsed
thereon over her signature that the said report has been
finally adopted by the City Council of the City of Tustin.
