AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF 'TUSTIN, CALIFORNIA,
AMENDING THE TUSTIN CITY CODE
RELATIVE TO MINUTES OF CLOSED
SESSIONS OF THE CITY COUNCIL.
The City Council of the City of Tustin does hereby
ordain that Section 1306 be added to Chapter 3 of the Tustin
City Code to read as follows:
~ 1306. Minutes of Closed Sessions of the City
Council. (a) Ail closed sessions of the City
Council shall be tape recorded and the recorded
tapes of such meetings shall be retained by the
City Clerk. Such tapes shall be sealed and
permanently retained by the City Clerk. The
recorded tapes shall be available only to members
of the City Council or, if a violation of the
Ralph M. Brown Act, Government Code Sections
54950-54961, is alleged to have occurred at closed
session, to a court of general jurisdiction of the
County of Orange. The recorded tapes shall not be
a public record subject to inspection pursuant to
California Public Records Act (Chapter 3.5,
Section 6250.er seq. of Division 7 of Title 1) and
shall be kept confidential.
(b) The'City Manager, City Attorney or a
Councilmember are directed to attend each closed
session of the City Council and keep and enter
into a minute book a record of topics discussed
and decisions made at the meeting. The minute
boQk shall be maintained as a permanent record in
a minute book especially established for that
purpose. Such minutes shall be sealed and
permanently retained by the City Clerk. The
recorded minutes shall be available only to
members of the City Council or, if a violation of
the Ralph M. Brown Act, Government Code Sections
54950-54961, is alleged to have occurred at closed
session, to a court of general jurisdiction of the
County of Orange. The recorded minutes shall not
be a public record subject to inspection pursuant
to California Public Records Act (Chapter 3.5,
Section 6250 et seq. of .Division 7 of Title 1) and
shall be kept confidential.
(c) No person attending a closed session' of the
City Council, nor any of the persons authorized to
review the minutes or tape recordings of a closed

~ession are authorized to disclose the contents,
matters discussed or information received in a
closed session or set forth in the written minute~
or tape recordings of such meetings and all such
persons are directed to maintain the
confidentiality of such information and materials
in accordance with the provisions and intent of
the Brown Act.
PASSSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California, held on the
day of , 1986.
