RECI~MENDAT I ON:
It is recommended that the Redevelopment Agency:
1) Adopt Resolution No. RDA 88-07, receiving and authorizing circulation of
the Draft EIR and setting a public hearing on the Draft EIR;
2) Adopt Resolution No. RDA 88-08, approving the Preliminary Project Report
and authorizing its 'transmittal to affected taxing agencies; and
3) Adopt Resolution No. RDA 88-09, receiving proposed Second Amendment and
authorizing its transmittal to affected taxing agencies and Planning
Commission.
BACKGROUND:

As you are aware, the Department 'of Community Development has been coordinating
with the firm of Katz Hollis in preparation of Amendments to the Town Center
Redevelopment Plan. The proposed Second Amendment to the Town Center
Redevelopment Plan, the required Preliminary Report on the Amendments, and a
Draft Environmental Impact Report on the Amendments have been previously
submitted to the Agency under separate cover.
The proposed Amendment as described in more detail in the above mentioned
documents would accomplish the following:
1). Add certain public facilities and improvements to the list contained within
the' plan to be funded in whole or in part by tax increment revenues;
2)
Extend the Agency's existing authority to acquire property within the
project area by eminent domain an additional twelve years;
3) Make minor code revisions to the plan to clarify the roles of the Agency,
property owners and businesses in the Redevelopment process;

4)
Update language and terminology in the plan to be consistent with recent
changes in State Redevelopment law; and
Increase the ltmtt on the principal amount of bonded indebtedness that can
be outstanding at any one ttme from $20 millton to $35 million to cover all
extsting project debts as well as any additional bonded i~debtedness that
may be tncurred as a result of the additlonal programs proposed. The
Amendment would also restate the existing tax Increment lin:it of $3 million
per year as $90 millton over the 11re of the project; tht:~~ restated limit
Is not affected by the Increase in the bond debt limit.
In proceeding with the processing of the proposed Amendments, the Agency wou]d
need to take the following acttons:
1)
Adopt a resolution receiving and authorizing circulation of the Draft EIR
and setting a public hearing on the Draft EIR.
2)
Adopt a resolution approving the Preliminary Project Report and authorizing
its transmittal to affected taxing agencies'.
3)
Adopt a resolution receiving proposed Second Amendment and authorizing its
transmittal to affected taxing agencies and the Planning Commission.
The above actions have nothing to do with the actual approval on the proposed
Amendments. Agency and City Council approval of the Amendments would be
scheduled at the conclusion of the Environmental review period. Acceptance and
transmittal of the Preliminary Report and Amendment triggers the required fiscal
review process for an Amendment . Immediately following the AgenCy's action on
the above mentioned resolutions, documents would be transmitted to affected
taxing agencies. Any affected taxing agency may call for creation of a fiscal
review committee within 15 days of receipt bY them of the report. However, if
no formal review committee is called, the Agency is still required to consult
separately with each taxing agency.

A RESOLUTION OF THE TUSTIN COMMUNITY REDEVELOPMENT
AGENCY RECEIVING AND AUTHORIZING CIRCULATION OF DRAFT
ENVIRONMENTAL IMPACT REPORT FOR THE SECOND AMENDMENT
TO THE AMENDED REDEVELOPMENT PLAN FOR THE TUSTIN TOWN
CENTER AREA REDEVELOPMENT PRQJECT, AND SETTING A
PUBLIC HEARING THEREON, AND AUTHORIZING PUBLICATION
.OF NOTICE OF COMPLETION AND AVAILABILITY OF DRAFT EIR
AND PUBLIC HEARING THEREON.
WHEREAS, the Tusttn Community Redevelt~pment Agency has prepared a
Draft Environmental Impact Report (Draft EIR for the Second Amendment to
the Amended Redevelopment Plan for the Tustin Town Center Area
Redevelopment Project.in accordance with the provisions of the California
Environmental Quality Act, the State EIR ~uidelines, and local procedures
adopted pursuant thereto.
NOW, THEREFORE, BE IT RESOLVED by the Tustin Community Redevelopment
Agency as fol lows:

i. The Draft EIR for the Second Amendment to the Amended
Redevelopment Plan for the Tusttn Town Center Area Redevelopment ProJect is
hereby found by' the Agency to be sufficient to permit adequate evaluation
and review of the environmental tmpact of the Project.
2. The-Draft EIR, in the form attached hereto, is hereby received
by. the Agency as the Agency's Draft EIR for said Project for purpos, es of
circulation for review and comment by public agencies and members of the
public.
3. A public hearing to receive comments on the Draft EIR is hereby
set for August 22, 1988 at 7'00 p.m. in the Council Chambers, Tustin City
Hall, Tustin, California.
4. The Executive Director of the Tustin Community Redevelopment
Agency is hereby authorized and directed to'
a) file a Notice of Completion with the State Secretary of
Resources in accordance with Section 15085 of the State CEQA Guidelines
(California Administrative Code);
b) provide for the distribution of the Draft EIR for comment
from public agencies and others, including the Project Fiscal Review
Committee, if created, as applicable with respect to the Project; and

c) publish nottce t~ice in the Tusttn News advising the public
of the completion and availability of the D~ft EIR for review and comment
by the public, and of the public heartng thereon for such purpose. Copies
of the Draft EIR shall be m~lntained for public Inspection during the
comment pertod at the Agency's offtce and the City libraries.

A RESOLUTION OF THE TUSTIN COMMUNITY REDEVELOPMENT
AGENCY APPROVING THE PRELIMINARY REPORT FOR THE
SECOND AMENDMENT TO THE AMENDED REDEVELOPMENT PLAN
FOR THETOWN CENTER AREA REDEVELOPMENT PROJECT.
WHEREAS, pursuant to Sections 33354.6 and 33344.5 of the California
Community Redevelopment Law (Health and Safety Code Section 33000 et seq.),
the Tustin Community Redevelopment Agency has prepared a prelimina~ ~'~ort
for transmittal to the affected taxing agencies on the proposed Second
Amendment to the Amended R(,development Plan for the Town Center Area
Redevelopment Project.
NOW, THEREFORE, THru TUSTIN COMMUNITY REDEVELOPMENT ASENCY DOES
RESOLVE AS FOLLOWS:
Section 1. The preliminary report on the proposed Second Amendment
to the Amended Redevelopment Plan for the Town Center Area Redevelopment
Project is hereby approved and adopted by the Agency in the form attached
hereto.
Section 2. The Executive Director of the Tustin Community

Redevelopment Agency is hereby authorized and directed to +,.'~'-smit the

consultation.

A RESOLUTION OF THE TUSTIN .COMMUNITY REDEVELOPMENT
AGENCY RECEIVING THE PROPOSED SECOND AMENDMENT TO THE
AMENDED REDEVELOPMENT PLAN FOR THE TOWN CENTER AREA
REDEVELOPMENT PROJECT, AND AUTHORIZING TRANSMITTAL OF
PROPOSED SECOND AMENDMENT TO AFFECTED TAXING
AGENCIES, THE FISCAL REVIEW 'COMMITTEE AND THE
PLANNING COMMSSION.
WHEREAS, the Tustln Community Redevelopment Agency has prepared a
Second Amendn~nt to the Amended Redevelopment Plan for the To~'n Center Area
Redevelopment Project; and
WHEREAS, any affected taxing agency may call for the creation of a
fiscal review committee with respect to the Second Amendment to the Amended
Redevelopment Plan for the Town Center Area Redevelopment Project, pursuant
to Section 33353 of the California Community Rec'evelopment Law (Section
33000 et seq., Health and Safety Code); and
WHEREAS, pursuant to Section 33353.4 of the California Community
Redevelopment Law, if a fiscal review committee is created the Agency shall
send the proposed Second Amendment to the Amended Redevelopment Plan to the
representative of Orange County to said 'fiscal review committee; and
WHEREAS, the California Community Redevelopment Law provides in
Section 33453 that prior to a joint public hearing on the proposed Second
Amendment to the Amended Redevelopment Plan, the Agency shall submit the
proposed Second Amendment to the Planning Commission for its report and
recommendation; and
NOW THEREFORE, THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY DOES RESOLVE
AS FOLLOWS:
Section 1. The proposed Second Amendment to the Amended
Redevelopment Plan for the Town Center Area Redevelopment Project is hereby
received in the form attached hereto as Attachment A.
Section 2. The Executive Director is hereby authorized and directed
to transmit It~e proposed Second Amendment to the Amended Redevelopment Plan
to each affected taxing agency for purposes of consultations.'
Section 3. In the event a fiscal review committee is created, the
Executiv~ Dire~'tor of the Tustin Community Redevelopment Agency is hereby
authorized and directed to transmit the proposed Second Amendment to the
Amended Redevelopment Plan for the Project to the Orange County
representative of the fiscal review committee created with respect to the
Project.
